True but since she was wrongfully arrested she now has a criminal record and most likely will lose her job and custody of her children if she is the legal guardian.

Like I said, since she works for the city near the same office with the police department she also knew that she can get her record expunged since the police committed an illegal and criminal act. That's why it looks like she's resisting. Not only did he grab her, but he did not make the verbal intent to arrest her before touching her, nor did he read her Miranda Rights.

Grand Admiral Thrawn well that counts as an assault charge for a tiny shove if any. It can land her in prison or even worse. It’s the police job to deescalate the situation and in force the law in a way that doesn’t disturb the peace. Not to mention he literally pulled her out of her home while in her property simply because he couldn’t take a tiny hand shove. She also did have a warrant out for her arrest

Updates: The officer was moved to desk and then let go from the department. The mother was awarded $200,000 for the wrongful arrest.

Im also two years late, but your translation is skewed. The officer eluded to living situation, that being getting mail at the residence, and it being a primary residence, you can not prevent someone from their primary residence as the mother did. Nor can you kick them out without first filing for eviction.

Fork Knife 69 Well! The officer can only enter houses (without a warrant) is if a fugitive is in there, illegal activity or they were invited in. So, the lady had every right to close the door and had every right to shove the officer back out as she was clearly not under arrest at that point and was clearly closing the door.

Meanwhile in my city 100 cops chased 2 guys who robbed a store and ended up killing both of them as well as shooting 2 civilians and handled the situation in the worst way possible and even with video of the whole thing there are so many people defending them

Also, that's just like the UPS Driver in that was hijacked and police chased them into a highway with civilians, had a shootout, then the UPS driver, a civilian, and the two robbers ended up dead! These kinds of chases are not only getting ridiculous, their getting deadly for civilians and innocent bystanders.

That was enough to send 100 cops after them (well i counted 88 in one video) This is also a place that will send 5 to 6 cop cars to a wendys to arrest a 14 year old for smoking pot outside

He doesn’t have to read her Miranda rights . She’s not been “in custody “ and then questioned . I’m an attorney . So before you comment, make sure you understand the law . The cops don’t run around reading the Miranda card bc you opened the door to speak w them .

@@Onel756 I had a friend whose father was a retired judge and when it came to asking him about the Miranda right he told me that any police is requiered to read them to you at the moment that they cuff you and take you to the police station. Yeah i find this very strange cuz in the UK if you let a fugitive into your home knowing they are wanted you will be arrested for harbouring. Also as far as i know once your child turns 16 you can very well kick them out all you like. I'm pretty the law is that the person on the paper work is the owner of the house and can do what they choose with it including refusing to let people in.

Eddygeek18 in the US if it is the persons primary address you have to go to the courts and serve them. They then have 30 days to get out, if they do not get out before then the cops will come and forcefully remove them (their favorite thing to do)

Forsaken Pumpkin while I see your point and understand your position, there are other pieces of evidence at play. While the teen could have been troubled and facing issues in the home life, he did have a warrant out for not showing up to court. While that can be traumatizing to show up to court for a crime at a young age, committed or wrongly accused, her son should have appeared so as to not make the position worse. He also was not present when the officer arrived which is also an issue, he cannot present his side of the case, or if the mother is right about her son’s actions, he did it to try and escape legal trouble. While again, I understand you had a completely different point of view, the point I believe the point the video was trying to make is that the officer did not follow the correct protocol or make the right choices for the situation, or that some officers are failing to interpret situations correctly and the issue needs repair. Again, this is my take of the video and I by no means want to say that your opinion and idea of the video is wrong. I am also sorry that you had such a bad home life because no child deserves what you went through and while I do not know you I hope you are in a happier situation now.

Forsaken Pumpkin As someone who also has an abusive parent with alcohol related problem, i do feel that you are projecting a lot of what you experienced onto this situation. Theres no evidence to suggest what this woman is doing is paralleling with the events you were a part of. In addition the actions of the officer were not valid even if what you say is true. If he did believe that a situation like that was occurring the way he handled the mother would be the worst possible way to bring her manipulation to light. He has no grounds to arrest her and also has no way of holding her responsible for the actions you accuse her of doing.

