Gen. Diya was crossed examined at the Human Rights Violation Commission (HRVIC) on the coup plan 1997 to overthrow Gen. Sanni Abacha, He bluntly denied the fact that he was part of the plan but he admitted he knew about the plan.
He further explained that he was afraid of being killed by the Coup Master Planner if he revealed the plan.
He denied pleading with Gen. Sanni Abacha but was shocked to see the video where he truly knelt down before Gen. Sanni Abacha as tendered by the Lawyer.
Gen. Diya Oladipo then was appointed as Chief of Defense Staff. He was appointed Chief of General Staff in 1993 and Vice Chairman of the Provisional Ruling Council in 1994. In 1997 Diya and dissident soldiers in the military allegedly planned to overthrow the regime of Sani Abacha. The alleged coup was uncovered by forces loyal to Abacha, and Diya and his cohorts were jailed. Diya was tried in a military tribunal, and was given the death penalty.

Dear Oputapanel, one thing that has bedeviled Nigeria and most of Black Africa is amnesia and lack of record keeping. Politicians steal and lie with the full confidence that the people will forget and never hold them accountable.Things are currently done in Nigeria without recourse to history. You have done a wondrous thing having preserved and made this video public for all to see. In spite of the drama, one thing that strikes me is how fortunes were reversed here. Apparently, General Diya's life seemed to be in the hands of General Abacha, who had all the powers human beings could have imagined. But it was not to be. God was in control of everything. General Abacha was the one that was to die, and General Diya lives up till today.

To partake or plan a coup is to gamble with 1's life in order to seize power. You should have accepted the possibility that it'd end up with you tied in front of a firing squad. If he could do the crime, then he shouldn't have chickened out when it was time to pay the price. The man was pathetic. The only person i respected among them was his poor CSO, Major Seun Fadipe, whom he conscripted a few weeks before they were caught. He was the only one with integrity. He owned up, told the truth knowing that he was agreeing too a death sentence in order to save his surbodinates, who didn't know that they were participating in a coup.

Well,it is a common statement that loyalty is better than competence, during Gen.Abacha's time, the whole arrangements is a test to ascertain absolute loyalty and Gen.diya failed.however it wasnt treated in a normal military way because he didn't actually initiated the coup,but by his failure means he will have loved to displace his Boss then if he had his ways.

If you plot a coup, prepare to pay the supreme price if caught. He's a coward because he refused to accept his responsibility. He might not have originated the coup idea but did he participate in planning it? Yes. I believe major Fadipe, his CSO. He was the only one whose story never changed. Diya was willing to allow the surbodinates he roped into the coup plot without their knowledge to die rather than admit his role. Major Fadipe was the 1 who stepped up to save the lives of his men but in Nigeria, we like to celebrate cowards & traitors.

Ishaya Bamaiyi, who approached him with the idea of mounting a coup. Given the explosive nature of the charge, the government then closed the trial to the public The head of the military tribunal, General Victor Malu, the former commander of the West African regional peacekeeping force ECOMOG, responding to Lieutenant General Diya's defence that people at the very top framed him, said it was not necessary to know who had initiated the conspiracy. He noted that all Lieutenant General Diya had to do was prove that he had not been part of the plot at any stage. My question is why gen. Bamaiyi who initiated the coup was not tried? It was all a setup to kill Diya but God saved his life, those of you blaming Diya cannot accept it openly that you are planning to overthrow/kill a head of State.

In addition, Gen Bisala was the instigator of Dimka's Coup. He was named by Dimka at the Tribunal. Gen Bisala was Minister of Defense in Murtala regime,he was subsequently arrested, tried and sentenced to death. But Lt Gen Bamaiyi was not tried. It was a set up and Lt Gen Diya felled for it. It is shame that the "Nigerian Army has become , the Army of anything possible"(Lt Gen Salihu Ibrahim rtd).

Bamaiyi was a double or triple agent. He might have indeed planned to carry out the coup but secured his neck by going to Abacha 1st to report so he'd be commended for turning them in. Abacha telling him to play along gave him a blanket of immunity to be the brain of the operation because if they were caught, he could claim that he was playing the role ordered by the C in C. Diya fell into the trap by not going to Abacha or mustapha & funding them perhaps because he felt that he could be the next in line.

Well its sad to say i was disappointed with how Diya lied to the commission or Nigerians about the Abacha-visit but i don't see any fault in him crying or begging for his life in front of Abacha. That said i respect Diya for staying out of the lime light all theses years. How many old junta people can lay claim to that.

