The corporate bullshit news tried to blame california humane law as the problem. The problem happened when they tried to go outside air bnb.
@ericcollins62314 жыл бұрын
@@b3at2 But clearly the law, and the way it is enforced is a very real problem. A verbal agreement of cash payment is no legally binding lease or sub lease. You never take cash from someone who wants to extend. I always tell every person that new guests are coming that same day they are suppose to check out. I get them out by noon and tell them new guest are checking in at 3:00 so I need to have the place clean(even if I don't have any guest coming). One time a couple looked suspicious and weren't making any attempt to leave, I had 2 friends show up with suitcases as if the were checking in. That got the couple to pack and leave.

This happened to my coworker who rented her house to provide for her 2 handicapped children. The squatters slashed her tires, broke everything inside the house, poured soil into the garbage disposal, and did so much damage that my coworker cried for days. ^ In this case, they weren't criminals. What they did can be viewed as "morally wrong", but, as you heard, their actions were legal by California's standards. The couple could be there up to 30 days. The woman paid them off because she was aware that them staying was totally legal- but she PERSONALLY no longer wanted them there. People need to take this as a learning lesson; if you rent out with Airbnb, stick within their contracts. When you go into other territories and extend stays outside of them, it's YOUR own fault. If she hadn't done that and the people refused to leave, she could have called the police and they would have had to go. People need to read the fine print and take responsibility of their stupid actions.

Something similar happened to me this weekend. A lady who was supposed to check-out at 11 am maximum ended up checking out at 5:30 pm. From that morning she asked to extend her reservation for two more nights which I agreed to her request… she kept putting on excuses not to pay saying the system didn’t notified her etc… at 3:30 pm Airbnb’s Ambassador tells me she is not willing to cooperate and she yelled on the phone to him saying she was shopping and she didn’t had time to attend the call. The Ambassador recommends me to set on the security alarm, which as soon as I turned it on she begs me to turn it off telling me she will be out of the house in 15 mins (she obviously lied about doing shopping and was actually at the house). I don’t understand how this lady stayed for 6 hours after check-out time without any guilt. She started insulting me calling me every bad word you could imagine, threatening me that she would sued me because I forced her to leave my home with her children. I don’t live in the same city as the house. I did what I could to prevent her staying for free. The police told me what she did was trespassing because she had no authorization to be at someone else’s property since check-out time had passed. I am traumatized by this and hopefully it never happens again.

@braddouglas7839 Жыл бұрын
Kinda along the same line is my story. I own a building with a few rental units. A bar, barber shop and two apartments. When I bought the place years ago I had a woman living in one of the apartments with two high school aged kids. She just stopped paying rent. I tried to evict her, but because of the liberal tennant favoring laws I couldn't. She wound up owing me about $6,000 by the time she moved out. She tried to get my building into the rent-assist program but I refused. Once you get in that program you're pretty much screwed. So, I had to eat the $6k. Fast forward a couple years. Another woman moves in. She lasts about 3 months then stops paying rent, while proudly driving her Mercedes around town. I drive a Chevy. By the time she moved out she owed me about $3k. Another tennant I had during Covid. He stopped paying rent. When asked, he said that I couldnt evict him because of covid, and he was correct, even though he was working EXTRA HOURS at the time. And, when he got his "stimulus" check I didnt see a dime. He ended up owing me $5k by the time he left. We had some mutual friends that didnt like the crap he was pulling on me. One day they showed up at the apartment and moved all his crap out, along with his worthless a$$. I had NOTHING to do with that. So, when people bitch about rent prices going sky high, remember these stories. One of the reasons rent prices are so high... laws that allow this type of crap to happen. So far I've lost my a$$ on those apartments, and I have to make my money up somehow. The other tennants HAVE to pay their rent. Being businesses I can boot them in a heartbeat.

Males are excluded from California law?
@BPtruth4 жыл бұрын
Nobody is excluded from California law, buuuuuut it’s going to be hard for squatters to prove you hired a alpha friend that respects a ladies space to come teach them some manners. You can’t prosecute someone if you don’t know who they are just turn the cameras off. No lawyers going to take this case without evidence or a down payment. It’s sad they take advantage of a already sad situation, then proceed to scam her into paying them more then they owed her for the rental to begin with, it’s a lesson learned though because it’s her fault for voiding the Airbnb contract.
@BPtruth4 жыл бұрын
Since there’s no record of them ever getting a rental on Airbnb then there’s no evidence you ever accepted their cash or made a agreement. If they call the cops just deny the rental arrangement, say they are robbing your house, and that you’ve never seen them before in your life.
@HarqoGames4 жыл бұрын
@@BPtruth I agree 100%. Really it could have been a more simpler resolution: Have male associate come over, "Hey, my female friend and I would like some privacy. Please leave.". *Sternly*. These bums would not have the heart to challenge the male (or males) to a confrontation. That along with the bums' lack of any legal proof that they have rights to the home would surely be enough persuasion for them to leave.

