The VERY fact that Pigeon Forge knew this property was for sale 2 years prior and never said a word is down right dirty!!! We all know it takes YEARS of planning to build new roads. Why a sudden change of direction? Why didn’t the city buy the house/land when up for sale? Why not imminent domain then? Just dirty in my opinion and I will never be visiting the area again.

For most people an ownership in any type of property is subject to a negotiated price, few being stubborn enough to refuse a fair price. Though a long settled owner's residence in a location they are well happy with and with long developed landscaping, gardens and outbuildings (and maybe a few faithful pets buried there) and the desire to stay there forever more; then nearly any price may 'seem' too little to trade.

Eminent domain is how pigeon forge became a tourist attraction. 💯 My ancestors were given $400.00 to vacate their homesteads in Cades Cove so that they could let strangers drive around.

I know someone who gets $3,500 a month from power company for having their lines on his property, I know it’s terrible, you get paid for someone to use your property. 😂

They are so much more to this story that is talked about on this little news clip. Through the fault of the realtor, they did not know they were going to put the road through their property. They spent a ton of money, renovating the property. The mayor of pigeon Forge watch this all go down literally from his front porch. Years before these people bought this property that road was going through an abandoned campground next door. It was changed because a group of people bought the abandoned campground. One of those people was the mayor’s brother. Again, it is all a big mess. The mayor was called out during a council meeting. The mayor said he had no moral obligation to tell those people to stop renovating the house because a road was going through there. The mayor lived on a hill above these people!

Had nothing to do with the mayor. The plans were were voted on for the change to avoid Taking other land, the mayor withdrew himself from voting on it because of that.

I've been following this story and Pigeon Forge did NOT pay them a red cent because of the mis-characterization of the zoning-the Race home is zoned C-6, not residential as the appraisal indicated, a big discrepancy that allows the city to give them much less value on the house, but because the Races balked at that, they've received NADA. The road went through their house because one of the men on the council owns the camp ground next to the Race's home and the city took out a family's home instead of the camp ground, simple political chicanery and favoritism. The Races spent thousands and thousands renovating that house, other than the purchase price, plus the zoning in the city's appraisal being mis-characterized as residential when it is C-6, commercial, and would have netted the city a hefty sum over time as a business, but values the home as less than it is worth in C-6. But, oh, no, the city literally stole their house. They knew they would be taking that house and watched the family renovate it, said nothing to them. They were completely kept out of the loop so that it would be a surprise and they'd not have time to fight it properly. Eminent domain is government theft. Common good is a myth. What about the family's good? It's the worst thing ever sanctioned in our government. The fat slob sitting there ignoring a family's pain is disgusting.

Here’s a few facts Mrs. Race never mentions in her social media posts; The city approved the route in November 22, 2021. The Races bought the 1047SF home for $306,000 on August 17, 2022 nine months after the route was approved. If they would’ve had a survey done, which everyone should do when buying a property, the survey would’ve clearly marked the right of way. The city offered them $490,000 for the property in October 2023. The Races counter offered with $3 million. The city then offered them $539,000, a figure that represents $514 per square foot. The Races counter offered with $1.5 million. The Races have never presented any appraisals or documentation to the court in support of their $3 million valuation or their latest valuation of $1.5 million. The city did offer to allow them to rent the house out until is was demolished however the Races never made any effort to rent it. The mortgage was paid off from funds held in escrow by the city. I’ve done appraisals in eminent domain cases and courts don’t award valuation based on what ifs. Courts award money according to the value of the property or properties like it the day it was condemned. The court is not going to award them money based on income they claim the property might make for their children and grandchildren in the future. That’s ridiculous.

so Wait, they are offering 500,000 when the house was purchased for 320,000?. Take it from other people who have had the same fight... it never goes the way of the home owner. Agree to the money before the pull the offer back and offer less and cut your losses. The only thing that is going to happen if you don't are vast legal bills.

Yep same thing happened to a property owner in my hometown. The state was expanding a road which needed the property their old mom and pop gas station sat on. Mind you they were old and should have been retired. The state offered a million dollars and they turned it down. Welp the state took it under eminent domain and gave them market value of 125k for the property and building. So this family is fortunate that they are gonna make dang near 200k. Take the 500k pay off the loan and use the rest to put towards a new home. But they want to be greedy and try to get rich when they gonna end up with the loan paid and no extra to put towards a new house.

