Prosecutors in the trial of Bryan Kohberger are blasting the suspected University of Idaho killer’s alibi, saying it lacks specificity required by state code. Meanwhile, Kohberger’s defense team is pressing to unseal DNA records used to pinpoint him as the suspect. NBC’s Liz Kreutz reports and Danny Cevallos provides analysis for TODAY.

Once the campus protests are over, and the Trump trial is dropped, there will be a vacuum. This trial will then be put into that vacuum, and the news industry will be drooling all over the place regarding this trial. The prosecution hopes that local Idaho people will be impressed, and declare the defendant guilty, and bingo, time for everyone to pay attention to the Democratic Party National Convention.

I know the defense is required to provide an alibi, but in this situation HE DOES NOT HAVE A VALID ONE. What they came up with was all they could say. They need to get on with this trail so we can be done with it and him.

How is his alibi different than someone who says they were home sleeping and are alone in the house? I think it will come down to the cellphone data. @@JustMe-us1vh He was there so the defense cannot prove he was not. Defense Attorneys lie all the time. IMO they should be held accountable for saying things without proper evidence to support it. Three things will take Kohberger down. 1. An eyewitness who very accurately described Kohberger as being in the house at the time of the murders. She gave an almost perfect description of a unique looking individual the very morning after the killings before anyone knew who Kohberger was. 2. DNA from Kohberger at the scene. Nowadays DNA is indisputable. 3. Camera footage of his car driving around the neighborhood at the time of the murders and numerous times prior. Match that with the car the person’s DNA found owns which is his.

You are not understanding the law. Evidence and an alibi are 2 different things. A defendent in Idaho IS requried to give an alibi within 60 days of being indicted. An alibi is not an alternate theory its an alibi.

@TJ-so9xo you're 100% correct. I didn't feel like going through the distinction but an alibi is not necessarily an alternate theory. But when you tailor your alibi to the known evidence, that's got you pretty well boxed in, it starts to blur the lines between the two. Because now you're trying to prove your "alibi" when you're alibi was supposed to be the proof.

@@JustaGirlinCleveland Thanks for getting back to me. As BK was leaving and driving away from the murders he felt the sick narcissistic euphoria of the "perfect crime." Then BK cleaned up and missed the sheath. Euphoria became PANIC. He KNEW he couldn't go back! He could not stop himself. BK returned to the murder scene about 9AM the morning after the murders. (Car like his on video and his phone pinged) The 911 call was hours later, so it was QUIET. The decison wheher to go in and look for the sheath must have been mindbendingly agonizing. He probably did go back in. The sheath was under a body, so he did not find it. The ride home without the sheath must have been devastating. Wonder what he had to eat after that. Wonder how long it took to get to sleep. Wonder how many times in the ensuing 16 months he has awakened to the recurring nightmare of the missing sheath.

Apparently the prosecution doesn't understand where the burden of proof lies. Bryan doesn't need a "specific enough alibi." He doesn't have to prove his innocence. It's the job of the prosecution to prove their case against Bryan, if they have one. It's also the job of the prosecution to seek the TRUTH and to seek JUSTICE, not to prove that the arrested suspect is convicted no matter what. If that killer is Bryan, then prove it beyond a reasonable doubt, and if convicted we can hopefully ship him off to death row. If they can't prove it, then the investigation needs to continue with more competent (and maybe less crooked) investigators. I don't care what Bryan's alibi is. I care about the mountain of holes in the state's narrative about what happened that night.

Only BK needs an alibi because his DNA was found at the scene on a KNIFE SHEATH under a dead body, AND his vehicle matches the suspect vehicle at the scene of he murders while they happened, The touch DNA is damaging but together with the vehicle and proximity opportunity, it is beyond reasonable doubt. Only a ROCK-SOLID alibi can overcome his DNA, vehicle and opportunity. BK does no have a solid alibi. Jail is NOT fun. The issue is his Alibi isn’t an Alibi. There is no exact times, evidence, or witnesses to his whereabouts. His statement that he is trying to pass off as an Alibi is saying the evidence is wrong, that’s a defense case for trial, not an Alibi claiming his innocence. He likes to drive around and hike.. ok? What proof does he have? He takes pictures of stars… where are they? He has pictures from other dates but not the one in question. It’s a “trust me bro” statement that he’s claiming is an Alibi

@@truvirgo4241 From my understanding Mr. Kholburger has alleged that his phone date will be his alibi which will be corroborated with expert testimony on phone data. By every metric that is a legitimate alibi to have if true. Remember if Mr. Kohlburger can show through his phone data that he was no where near the crime scene when the crime occurred than he would be not guilty of the crime as that would be an alibi that would directly contradict the prosecutions narrative. Ultimately in order to preserve Mr. Kohlburger’s right to a fair trial he must be allowed to have this phone expert testify on his behalf to prove that he was never at the crime scene when the crime happened. At the very least the Judge should allow a Voir Dire of the defenses expert to see if said expert is a credible expert to give testimony on said evidence. As long as the expert meets the qualifications of being an expert then he should be allowed to testify in front of a jury as a defense witness. If the state believes that this alibi is weak then they should be able to dismantle the witness through cross as well as having their own evidence to contradict the defenses experts.