Except this happened with a granny flat/guest house type property and the "guest" pulled the same scam, then proceeded to threaten the owner and try to write him up on things that weren't up to code. But when the owner tried to fix things to be compliant, she refused to let them in for the repairs. She ended up staying there for free for over 6 months I think. I can't remember what eventually forced her to move out but apparently she had pulled the same scam at her previous airbnb booking as well but that owner paid her to leave. So ridiculous.

Similar thing happened to my sister. She had a friend from work stay with her, because she needed help, and when my sister returned from a weekend in Vegas, the friend boyfriend was at her house living there. My sister told her she cant have him living in her house, and they threaten her that they will call the cops, because she pays half the rent. Well, this was a not a signed documented agreement kind of thing, and when our family heard about what happened..It did not sit well with my brothers. They went to have the couple removed and they locked the bedroom door on them. One of my brothers kicked the door open, and they tried to call the cops but my brothers took their phones and busted it, and had them out with their belongings in matters of 10 minutes. They did call the cops from someone else's phone, and my sister spoke with the cops and told them that she dont live there, and was there for a weekend only, and she did not pay rent. The couple couldn't prove that they were living with her, and so the cops had them escorted off the property. My sister did lie to the cops, but she knew that they couldn't prove anything, and didnt want to deal with the bs of their damn rights..Give a person an inch, and they take a yard! Lesson learned!

He’s talking about the law. Many people rent homes in California because homes at expensive and all the rich people already bought them all(good luck Texas and the rest of the states where these rich people are now moving their businesses to, you’ll have the same problems soon enough). For a normal person who isn’t scamming or trying to do anything wrong, getting evicted overnight is horrible and it can take time to find another affordable place to live so 30 days is reasonable. To be honest this was stupid of her, my dad rents his house but we are not there and he empty’s the fridge and locks some of the doors like the rooms they don’t need to be in such as pantry

They saw that she was sweet, and law abiding and decided to walk all over her. If she was a nuisance herself, yelling at them and complaining all day at them, maybe they would have left. How can people just be milling around your house when you don't want them there? Take their stuff, put it outside, lock the door, and don't let them back. She wasn't aggressive to deal with that creepy couple. I would be so furious with them pawing through my food and walking around half nude.

I had a similar tenant and my eviction lawyer said if I take out her stuffs and change the lock, I would be breaking the law and the nonpaying tenant would be able to sue me and win the case. I had to wait for the slow eviction process to run its course while she stays rent free and breaking my walls, painting graffiti on doors and stealing roommates’ properties. The police came many times and couldn’t do anything with her. That’s the reality faced by many landlords in California

She was most likely advised by a lawyer to not engage and to ride it out the way she did so as not to cause more liability on her side. That way the law directly deals with the squatters rather than it potentially backfire. Clearly it's not their first rodeo, and just because you're nice and timid doesn't mean you're weak/vulnerable/unable to do anything about the situation. Just means work smart not hard.

@@EeliusAstaroth When you are around certain people, being nice doesn't pay.
@EeliusAstaroth2 ай бұрын
@@Babu-kr3cr depends on your perspective and how well you handle the situation. In this case obviously it quite literally pays as she is in favor of the law thanks to her niceties rather than against. Otherwise, you can retain boundaries while still being nice, and people forget to distinguish the two as they sacrifice their protection while simultaneously putting the blame on their behavior when it's not actually the case. It's simply the easier thing to do. There really isn't any deterrent or negativity of being nice. If there is it is minimum in comparison. The main thing is whether or not you allow others to take advantage of it, and even then there isn't much to lose from it when in the face of other alternatives. Even if you fail to succeed at what you were trying to accomplish there's still lessons within that time to learn from if you allow yourself to do so. I think given the outcome and reasonings this case is a good example of that to prove otherwise. Especially since someone else here commented previously supporting that basis of debate. Yes they had to deal with the aftermath, but the other course would have led them to an even greater loss where they wouldn't even be able to have a chance to fix the damages. Even in critical moments being nice provides a calm demeanor that allows the person to think and react more appropriately to the situation. You can still defend yourself be it with words or action. Most other emotions would get you in trouble/may cause you to react in a way that ends up being more at a cost. People like this count on others to react poorly so they can continue to utilize the law in their favor whereas others who react in retaliation have the disadvantage of playing into the other person's hand. In this case, the squatters.

Michael David Laws in California protect squatters. It’s absolutely ridiculous. They can actually fight you for your home. It’s so stupid it doesn’t make any sense.

Connecticut has squatters rights too. Don't even let anyone us your address for mailings. That can be used as proof if residency. Evict them. That's what eviction is for.

This isn't an airbnb issue. This is her not understanding that she just became a landlord by accepting rent without Airbnb's involvement. She's not very smart to have done this. Tenants have rights. If you don't want to deal with that, don't become a landlord.
