I have to be fair here, he's clearly just a techie who didn't think through all of the implications. The real villains are still Venness and her cronies.

so he didn't lie in the Misra case?

So far I get the impression Mr Jenkins was not the nasty co-conspirator he's been made out to be. I've worked with guys like Jenkins, he's a software dev, a database/data modeling guy. His bosses told him to provide answers to technical questions, he wasn't well briefed by the lawyers that he should be an independent expert witness and what that means. He's clearly not the kind of person to naturally grasp linguistic nuance or legal implications of key phrases. "does it work as designed? yes. were you able to see the error? no." all technically specifically correct, but he's not going to go outside the lines and offer "it was designed badly and the error may have been present but I could not see it from the test data provided, I could check the message store if asked". The PO and the lawyers knew the kind of guy he was and used him as the ideal expert witness, one who can quite easily be put on rails to to give the output needed to win at court.

Martin, I said the same to my wife. He didn’t come across as badly as the PO made him out to be.

I have also worked with plenty of people like this, he comes across exactly as I would expect and I doubt he was ever scheming in any way. You wouldn't use him on a sales pitch because he might explain just a little too much. You would coach him and he would accept that.

Failing to do an in-depth investigation of the sub post offices that were subject to a trial. Failing to do a summary check of all errors and repeating errors in the whole system . Failing to admit significant errors and impact at trials or in his various witness statements. Not knowing as an Expert Witness he needed to fairly report any/ all faults and possibilities.

Great summary.

Total tunnel vision of the techie. Highly competent in his narrow area, but incapable of exercising any critical thinking beyond it. In contrast, did you notice how amazed he was that Beer's summary of the data tree was correct in every individual aspect? His mind couldn't even extend to an aspect of the legal profession that was placed before him multiple times, and which clearly applied to him, yet his brain just couldn't stretch beyond his narrow scope to see it.

Ironic that a 'bug' (a fly) in this system allows the offer of a break .. when the 'bugs' in the Post Office system were ignored...

Did he not state, that he wanted Immunity before giving testimony, It is staggering to think of Firms like Cartwright King, Bond Dickinson other External & Internal Solicitors of the PO & Fujitsu. Who under the Duties of Prosecutors, that not one of them thought to Instruct him in the Duties of an "Expert" witness

They had a huge financial interest in him not being instructed. That, ultimately, was the driving force behind the prosecutions and false accounting (and "payback" demands). Look at how much the law firms were billing (vs the "loss") and how much Fujitsu and the POL executives were making. They all wanted it to go on forever...

I was sort of deciding that he was, as others have said, a disconnected tech person without a real understanding of how his actions did harm. I have now gone back and re-listened to several of the individual testimonies that Mr. Beer brought up. With that fresh perspective, this is a very bad person. He knew and just did not care. He needs to be prosecuted.
@boodori1210
@boodori1210 2 күн бұрын
... even though at trial, his oral testimony was that there was a possibility that the discrepancy was caused by a system error and that he simply hadn't been given enough time and data in order to determine what actually happened. It's not his fault that he was ignored by the jury, or that the prosecution lawyers explained away his statement, or that the defence lawyers failed to nail that to the jury.

@@boodori1210 I think we have to remember that these subpostmasters were likely struggling to afford attorneys and especially the time that would have been required to fight with the Post Office with unlimited funds, courtesy of the tax payers. If they had all had Mr. Beer we might just not have been here these many many years later.
@boodori1210
@boodori1210 Күн бұрын
@@dinacox1971 we also have to remember that they were prosecuted by the Post Office (its investigators, in house lawyers, external counsel), not by Fujitsu and not by Jenkins, resulting in their unfair conviction. Unfairly prosecuting Jenkins does not fix anything other then some distasteful lust for revenge. If you bother to watch the full testimony you will earn how much work Jenkins tried to do to uncover the truth. It was Jenkins who told the court that all systems have bugs, it was Jenkins who told the defence expert about the Known Error Log and it was Jenkins who told Second Sight about the Calendar Square and Payments Mismatch bugs.

I eagerly anticipated Gareth Jenkins's evidence. Though we might get some insights.... how wrong I was. More of the same as POL and most of the lawyers we have heard in this phase. I am sure that we are all baffled by how much these shysters can't recall.....and how totally incurious they all were into what was actually happening around them....
