UCMJ would only apply if he was on active duty when the assaults occurred. Otherwise it is a matter for the civilian courts. And even if he was on periodic active duty, weekends and summer time training, as opposed to being activated for permanent or semi-permanent duty and the assaults were not on base, the military would probably let the civilian authorities handle the investigation and trial.

It was kind of a good ol boy unit, most of the senior NCOs knew each other for a long time and worked together full time in civilian life and i was just a lower enlisted college kid who lived two hours away. I just showed up and did the bare minimum to keep my scholarship. But the rumors were that he was forced out of his position for some me too type of stuff.

We are sometimes criticized for how many we do have incarcerated. But, we have more laws and enforcement than most other countries. Some lesser crimes can remove prison, like just smoking weed or similar non victim crimes. But some crimes need consequences, so prisons are there.

No worries, he will face a military trial too. He Was an Active Guard Reserve member. A Solider is a Soldier 24/7 regardless if they are on base (on official duty) or off base in civis relaxinc etc. I've worked in mil criminal investigations and guys like him usually get double court (civil and military).