Seriously, they would have profited 200k less the renovation costs, but they're just trying to squeeze the town now for more money like the mayors brother was doing with the campground... oh you want THIS Land for a project, how about $1M per acre you need sounds like the town isn't budging, they should have taken the 500k and ran since it was an "investment" property they JUST bought anyway

They should've been made aware of the road plan prior to buying the house. They have every right to challenge it in court for more than what the city offered for it.

My family's land was taken by eminent domain in the late 50's early 60's to build a dam. Now the dam is being taken out, do you think they let us buy it back...Hell no, even though we still own the adjacent property

If the parties cannot agree on compensation, the municipality can put its last offer in escrow. It can then take the property in question, leaving the former owner to either take the money offered or take the case to court to get more compensation. Years ago, I actually saw an auction where the buyer begged the former owner to let him move the house to the back of the lot so he could still live there. The man refused, so the buyer took the house apart and reassembled it elsewhere. That lot is still vacant.

No they will give them the last offer but now they think they should get 3 Million for there $300,000 property & suing. They won't get anymore money & they will spend more on legal fees. They could had payed the mortgage off & had money in there pocket to find something else. Facts are they were in negotiations since March 2023. They approved the road 3 months before they bought the property. The sellers probably knew & the realtor should have made them aware. It sucks but it also help the people who live here full time. Most of us can't get to work to serve the tourists because roads are backed up. This road will help.

I doubt the jury will award them the millions they think they deserve when the facts are presented. This is more about greed than eminent domain... These folks paid $306k and 2 years later refused to take $539k... an 85% profit in 2 years. These Ohio folks demanded 3 million bucks, have reduced the demand to 1.5 million.... sorry about a road going through a place you bought as a rental 2vyears ago, but greed is not a good look. Take the $539k / 85% profit.

$140,000 profit in less than 2 years. They bought the property as an investment property not a family heirloom. Should have took the profit and bought something equally nice on the other side of the valley. If they had bought the home for "grandma" to live in then sympathy is due. However they bought it for passive income and now their stubbornness will cost them.

These people in pigeon forge gatlinburg only care about money. There is a place in gatlinburg pretend they care for vets by give a free drink. If you knew how they really treated vets when they think nobody is looking. You be very suprised. The place is ate up with overpriced food. The crowds are unbearable. Traffic is a huge mess. Drug shops everywhere .Moonshine everywhere. Its start to be a place you dont want to take your family. People should start looking at other options. Greedy cabin rentals try to charge 300-400 a night. Including dollys hotels. For a 300 a night. Greed

Hubby and I went to Pidgeon Forge, it was so built up and crowded we changed plans and went to Cumberland Gap area in Tennessee. Best decision we could have made.

They actually haven't paid them anything, and they lived in ohio to begin with. The 500k appraisal was for a residential property. It's zoned as a commercial property.

They are just greedy and holding out for more money. Their house is gone. It can’t come back. They would just take the money unless they wanted to try to sue for more and more money. They can’t sue for the home back. It’s a money grab. They bought that house to air b&b. If it was their primary home I’d feel for them. ​@jaznjen9876 it was an older home. They completely renovated it inside and out. All the permits the city let them pull for renovations and never said a peep about the upcoming seizure. At $500,000 they would still be financially in the hole. The road could have gone around the house. It didn't need to go through it.

Yes, eminent domain is a very difficult and controversial issue. But remember, the land was not “taken,” insinuating they got nothing. They purchased the property for $306k a few years ago as a vacation home/investment property. The municipality offered $500k, which sounds appropriate for the amount of insane inflation (an entirely separate conversation), and the owner refused. This sounds to me like sheer greed under the guise of “the government is taking our family land.” What a joke. They’ve only owned it a few years!

