Like partition on ownership property, can there be partition of tenancy rights also in pagdi property? Also when out 4 co-owners, only 1 or 2 wants partition, others don't want, then still court will order for sale of entire property if the other co-owners cannot afford to purchase the outgoing co-owner & they need the property to stay?

Sir My father name is missing from land record during 1962 land reformed But whole land is in my tauji name Even my grandfathers name was mentioned in it though it's ancestral property Any suggestion? It seem my dad was minor so his brother who was managing all ancestral lands did some manipulation

go to tehsil office and ask for ferfar panji (mutation record), you will get to know how your uncles name was registered, then take legal heir certificate from talathi/ local civil court then give application to tehsildar to register your name in the land revenue record.If they dont then appeal in local civil court.

I think there is much more a plaintiff needs to keep in mind before filing partition suit . Also for partition suit it is not always necessary that the property is ancestral it can be between partners also . Also it varies from the angle of nature of property also especially in case of land as some times land is agricultural or no agricultural then the parameters are entirely different.

@@Johnwick69696:- as per my knowledge : agar apki mosi plaintiff banti hai to unko hi hisa milega,, jitna hisa apki mosi ka banta hai,, isliye aap apna alag se case file kre aur apni mosi aur baki jo 4 hissedaar aunko defandant banye. Agar apka possion nhi hai to. Baki app advocate se salah le. Muje 13 saal court mein chakkar lagate ho gye hai property case mein. Jo abhi tak chal rha hai. Civil case mein 20-25 saal maan k chlo kam se kam.

Property is divided equally between mother daughter and sons after fathers death and in mother's plot during dividation grandson and mother name was there now after her death how will be the plot divided

North & South side main roads are there, (30L*W120 main plot) divided into 3 parts (30*40). Middle plot owner is having unsize route, north 3ft & south 5ft, now he is to start construct a home. North & South side owners already constructed homes. Issue is, middle plot owner to get same size route to both side or not?
