Bet they patted their backs after this thinking they had the bad guy why they were the bad guys all along.

Impersonating a police officer is the fraudulent activity in this situation. This is a lawyers dream to take on this casino. Card counting is illegal? What a clown world we live in right now.

Gaming authority officials are actually law enforcement. Otherwise they wouldn't be able to have the red and blue lights.

@@PerMortensen According to a quick google search the CO gov website states. "All Division investigators have the powers of peace officers and are certified as such.". AKA they hold the powers of the police and so can for reasonable interactions be considered such.

I would think an attorney would be champing at the bit to sue any casino which refuses to cash out chips, because they don’t like the way a player played. The state could be sued silly over their broad definition of “fraudulent activity”.

It seems as if they have what would be considered a limited commission. There are many types of limited commissions, such as State Fish and Game are law enforcement officers but do not have the same authorities as a standard police officer. However, they can still wear and represent themselves as a police officer when conducting their duties as defined by their commission.

I've been thinking this for a long time about casinos - they get so angry and self righteous whenever someone cheats (or doesnt even cheat and just counts cards) While they've caused millions of people to lose their home and their family to gambling addiction without a peep.

They get even angrier when they are a franchise and they can’t even ban you permanently because the main office rescinds the ban after a short time. The security of our local casino has a pool going, how long it takes until a manager physically assaults me.

Before each round, players are allowed to bet between $[table minimum] and $[table maximum]. During each round, players are allowed to "hit", "stand", or (depending on rules) "double down", or (sometimes) "split", or (depending on rules) "surrender". If a player is not violating one of these options (eg betting more than table max, entering mid shoe when not allowed, doubling on disallowed hands) how exactly is he *"not playing the game correctly"?* (Perhaps the cops think that card counters "ruin the order of the cards"?)

As a magic the gathering player, it angers me beyond belief. There is a concept called "revealed information". If you have seen it due to in game rules, you have the ability to know it. In high level play, people cast cheap spells that reveal the opponents hands to get an advantage, and often just write down the opponent's current hand. Extremely high level tournaments are often player with fully known deck lists, where the opponent knows all the cards in your 60 card deck. Once you know a deck list, you can 100% start mathing out every card you've seen that game. In black jack, if you see a card, it is... Illegal for you to remember it? Huh????

as a recreational gambler who frequents several casinos in blackhawk, i was outraged seeing this. i just left a message with the lead investigator at the colorado gaming commission expressing my outrage and confusion over this situation. i expressed to them that i hope sheriff receives an apology and that a public statement is made to clarify the legality of the situation so that no innocent people are treated this way or threatened at any point in the future.

The gaming commission in Co is ex cops, most have violated excessive force behavior and lost their regular cop jobs therefore getting hired by the commission. Colorado gaming commission is the absolute worst in the world.

Qualified immunity gets in the way. Even when they're breaking the law, as long as a 'reasonable person' is not expected to know the law. Ignorance is not a legal defense for civilians but for police officers it is.

No such cause of action in the U.S. The closest civil action would ne intentional infliction of emotional distress. This probably doesn't qualify and, even if it did, the officer is likely immune from personal suit (you can't take his own money.) You would, instead, sue his employer.

A guy claiming to be a cop blocked him in with an SUV with flashing red and blue lights and prevented him from leaving. That's an arrest, unless the guy was not actually a cop, in which case it's an unlawful detention.

its absolutely ridiculous that a lawyer has to go to college, then law school, possibly do an internship and pass a very stringent exam just to practice law(about 7-8 years of schooling). while in some states its an 8-12 week course to enforce law. mind blowing

That guy needs to be fired from the Gaming Commission like yesterday. Impersonates a police officer, uses that impersonation as a means to detain someone, lies about card counting being illegal (which come on surely knowing that is part of his job) and just generally offers no impartiality at all

@@johndorian4078 the Gaming Commission Officer is employed by the Colorado Gaming Commission, which sits under the Department of Revenue in Colarado, so it doesn't appear that the person with the badge identifying himself as "Police" actually works as a Police Officer - certainly he can identify himself as Officer X but that's not what the badge says

It's also hilarious at how your friend is calm and articulate while the 'police officer' was more garbled, tongue-tied and unsure of himself than child that doesn't know what they are talking about. As an employer, I would have very little confidence in him doing his job properly. Luckily the commission doesn't prioritize that as much as they do toeing the line and doing what's best for casinos.

"You can *ASK* for my ID. *I DO NOT* have to produce it." Casino: "We wanted proof he is of age." Dude: "I provided ID ready, which is why I have wristband." Card counting is a skill, not cheating. This is why casinos can ban you, but not arrest or charge you.

They always seem to ride right on the line of legality. Especially in Vegas where legit most of them are in hotels where people under 21 have the ability to walk through, but not play unless they somehow get somebody else’s card like say a parent or friend of age. It’s just overall a shady business as we know all the machines and most tables are rigged.