I understand they put time and effort in the house but I just can’t think it’s the same as losing a house/ property that’s been in your family for years. They’re not having to move and uproot their whole lives because it’s not their main house. Can’t fight the eminent domain unfortunately, it’s been around for years, just look back on how many lost when TVA came in and Oak Ridge. I know a lot of good things happened but many people and families were destroyed because they were never able to overcome losing their farms, houses, businesses and communities. The government has the time, money and courts. They’re making themselves miserable and I’m sure the time and effort they’re putting into this is also costing plenty of money. It sucks to be screwed over by the government but you definitely let them win if you’re letting it dominate your life and drive you crazy!

They agreed to accept 490K for it. The city didn’t just “take” it without paying. It was agreed to in advance. I looked up the document myself. The owners are idiots to cry for more if they owe on the mortgage for it. It is way more than they paid for it less than a year before. They create their own problems. I don’t feel one bit sorry for them living way beyond their means.

Outsiders scammed by people who knew what was happening, and the outsiders didn't do their due diligence It sounds like they have a solid case, especially regarding the property being valued at a higher amount than the zoning code that was allotted to it by Pidgeon Forge. If the real estate broker knew about the future road project and didn't tell the potential buyers, she or he/company could possibly be liable for fraud because most states have laws relating to what kinds of disclosure MUST be made when real estate is being sold. There's a lot more to this "story" than a little news clip can cover.

This is why imminent domain should be outlawed or HEAVILY controlled. People in power abuse this. The city I currently live in tried to take half my dad's property WITHOUT paying for it and installed a drain pipe that let the water and runoff from the nearby gas station flood our backyard. My sister couldn't go out back for months because the runoff gave her sensitive skin rashes. The city eventually gave my dad the property back and removed the pipe after being threatened with a lawsuit.

When we told him what had happened he said well I’ll pay to replace them…..I never gave him a number. Because I could not figure out a monetary value to all the work I put in raising them as chicks and waiting for them to start laying. Could I have pushed adult hens and tried to somehow get them integrated into an already tight knit flock? Yeah, but the fact that that’s even more work. Honestly, I would have had to have a lot more than he wanted to pay to feel like it even came close to the inconvenience and the time spent getting my hens to what they were when they died. If you’re gunna steal someone’s property and they spent 6-7 months renovating it themselves knowing they were going to make decades of income, you better pay to compensate appropriately

That's the same reason the mayor's brother wanted the road moved from the original plans , so they could make money from the land they own beside these people. My family is from northeast tenn and have gone to pigeon forge/gatlinburg tenn for decades. We aren’t going back, headed to Cincinnati in a couple of weeks instead of pigeon forge tn. We went to Cosby tn to camp several weeks ago instead of pigeon forge. We miss it but this has opened our eyes to many new travels and discoveries in the future. I hope many many do the same. I have been following that for a while, the mayor watched them renovate the home, from his home above them, the new road was moved from going through a empty field, in favor of a campground being constructed in the field. And it took that family's home. The city of pigeon forge has some sleazy government, and that town attorney, looks so crooked, I'd almost bet he sells used cars too.

Watched a town favorite, a popular drive in restaurant, be taken by eminent domain for the same thing (a road project) in my hometown. The city destroyed half the building, never dis anything with the land and changed the road plan afterwards. It was a whole bunch of shenanigans because of the restaurant owners political affiliations. It still there to this day, a run down building thats half torn down, sitting on the corner of an intersection.

I did have some sympathy but when I realized that this is a second home and probably an Airbnb plan for someone, I have no sympathy anymore. If this was all they had I would support it. The town of pigeon forge knows these are a couple of Invaders from another state trying to suck money off of their local community. Airbnb landlords, you can go screw.

Everyone that is upset should protest by refusing to use Freeways/Roads, electricity or Natural Gas. They were all made possible by government using eminent domain. The land and homes that we call our National Parks were once homes belonging to someone… Protest by never visiting our National Parks.

Guarantee: the seller sold the property _because_ they knew about the plans for the road. Caveat emptor. You can go to the city and find out if there are future plans for that property and its neighborhood. Or if it's sitting on top of a worked out mine vein or toxic waste dump. You should always do that.

Then you'd be complaining how the gov is waisting/spending your tax dollars. They paid just over $300,000 and was offered $500,000. Personal I think they were scammed. That new road took years of planning. The original property own knew about it and did a quick sell thinking they'd get more money than what the state would offer.
