They are actually pretty well protected from DMCA takedowns. You have to read it carefully, but the question regarding the DMCA is whether the purpose of the video is to consume the music, or to consume the content in the video. In this case the music is secondary to the content for most viewers, namely, they come to watch the person succeeding at the game, and would watch a different video if it was only to consume the music. Videos 'may' get taken down, but they will end up being returned pretty quickly, because distributors of the music can't demonstrate that the people showing their gameplay are detracting from direct music sales by showing their gameplay. That is people who just want to listen to Fade by Allen Walker aren't choosing the Beatsaber video to find the music... In contrast, MxC for example will post videos 'responding' to watching a funny video... The purpose is almost explicitly the same, to see the funny videos they find, with the added benefit of seeing someone you subscribe to responding to it... But they can't demonstrate that in fact the person responding isn't stealing views of the original video since many people do in fact watch response videos to consume the funny things they are responding to. If something unique isn't added, such as criticism, commentary (Beyond Lol), or some sort of discussion, those sorts of videos are easily taken down for DMCA and their authors sued.

I know that local copyright dictates if the music only has a filler / background function, you are not allowed to use it. Essentially only criticism, review or satire is allowed, hence I had to ask. But thanks for your response ^^

Fordbert she’s doing mixed reality. She has a green screen in front of her and a camera facing her from the back. Software then combines the image from the web cam with the game footage from VR and combined them together so it looks for us as if she is in that virtual environment. She sees the environment as if she is in it with her VR goggles so the mixed reality view is for the a fun spectator view which she shares with us.

That's just the nature of the beast i'm afraid, Inside out tracking on the first gen mixed reality head set is quite poor, especially in low lighting, I've heard the quest tracking is pretty good.