I'd love to see a new channel where a lawyer learns to count cards and then films all these interactions with casinos. I feel like a lawyer would stand their ground and even look forward to the chance to go to court (whether criminal or civil) over these miscarriages of the law. Seems like it would be a good revenue stream too.

I doubt it, because a lawyer would know there's a time and a place to "stand your ground" and that the legal system is all about technicalities and what judge/jury is hearing your case.

They can back you off for any reason whether you are an attorney or not. If you "stand your ground" you will be trespassed off the property.

You just hit the nail on the head. The legal system is not designed to uphold righteousness and fairness and truth. The legal system is designed to be confusing and complex so that they can get away with their interpretation as well as get away with truly whatever they want. If something is so complex to the point that the average citizen doesn't understand the laws and the rules and the structure of said legalese the people stand no chance because the powers that be can do and say whatever they want and the people won't know if that's legal or not because of the complexity. In other words life is rigged for certain prominent ruling bloodlines. The ones who work on behalf of the ruling bloodlines get paid handsomely. Those are the ones who enforce the will of the 1% on the 99%. Also known as retainers to the nobility.

If you represent yourself as law enforcement and you are in fact NOT law enforcement, that is impersonation of law enforcement and it is a very serious felony offense in this country. There was a teenager in New Mexico who put some flashing lights on his car and thought it would be funny to pull some people over and act like he was a cop. He's now a convicted felon.

@@Not_Ciel i dunno if that would still count here though. A police officer and a law enforcement officer aren't exactly the same thing. For example, the FBI is law enforcement, however they can not legally state that they are police officers, as that is not true

They are trying to assert that if you perform a mental act correctly (noticing and counting) it's fraudulent, but if you can't do that, or do it wrong, then it's legitimate. So your mind operating correctly is fraudulent and your mind working defectively is the correct way.

Fun facts: In NJ, each casino has Division of Gaming Enforcement office in the casino. You don't have to call DGE if there's a problem- you just walk to the office. Several years ago, when the state government shut down for several weeks for lack of a budget, the casinos had to shut down too. That's because state law prohibits a casino from operating without a DGE employee on site, and since DGE is a government agency, none of the employees could work during the shutdown. DGE employees have since been classified as "essential workers", meaning that they can keep working if there's ever another shutdown. In 1982 the New Jersey Supreme Court ruled in Uston v. Resorts International Hotels, Inc that NJ casinos can't ban you from playing blackjack just because you're playing too well. Instead of kicking you out, they'll just use tactics like shuffling after every hand, until you just leave on your own.

You really can't prove someone is counting cards unless you read their mind. The most you can prove is that their betting patterns are consistent with card counting. And all a card counter is doing is keeping track of high and low cards as they are dealt out. A card counter is using information that is freely available to every player at the table to determine bet size and sometimes alter strategy (whither to hit stand, double or split).

I would also note that the "numbers" (illegal lottery) games run by the mob typically skimmed about 10% of the action, whereas state run lotteries take 50%.

Hi Steven, I have an interestiing idea. In the EU, under the regulations of the GDPR, a data subject (person) can access and file a request for deletion for all the data stored by a company/institution about oneself. Therefore, if you went to European casinos, you could theoretically show them your ID and then request a deletion of your data at the casino/the casino's affiliates (online databases). This way, they'd have to delete any information about you being a card counter in their database. Furthermore, in the EU companies are not allowed to share your information to third parties without consent. I think there is a lot of potential in circumventing databases by utilizing data regulations and would love to see a video using this technique (if you can call it that). Greetings!

I was hoping he'd go into the legality of the gaming commission guy blocking his exit with a car equipped with red-and-blues and being effectively disguised as a real police officer. Unless the SUV we see at 2:06 belonged to the real police officer who arrived afterward, that seems approximately 'holy shit illegal' to be using, especially if you're also wearing a police disguise and detaining someone. Then one of the officers reminded me that they're in a city called Black Hawk, so I wouldn't be shocked if there's some kind of screwy tribal law thing at play...but considering that it's still a legal matter, I would have hoped a lawyer would help illuminate things.

I'm not certain about Colorado, but I know that in Missouri and Kansas the gaming commissions are actually Highway Patrol officers, since they're state unified police. So in Missouri and Kansas, they actually walk around wearing their police badges, and in Kansas, they have "police" written on the back of their uniforms. I assume it's the same for Colorado, but definitely don't quote me on that.

There is currently a lawsuit pending against Ameristar Casino, Colorado Gaming Division and Blackhawk Police dept. for either this incident or one almost identical (per a news account I read). I am a resident of Gilpin County and am sort of hoping I will serve on the jury for this, though I think it is very likely that it will be settled, as I'm pretty sure the attorneys for the defendants will advise them that they don't have a leg to stand on.