My submission is that Gen. Oladipo Diya was loyal and a close friend to Gen. Abacha. Am sorry for the lawyer that interviewed Diya because it was evident he was only trying to blackmail and kill Oladipo Diya. I belief Diya was very sincere and was rather deceived by those who informed him they want to meet the Head if state to point out 4 items for him to improve upon in his leadership.; These was misconstrued to be a coup against the leadership. It is as though planned against the Yoruba in leadership then. WE NEED TO LOVE EACH OTHER IN THIS COUNTRY IF WE MUST BE ONE AND STOP CHASING THE INNOCENT TO DEATH.

The coup was real. The originator of the coup was between Diya and Bamaiyi. But the thing is Bamaiyi reported to Abacha after he became restive that the coup could leak. Because Diya had also informed some GOCs. Why did Bamaiyi wait 3weeks before reporting to Abacha?

Alright enough with all these, "Yoruba is coward comments", I am a Yoruba myself, I have gotten into real life-threatening situation with my Ibo/Igbo friends and none of them refused to tuck their tails between their legs life a true bitch. That was when I realised outside just beating yourselves in the chest about how brave you are, you are just all mouths. General Diya has no business being a Soldier, He disgraced his profession. Look at Major Mustapher, he has been in Jail for more than 14yrs and he remains adamant, even in the face of (an obvious death sentence) he remains unshaken, now this is how a Soldier should behave in the face of great danger, and not knee down like a baby. A real Soldier facing death would fight Abacha there with anything he could lay his hands on. I fee so ashamed of Diya. I cant even call him a General

Towards the end of 2030 Botswana and Rwanda will top one of the best Economy and best Country in Africa/World in terms of developments and managements, same as Malaysia in far East Asia. The whole video hardly show a strong evidence, despite Gen Diya knelt down or receive tissues. For the fact that we could not hear the discussion between Gen Diya and Gen Abacha the evidence in this case is tainted and in my opinion not admissible. Possibly Diya was pleading on behalf of the other Generals as he said.

Going over this, I came to conclusion that Bamaiyi, (or probably Abacha himself) planned this. Bamiyi and the others approached Diya with the "Four Point Demand", he supported them. He had it in mind that they were planning a coup. It all failed (or it was planned to fail). It appeared to have leaked to Abacha that these guys are planning a coup. Diya was questioned by Abacha, and he admitted and was begging for his life. It didnt work, he was finally arrested. the coup plotters were arrested. Later Diya came to know that Bamaiyi and the others -who approached him with the idea of the "coup" were not arrested! So that is why he was still insisting that there was no coup, it was a ploy, a phantom coup, arranged coup

The fact that the video was edited made nonsense of the evidence. Diya did not deny pleading, but for other generals he was told were arrested for being framed in the coup. There are consistency and credibility in Diya's speech and the coup saga was actually a setup.

Actually there was a coup and General Diya initiated it based on the fact that he could convince other top rank officers like General Aziza and especially General Bamayi who was then the chief of Nigerian army staff. Anyone who is conversant with military coup will agree that coup with a support of chief of army staff is with high probability of successful no matter how strong Abacha was that time. One could see a kind of tribal conspiracy there. Unfortunately General Bamayi stabbed General Diya in the back by reporting the coup to Abacha. Normally Bamayi wouldn't want General Diya to take over Abacha being an Hausa man rather than himself .Normally Northerners don't like power to shift to any other ethnic group

Was this tribunal convened in respect of human rights violation? Was that the violation of the rights of the Nigerian citizenry or for the purpose of humiliating General Diya? What does the video evidence prove? What an arrant nonsense and a waste of Nigeria’s resources. The late Justice Oputa should have turned down the appointment. This video paints the nation and its judicial system in bad light.

I believe if Gen Diya actually planned a coup against Abacha he would have said so and would been praised for it now if not then, unless he wasn't sure of his safety even when he was at the Oputa panel. I still respect him, no matter what. And why were people shouting at the panel?

He supported Abacha against Abiola's mandate, was living comfortably when Obasanjo, Beko and others were jailed. He got what he deserved. He is lucky he survived it.

iin all honesty the footage shows nothing, the quality is poor and thus only those in attendance might be able to hear what diya and abacha were discussing (even that is doubtful)...diya can argue that he was saying a lot of other things and not pleading for his own life....also i don't see why realising the footage was necessary, like i don't know what it adds or subtracts from the discussion or case at hand...

Not really interested in this mockery of justice, except to suggest that the Nigerian Justice System rethink their use of “ my Lord” while addressing the Judge because it arrogates him/her above the maxim that no one is above the law. This old borrowed British Concept is outdated. What about “your Honor”
