Hi. 1. Person A is having enemy with Person B. Both A&B resides in same association 2. A stole Soceity Letter head , wrote some serious defamatory articles on it, and started Signature campaign against B for the purpose of defaming B 3. Person C , approaches other people of the society and asked them to sign on the society letter head which would be used with defamation against B 4. Person D [having knowledge of the purpose of the Signature campaing ] Under Which Section Person A C& D must be sued By B

The pecuniary jurisdiction of the court of senior civil judge is 6-10 lakhs. But the compensations claimed by the plaintiff is 3 Crores, will it be rejected on the grounds that it is undervalued. Or since the prayer is just a right of the plaintiff, the discretion is upon the court to decide the matter on merit.?

Since there is an intention to harm the plaintiffs reputation shouldn’t it be a criminal suit under IPC sec.499-500??

In a civil defamation case, the person who is defamed can move either to the High Court or subordinate courts and seek damages in the form of monetary compensation from the accused. Also, under sections 499 and 500 of the Indian Penal Code, a person guilty of criminal defamation can be sent to jail for two years.

Is there is time limit to file defamation?

There is a period of limitation to institute a civil or criminal defamation; for civil defamation, it is 1 year from the date of the event and for criminal defamation, The period of limitation shall be- six months, if the offence is punishable with fine only; one year, if the offence is punishable with imprisonment for a term not exceeding one year; three years, if the offence is punishable with imprisonment for a term exceeding one year but not exceeding three years.

@@EMINENTLAWCLASSES and if the authority agianst which we can file defamation suit can transfer during that period???? Can i file defamation suit after that said period with giving sufficient cause???