The purposeful way you delay the release of them as to not mess up your team. The intricacies of card counting and plans. The amount of training and hours you put in before play. The lawyer is wrong in the aspect that police may have had the reasonable suspicion to detain. The key here is that the gaming officer talked too much. He specifically says counting cards is illegal. There is a reason why you should never talk to police and there is a reason why police are almost always very vague when talking to a suspect. If the gaming officer just said we are investigating you because we suspect that you could be doing something fraudulent. Then that could be a number of different things. But he cornered himself when he specifically stated that it was for counting cards. Now he is detaining someone for something that isn't illegal. That is now an illegal detainment

He is also wrong in saying that police need probable cause to detain (and ID) you when they need only reasonable articulable suspicion. They need probable cause to arrest you. Very strange that the featured lawyer doesn't know that or glosses over it

I don't know if it is an illegal detainment or not in this case however the lawyer is right, they are allowed to detain you even if you had done nothing wrong though the officer will have to have reasonable suspicion. Example if someone calls in a crime and states your exact description they will have reasonable suspicion to detain. This does not mean arrest.

@@SabentHD They don't have the reasonable suspicion to detain and we know this because the officer talked too much. The officer specifically says "counting cards". Well counting cards is legal and the officer knows that's what is going on. If he doesn't say that then like I said, the officer could claim that they suspect that he was doing something fraudulent. But even then if Steven were to sue over this false detention, the officer would have to state during the deposition, what crime he thought Steven could have broken. Also your example of an exact description does not always give reasonable suspicion. There would still have to be an investigation by the officer depending on the level of dangerousness of the crime. For example, a man calls 911 saying that the suspect (gives description) is trespassing on his property. The police get there and the suspect isn't on the property. The officer cannot detain the man, without gathering evidence that would indicate that the suspect could have broken the law. Now another example, if a man calls 911 and says the suspect (gives description) just shot him. The police are allowed to detain immediately when they see the suspect because of the dangerousness of the situation.

There are a number of jurisdictions where the gaming commission is an arm of law enforcement. For that reason, it is entirely possible that he was truly an officer of the law. In fact, in such jurisdictions, everyone on the gaming commission is a police officer.

I think it’s a felony without specific language stating they can rebrand their agency as “police”. Impersonating legal agency is an extreme crime, and the law says so in every case. If police come upon impersonators I. Almost every scenario, it is likely they have weapons out. This is almost a slam dunk victory, unless there is a legal basis for his attire.

Not positive about the state of Colorado, but 97% sure the gaming commission is certified peace officers and can wear the label police/detain people for offenses involving gaming just like the police can.

There are such things as Company Police and Peace officers that are technically classified as law enforcement agencies, so they can technically wear Police on their uniform. I wouldn’t say they’re the same thing. From what I gather, it’s more akin to a security guard with law enforcement training. Though, I’m definitely no expert on the issue, just aware that those exceptions do exist. They are by no means the norm haha.

Well the next morning when we went back the moment we walked in security came up to both my buddy and I and they said we had to leave so I went to the cage to cash out from the night before and security kept hounding me for my ID I kept telling him no. So they followed us out and then watched us get in our car so we drove by them and waved goodbye. Lol

Your attorney was right about all but one very important detail. Officers don’t need Probable Cause to detain you. Only, Reasonable Suspicion. They can briefly hold you while they investigate the matter. They need Probable Cause to ARREST you. Surprised he got that so wrong, twice.

In regard to your comment about the police knowing the law: One of the biggest mistakes you can make when interacting with the police in the US is assuming competence. US cops are among the most poorly trained in any first world country. Do not assume that they know what they are doing, know the law or are there to protect you. Especially when you're not the one who called them.

This casino is one of my worst experiences I have ever dealt with from counting cards. I had a similar experience to Sheriff but was a bit fortunate that there was no police officer or gaming commission agent stopping me on my way out of casino. Then I can cash it out later without any problem.

What I don't get is how the real police didn't go "are you f****** kidding me?" seconds after hearing the fake cop say "You were stopped for card counting" and that the casino refused the cash out the chips. The fake cop literally admits that they were detaining this person for doing nothing illegal and that they themselves performed illegal activity. The cop should have ordered them to immediately let him go, cash out his chips, and offer to write a report that would provide evidence of false imprisonment for our card counter friend to sue in civil court later with. The real police should be mad these idiots are wasting their time. This is the problem with Police having the mindset of " why is this guy guilty?" and not " What happened here?", then reacting accordingly.

It not that I'm not ( a little) surprised.. But I think I'm more impressed by the fact that you had a friend named sheriff, that it isn't a cop, arguing with a guy with Police of his chest, that also wasn't a cop... While all real cops on the scene just stand there and uphold the lawlessness
