Holidays and Other Leaves have become very controversial in India. Also, there is tremendous difference between govt and Non-Govt. Mostly these issues are misinterpreted, misguided and on other hand lot of exploitation happen. Total human rights violation. Employers and bichholiyad are enjoying all privileges.

It depends on your company whether you earned leaves can be encashed or not, at my previous organization, earned leaves could be encashed, but at my new company, we cannot encashed the remaining leaves

Our Co. Has freezed my EL. I had 35 leaves around Apr'21 and all my leaves are being ceased. Pls guide my way to retrieve my leaves.

Sir, I work in a company based in India. It handles the operations of another company based in the US. My shift timings are EST and I work Monday-Friday. Saturday and Sunday are off. But we do not have a concept of CL and PL in the company (the one based in India) on whose payroll I am on. We just get 15 leaves a year, i.e., 1.25 leaves per month on pro rata basis. These leaves do not get carried forward to next year. We cannot encash them either. The unused leaves simply lapse once the financial year ends. We work on all Indian National holidays. We get one holiday on Ganesh Chathurthi and one holiday on Diwali. Apart from that, we are off only 5-6 US federal holidays. I am not sure if these leaves and holidays are fair as the HR is not at all helpful. Please advise.

52+52+15+8= 127 Minus 365 days -127 holidays=238 less than 240 days your getting more leaves compare to other companies in india

@@zomoto9577 What is 8 for in your calculation? I feel there are a lot of companies in my city who have full weekend off and more than 30 PL & CL and all major Indian holidays plus state-wise holidays. That's a lot more than what I get.

Is it depends on employer to carry forward EL next year or elapse the EL? If employer wish to not carry forward or pay in cash the EL, can he do as per law?

Hii Rishabh and Mandeep, Actually I have a question. My employer did not updated me throughout the employment that all leaves will be lapsed at the end of contract. Now they are refusing to encash the remaining leaves. I would like to understand what our law says on such a scenario. Thanks and Regards, Mahesh

Hi Sir, I have a question..If someone had a physical operation for his health and he has informed his employer about it before taking the leave and also provides Medical writen certificate by doctor..After than also if his employer is asking him to join his job as any cost what legal action can the person takes against that employer??

Hi My company at Maharashtra as per Factory act gives 3 CL 2 SL for 1 year and 1 PL for every 20 days net work attended (days work attended i.e. other than Holiday and any type of leave like CL, SL, PL, Holiday and Week Off ). It further says that No CL and SL days benefit will be given for Probation period (during 6 months probation period an employee neither will be allowed nor will be given CL and SL for probation period). Kindly advise if company is right.

My company doesn't allows encashment or carry forward of PL. Moreover, there is no specific leave balance for sick leave, one can apply sick leave which would be debited from PL if applied for 3 or more days and would be debited from CL if applied for lesser days. Is it ok ?? I.e legal?

Hi Mr. Rushab/Mandip, Can you plz confirm if there is any goverment regulation about the encashment calculation of Earned Leave (El). Specially for Maharashtra State. Is this payment should be based on Basic Pay (BP) or based on overall salary including everything (BP+Ad-hoc Allowance+etc)..Generally BP+DA is minimum amount in overall package by IT companies...So this EL encashment calculate based on BP+DA or based on overall daily salary....THANKS IN ADVANCE...

If an employee worked in a factory for 260 days then he is applicable for EL. Means he earns 13 leaves or after 240 days 1 leave for the 260 working days. Which is correct?

I have a question, Is it mandatory to work 7 days in a work compensatory leave?? Means i have weekend on Sunday, and in that week i have worked on Sunday. But took a leave on Tuesday in the same week. So my company is saying that you will not get a Compensatory leave since i have not work for 7 days.

Sir, in case of death of a close relative, if Employee has to take leave on Saturday and Monday( Sunday is already week off). So, can HR in this case apply sandwich leave policy ? Also, employee here is Intern and not the permanent employee....

Sir ji mai LIC me temporary employee as an assistant ke pad per 81 din kary kiya hai 1989 me. Hum logon ka absorption Supreme Court dwara order hai. jisme 85 din kary hona hai. Kya mujhe EL,Cl,PL etc mere kary diwas me judega. 85 din ki awasykta hai.lekin mera 82 din hi hai. please sir kya mai elegible hun.

My company insisted every employee to sign declaration that he will not join any competitor company for a period of 3 years. This declaration they are asking once again at the time of exit and neither giving full and final nor reliving letter. I have already served full 3 months notice period.

My company is private limited they are giving only 21 days PL, While asking for CL,SL they are said that it was not applicable for you, It is showing a rule of Shop and establishment. what should have to do.
