The final scene is one of Sam Waterston's defining moments as Jack McCoy. He always gave the sense that he was never totally certain about what he was doing, and when he was arguing, he was trying to convince himself as much as anyone else. (Especially when compared to his predecessor in the role, Michael Moriarty.) The famous final episode of this season made sense of that: McCoy's father was a cop, and McCoy became a DA not so much because he wanted to but because he felt it was his duty.

I can't live with "unlikely"... I could never be on a possible death penalty case, as I'm biased towards the constitution protecting the right of all citizens to be free to enjoy life, liberty and the pursuit of happiness. I also believe vengeance belongs to the Lord, not me or any other human being who are prone to mistakes.

I love how many people exist that don't support the death penelty. Even in this episode they try to make the argument that living is a fundmental right. Yet what about the victims. They didn't get to choose when their last breath was. More and more in this country we seem to want to pity the criminals.

It's entirely because there is no way to definitively say someone is guilty or not in some cases. Some cases have seen cops use threats during interrogations to get false testimonies, sometimes bad DNA testing was done and used against people that were innocent. One thing to consider about law is that it's not about every case, though laws affect everyone, you have to account for the rarest of possibilities. I don't disagree with the death penalty morally speaking, but purely from my own personal logic. It's better to be in a system that can give the falsely incarcerated the avenue to be able to go free, than it is to have a system that potentially puts innocent people to death.

@@Feedback72 stupid? You'd have to be insanely malicious and powerful to fully get past all checks and balances. McCoy used the correct lawyer term: "unlikely", but that doesn't emphasize just *how* unlikely it is.

​@dfmrcv862 21 people have had their death sentences overturned because of DNA testing that wasn't available at the time. And those are just the ones that the system caught before it was too late. Are you ok with killing 21 innocent people just because it is unlikely they would be innocent? Death is irreversible. You can free a man that you mistakenly locked up, but you cant bring him back to life.

One of the few cases on the show I was on the side of the defense lawyer. Not at trial mind you (Prison was made for people like the defendant), but at the appellate was with the deference on that one.

@nateoverthehorizon1176 According to a quick google search, the issue comes down to the fact that most killers can't afford lawyers. The state has to pay for that person's lawyer. And trials and appeals can take years.

Just out of curiosity, who plays as the dead bodies in all L&O episodes such as the man who was shot dead in this episode? The actors and actresses of the murder victims who never had screen time before their lifeless bodies were discovered were left uncredited. Those who did have screen time were credited. I’m curious about who played the people who didn’t have screen time before their murder and why they aren’t credited.

Any who play only the dead body on L&O are considered an 'extra' or a 'background character'. Extras and background characters aren't credited in movies or shows, because they're considered part of the setting, don't have lines, and/or aren't even at the center of the scene. Tobey Maguire's first film role was "The Wizard" but was uncredited, because he just stands next to three other kids including the antagonist, Lucas, without saying a word. Any kid could've done that. If Tobey's character said at least one word, then his name would've appeared in the end credits. Any uncredited L&O extras may be people aspiring to become famous stars, anyone off the street who happened to be on the day of shooting, or even fans who begged to play the dead body (Many fans ask online and even record themselves playing the 'dead body' to get on L&O). If any who played only the dead body on this show got acknowledged in the credits, then everyone who was ever an extra or background character would want the same recognition.

@@latinguy67 Which was also uncredited, and Kevin became a famous star. Bruce Willis and Brad Pitt's earliest films were also as uncredited 'extras'. Some make a living as uncredited 'extras' in films and shows. Playing the 'dead body' in an L&O series has the chance of meeting L&O cast members, appearing on tv, and potentially getting discovered in Hollywood.

10:20 "What if someone falls through? How do we rationalize that?" I honestly get so annoyed with death penalty objectors using such lines. In instances like the fictionalized scenario shown here, the CPA killed a cop so he wouldn't get caught. The fear of losing one's family, job, and quality of life by being sent to prison is not a valid enough reason to kill. So yes, that criminal must then forfeit their life & there's nothing, absolutely nothing, they can say to justify the act. The unfortunate reality, however, is that it'll be a decade plus before the needle gets stuck into their arm, resulting in our tax dollars funding their food and lodging. And that fact sucks.

People have been convicted of murder “beyond a reasonable doubt”, and then been posthumously declared innocent after being executed. @@GabrielRodriguez-oe9li : Less than 1%. And before you ask if I (or the majority) can live with those odds, the answer is an emphatic yes. The system will never be perfect, and I'll admit it needs major revision to catch up with the times. But if we simply imprison convicts for life instead of offering a more fearsome deterrent (since some are apparently okay with free room & board at the state's expense), then that's arguably a far more tolerant society that will continue to get preyed upon. So while the odd innocent person gets convicted & it's a tragedy for sure, it shouldn't influence the abolition of the death penalty. If one person in 1,000,000 were to die from flying instead of driving, would this mean we should ground all aircraft and never fly again?

Typically the acting is so bad in these shows that it is funny when they try to make legal arguments. However, this episode was different. Both the defense and state presented expertly crafted arguments for both sides of an issue.

There was another episode with an 18 year old boy. he and his friends lure the Chinese delivery man and beat him. Upon hearing his groans and realizing he was still alive 1 guy picked up a brick to finish him off because he saw them.

I have a legal argument against the death penalty that has never been used. Slavery is illegal. The state can not legally destroy that which it does not own. If you have a dog that attacks someone and destroys the animal, it is a defacto transfer ownership to the state. When the state confiscated illegal drugs because they are illegal, that too is a defacto transfer of ownership. If it weren't, then the state couldn't try people for possession. Given that the state can not legally own a human being, the death penalty violates the law.

Part of it is that the drugs used in lethal injection aren't cheap, but the real culprit is how long the appeals process is. When you have a trial, a sentencing hearing, an appeal for the trial, and an appeal for the sentencing hearing, and possibly an appeal to the Supreme Court if the convicted party decides to fight it out that long, the hours spent on the case by the DA's office really stack up. Even if those hours are salaried, not billable the way private attorney's hours are, you're still looking at a respectable fraction of the personnel budget for the whole DA's office.