@Forsaken Pumpkin Its a possible theory but maybe you're biased because you are projecting because I know many MANY young men with great mothers who litteraly sacrificed everything for them just so they turn out like her son ( bad friends, wrong decisions) and became very violent although in my country law allows you to hide fugitive family members but we've gone no contact with them because they are a danger to others.

But its true tho... my ex broke into my or err our apartment throught the ac on the wall (I was at work) he had moved out but since we leased it together its technically still his too so when I called police they said that he can do that. They didnt even want to look at the damages and said I'm responsible for paying it. WTF.

The fact that he didn't have a warrant to be in her home and take her out was a no no and a violation of the law. Until he had a court ordered warrant then that's when he could've with reasoning. The blatant disrespect he had for this mother is beyond me.

I admire her protecting her younger children. She is taking the steps needed to fix the issue with her aggressive son within the legal system; listen to what's she claims the judge instructed her to do, plus she was willing to prove it to the officer. She also works a job. So her time is limited. The officer's ego got in the way here. She has a right to protect her other children. She has a right to not harbor a fugitive. She tried to explain it to him but he was to stubborn to check her story, he failed.

Not all parents are good parents, not all homeless kids are criminals. This is called being triggered. Maybe it's from a traumatic experience like being kicked out as a kid, or maybe it's from being used to getting what they want, we don't know. But to just assume that anyone who may have been a criminal and became an officer is automatically going to be a bad cop is definitely an unfair assumption.

I don't think you understand that society is dictated by laws: The son is an adult so he has the same rights as the mother. In order to "kick out" the son, she needs to file for eviction, regardless if the son paid rent or not, since the son has this address as the legal location of permanent residence. Your belief that the mother does not have legal obligation to provide for the son is correct, and so she needs to complete the eviction for the court to "kick out" the son, as the mother don't have the rights to limit the rights of the son. If the mother blocks the son, she's obstructing the son's freedom, which is punishable by law. Get it?

@@Frostingar unfortunately law often lacks commonsense and so does the officer and yes some people. The kid is destructive, deemed a threat to them, and has a warrant. So to follow the law it could result in a death and/or a ticket for harboring. Interesting twist, unless the PD arrested the kid when he made the complaint, the officer is guilty of aiding and abetting bc cop said he knew of the warrant. Ideally, let the kid in, leave with family, and call police from nieghbor or somewhere. And hopefully nothing happens in between.

He really was about to tell her "well as a mother you need to let him into the house." Uhm excuse me what? What part of what she said do he not understand? He's damaged her property, is obviously not making good choices in life and she has a young child. I'm sure she loves her son, but is doing what any good mother should and making sure he gets on the straight and narrow and then he is more than welcome in her house. Also, I'm pretty sure the law is whomever the house belongs to gets to decide who can and cannot live there. IF his name is down as an owner of the house then by all means he can go in the house. If she's the homeowner and he just lived with her at some point and now thinks he can come by whenever, then that's incorrect and she can decide who she lets into her house.

Everything you said is true. As the head of household, she can say who gets to come into home. She also has legal records of her son being a danger to her and her other children. She does not have to let him in. And if the mother stays in public housing then she has to be extremely careful, because most have a one strike and you're out mentality.

Simple solution.. She should follow his movements and inform future possible Law Enforcement Agencies of his past illegal activities.. And inform them that since she had advised them and chooses to do nothing, she would be only too happy to testify against him if another incident comes up.. Its not defamation of character if its true and factual...

I don't think you understand that society is dictated by laws: The son is an adult so he has the same rights as the mother. In order to "kick out" the son, she needs to file for eviction, regardless if the son paid rent or not, since the son has this address as the legal location of permanent residence. Your belief that the mother does not have legal obligation to provide for the son is correct, and so she needs to complete the eviction for the court to "kick out" the son, as the mother don't have the rights to limit the rights of the son. If the mother blocks the son, she's obstructing the son's freedom, which is punishable by law. Get it?

There's no proof of domestic violence here, the police was contacted by the son because of obstruction of freedom to his legal permanent residence, so it's the mother who (also) is breaking the law.

