On the other hand this is also why it's so important to be honest to your defense lawyer. In the US being found guilty has less to do with if you did something and more to do with whether or not what you did fits in line with your charges. You can technically be guilty but innocent of what you're being charged with.

The lawyer needs plausible deniability. He can be disbarred if he's caught lying to the court, but if it turns out the police officer lied to him. He's blameless in the deception.

The lawyer was dumb to say they "welcome any footage" to begin with. A good lawyer never assumes their client is telling the truth, and will do everything they can to not allow evidence that they have not yet vetted into the court.

I have told my doctor outright illegal things. Can confirm. HIPAA holds VERY strong. (I never hurt anyone else. It was mostly drug related and self-afflicted. It was not an addiction. I have since stopped. Medical reasons, not moral. Hope that answers all questions.)

Oh frikkin shut it about qualified immunity. All that means that you cannot get charged for good faith execution of your duties. You want to make the justice system even more multi tiered than it is now? Make any investigating cops or DA susceptible to lawsuits from spiteful suspects. You think it is had to stop a wealthy criminal today? Just imagine if no one would investigate them for fear of being sued into to oblivion. And no it would do nothing about that case anyway. There are legal routes if one wants to pursue perjury charges or the like, it will just probably not be worth the time and cost. Ending qualified immunity is not only no a cure all, it a 'Created way more problems than it was worth' solution.

Listen as we speak violent criminals are being released on untenable levels. An experiment by progressive DA and mayors. You see the crime shorts. The looting where no one does anything. Now here we have this tv show with this very rare scenario and you need to keep that in mind. Not to mention...you're fkng A right cops deserve professional courtesy AND qualified immunity. Not saying the justice system doesn't have flaws, but name a better one. In some countries the police beat confessions out of people. In Japan they can hold you indefinitely until you confess. We have an excellent legal system.

Actually our legal system railroads people. The number of federal defendants opting for a trial has fallen 60% since 1998, because defendants who opt for a trial are punished by pushes for longer sentences and higher charges. Used to be plea bargaining was a way to let someone off with a slap on the wrist for the sake of convenience, now it’s the only way to guarantee a reasonable sentence

Are they possibly using this fictional event as an example of the flaws in the system, that perhaps this fictional show did things that also happens in reality? I know, its crazy, with all the aliens and car jumps and black people, movies seem like crazy fantasy land, but sometimes between all the cloning and flying cars, they do things that also really happen.

Love this episode, for those who haven’t seen it, there was no ATM camera footage, the lawyer was bluffing because he knew the cop was lying and wouldn’t want to get caught in the lie.

@@ghosty0612 If new evidence comes to light the defense or prosecution can present it. Typically though the judge and both attorneys would see the evidence and then the other side could allow the evidence or object. If they object then the judge has to decide if it should be allowed. The fact that the prosecution caved before even seeing the footage is pretty silly.

These axon bodycams dont "malfunction". When they encounter an error, they restart. This takes roughly 20 to 30 seconds. If they were recording before restarting, they will continue recording. They are very well built, and very valuable to both police and the public.

That's very interesting to know. So technically, even a 'malfunctioning' body camera should encounter only gaps in the footage, correct? Would be great if they also captured error codes, and 'record' / 'pause' user interactions. With time stamps, of course. And time stamps where files are deleted or transferred to a computer Both the full videos and this additional information should be available for audit / as evidence. Camera 'malfunction'? Then you show the time stamped user action 'record', then the footage before the error/malfunction (time stamped: end) - the 'auto reboot' event (time stamped) - the 'resume recording after reboot' event - and the rest of the footage. If all is well, there should be no gaps in the timeline. Because these body cameras seem to 'malfunction' a lot at very convenient times... Question I've been thinking about: Do you know anything about battery life? (I have a Gopro myself - battery drains in about an hour.. I can't imagine that police officers are spending half the day switching out batteries...) -- Sidenote: I'm surprised the camera company hasn't sued for defamation yet, if these cameras are so robust.

I’ve served on 3 juries in criminal cases and always believed the police officer’s version of the event. Then I had a run-in with a police officer over a minor traffic violation. I told the officer my side of the incident and he called me a liar, and threatened me with an other citation for not meekly accepting his version of the incident. Suddenly it occurred to me he didn’t care about truth; he just wanted to write me a citation. Maybe he had a quota, and that was his basis of “truth.”

I would say the most common testimony i have seen with officers is “ the system was down” on 2 dash cams and 4 body cams. Dont worry tho they managed to get them working after they found probable caus /s. If ur ever stopped. Record the conversation, do not tell the police they are being recorded, and cooperate fully. Your lawyer will be able to use the evidence on your recording to help exonerate you

For everyone who doesn't know. This Lawyer doesn't have any video of the conflict from an ATM he made it up. However the officer DID do something he doesn't want seen. But with the lack of evidence on boths sides the plea and potential trial would go worse for the defense.

Qualified immunity does not extent to perjury. This cop would be in trouble for lying to the court irrespective of qualified immunity. Most people who don't know anything (about anything) and who get all their education from youtube probably don't really know what qualified immunity is, how it functions, or why it's required for police to do their job effectively. It's irrelevant to this situation, in any case. An officer isn't allowed to lie to the court. If he gets caught doing it, he'd face consequences for it just like anyone else.

First of all, this is not the actual time to submit evidence. They are in arraignment. This means that he either pleads guilty or not guilty. Second point: The lawyer is required to provide all evidence to the District Attorney's office to create an equal opportunity for both sides. Third point: The ADA would not be permitted to consult the officer at that time. He would need to wait until after arraignment to converse with him. Lastly and most importantly, The ADA and lawyer would not be discussing sentencing or anything else pertaining to a deal in the courtroom. All negotiation is done in private outside of the courtroom. Sorry but this is a terrible example of how a courtroom works.

If I was a judge, the second I hear “body camera malfunction” I respond with “case dismissed, all charges dropped, reimbursement for damages/lost wages/etc. to come out of the officer’s pension or salary.” Cops need to know they can’t get away with this shit.

Body cam "malfunctioned" should = charges dismissed for any non-violent offence, violent offences stay but require extra scrutiny of the officer's testimony.

Time served, dropped to selling without permit, and expunged. Idk man, i feel like you could get...so much more from this. But I like it when those that lie in court get called out.

I love how every court case tv show introduce evidence the DAY of the trial. Like that’s not happening. You’re not catching your opponent off guard like that. That’s cheap and easy, make a show where they actually fight it out like real lawyers

they can't just enter evidence like that, evidence has to be given to both sides and allowed time for assessment.

The part they leave put is that the judge gets the final say when you enter a plea. You have to plead guilty first and hope the judge accepts the plea. Literally just went through this on Friday.

I can attest to the fact that this is exactly how it works. The same lawyers. Working with the same prosecutors. Day in and day out. That's what you really pay for with the lawyer
