The defendant previously sued the plaintiff regarding a house sale that didn’t go through. The plaintiff claims the lawsuit was completely frivolous, and he had to hire an expensive lawyer, so he’s suing for legal fees. The defendant insists the plaintiff is a sneaky guy who backed out of a house deal and tried extorting money from her.

Buying a house is so emotional. She was emotionally attached to that house and everyone saw her as a sucker.

If she had just paid within the 24 hours like she was supposed to the plaintiff wouldn't have inquired all of those fees and everything would have been fine but all of the fees that he named off he's entitled to, why should he be out fees for her to buy a home. Most people would not agree to purchase the home for you if you didn't understand that you were supposed to bring a specific type of currency, that's a big risk that he took for her. I'm not saying I don't feel bad for her but she kind of brought this on herself.

No way. The plaintiff expressed all the fees he needed to pay for her to get her the house clean. Of course he should make some money too. He, being a complete stranger, decided to help. His points were valid and sound. The judge didn't even question him further after he said why he was charging so much. It was really the prior owner that made it so complicated

If he went up on the price of the home because he had to pay old fees for everything, then yes, it's worth what he's asking. The entire point was that she was suppose to pay in 24hrs, which meant he wouldn't have had to pay all of those fees. Because she didn't have the funds and waited too long, he accumulated many more charges, so had to up the price of the agreement. She should have just paid it.. and now she's out the home she really wanted. This is why she lost the original lawsuit.

Verbal contracts are valid with lands/homes... the problem is proving that verbal agreement. The agreement won't be valid if there was confusion or if no one can agree on what was originally agreed upon. So it won't be valid. But had they had a video or voice recording, it would have been proof enough. @@shaydaslays

I was wondering the exact same thing when I first heard what the case was about. He should have sued for his attorney's fees in the case that he won. You can't sue for them in small claims court after the fact. I'm fairly certain that I've seen this scenerio happen before on TPC. It sounds like maybe the plaintiff's attorney dropped the ball and didn't add his fees to the previous case when he was in court with the defendant.

Why would he think he could sue for legal fees on the original case...in a new case? He shouldve sued for that in the original caee even tho its not a guarantee he would get it.

So what I think happened is the defendant was collecting the money but not paying the mortgage and fees so the owner would lose it unknowingly and she could sneak in with the plaintiff who I bet she set it up beforehand with and buy it. He turned the tables got greedy and now she got taken like she did the previous owners and he good collecting his money back from new tenants but still being greedy trying to sue her for more. Oh okay back to the case.

He lost his chance to sue for it. He might have gotten it if he sued in the case it was about. You can't sue for legal fees after the fact

The plaintiff got greedy. He could've sold her the house with all the other stuff (fees) included in the sale. He saw how much she loved the house and he took advantage of that. Karma will get him for this one.

I really couldn't tell if the defendant was scamming, or just stupid. The plaintiff, however, was totally scamming and trying to turn a huge profit for very little time & effort and "his" incompetent lawyer screwed it up.🙉🙉🙉

BS. What scam? He is an investor. He will flip the house and make a good profit. What is wrong with that. At FC sales, the investors have no idea of the condition of the house and sometimes they end up losing $$. It's business.

Pretty unlikely the judge in the original case would have granted lawyer fees as well. About the only way that happens is in cases like the Lemon Law where the law specifically states that the automaker pays both attorneys. Sure if you can prove malicious lawsuit you might be able to collect for your attorney but that is very hard to prove.

That's a BS ruling. Yes, his attorney should have asked for the fees, however, Judge Milan was sympathetic to the defendant and at the same time thought that the plaintiff was trying to fleece her. The defendant was naive on how FC sales works and the plaintiff is obviously an investor. He's probably going to flip the house and make a chunk. Nothing wrong with that.

The judge's ruling is absurd. To get attorney fees for abuse of process (frivolous lawsuit) you have to win the first case. So, no, judge, it could not be part of the first suit. If you really think so, then why not issue your ruling within one minute? Didn't need a whole episode for it. Sheesh!