@Tom Smith Well, unless he's paying rent, he's not a tenant. Plus, by law, if he has a warrant for his arrest, she should NOT allow him anywhere on the property and should be calling the police to have him arrested. Allowing someone with a warrant to stay in your home is grounds for being arrested for harboring a criminal. If he IS a tenant, his warrant and violent behaviour would give his landlord the right to refuse him entry to the property and evict him immediately, while also making sure his property is made available for him to pick up or is given to the police for holding.

That's what happens when you didn't learn in school. What does it take to be a police guy in the usa? Here in germany they have to check in every now and then for psychological evaluation and also their training involves some degree of psychology and law education. Seriously.. i think in usa they just need to be able to hold a gun the right way while being strong enough in their fingers zo pull those trigger. Well and they're mostly trained with the guns instead of communication and anger management

That's not what happened here. He told her she couldn't just lock him out. Now if she felt unsafe or wanted him gone, she had the option of filing eviction or contacting the police to handle the warrant. You can't just take matters of law into your own hands and lock someone out, you CAN contact the police to alert them that a person with a warrant is in your home, and you'd like them removed.

@@sleepy1697 legally in the US a parent can evict at 18, then end of parental responsibility in the us. Legal eviction is complicated and costs money. If he's under 18 then she legally has to financially support him (house and feed), she doesn't have to share that home. I wonder why she wouldn't go to the police, polite and co operative and she gets arrested. Especially if they are going to support the abuser, this was a social issue not a police issue.

The video did not say the son did not pay rent, and if he did not, the mother can "kick him out" in the correct, legal way, so there's no problem with interest. The video did not say the son's a criminal, and likely he was not because the police would see in their computer system and immediately arrested the son. Likely the warrant was that he just failed to appear in court from the mother's allegations, and the police expressed he's aware. Knowing this, can you explain again which part is unjust?

​@Kaleela Edwards How do you know he's a criminal? If the warrant shows he's a criminal, then he wouldn't have called the police for help, as the police would arrest him based on warrant. The mother already filed complaint in court, as she implied, but the court has yet to convict him of any crime.

Thats not in fact true, so we have yet again a police officer tasked with enforcing the law who can't be bothered to know the law, and yet opens his mouth anyway. BFT Neelix I don’t know where this was taken place or any other information but I’m assuming it was illegal. Different states have laws, also is the son a minor? Kicking out minors pretty sure was illegal, 18+, if the son was not registered as a residence, also illegal. So technically depending on the law, it “could” be illegal. I understand the moms point and I agree, I probably would’ve done the same, but the law is annoying and we have to follow it. But yes, the police officer did become very bad at the end.

@@Evili555 Well, I am familiar with the details of this case, and where it happened and did put the time to look into it. It took place in Colorado, this cop *was* a member of the Greeley Police Department, he is no longer as a result of this incident. Number one, she didn't kick him out of the house, which is what she clearly explained to the cop, he ran away and had a history of running away, is constantly engaged in criminal activity. She did not allow him inside when she was not home, which she also explained but the cop was too busy building his own narrative instead of listening to what he was being told. It is the middle of the day, hes not being left out at night, a mother absolutely in the State of Colorado can tell her 16 year old son he is not allowed in the house when she is not home during the day if that 16 year old is known to engage in criminal and violently criminal activity. Moreover, she told the officer because he has a warrant, he would not be welcome in the house until that is resolved. That is in fact the correct thing to do, as if she were to let him in the house she would actually be criminally liable for harboring a fugitive. His age is irrelevant.

Depends on the department. The police academy near me that was required to be an officer in my area is a 2 year course. Not all departments are equal. Edit: also, they require at a minimum an associate's degree as well. So another 2 years.

Well no matter the situation I can assure you the stylist has a much lighter work load for the class, I know in the similar field of EMS the duration of the terms of the classes may be short but its something like 20 hours in the classroom a week and another 10 studying/ practicing

If a person committed mass genocide and is guilty by court, you can call police when you see him regardless of where he lives. The son was not found guilty of any charges yet, and the warrant was just to have him appear in court; it is his legal residence, so the mother could lock the door of her own room and have court order for protection if necessary. The son was obviously the one who called the police, and the police knows details of warrants as it's in their computer system. If he's guilty of such major crime, the son would not have called, and the police would immediately arrest him.
