You probably know that many small businesses fail as large organisations use their services then simply don't pay. I was shocked when my brother was taught in university to deliberately not pay invoices, or to 'pay on the court steps' as a deliberate business strategy. Welcome to England - now/soon the most corrupt and morally bankrupt country in the world? It wouldn't be so bad if solicitors, courts and police weren't the same.

We are in progress of selling a property of a deceased relative. The estate agent we are with (after some research) did mention that they could sort out a solicitor to work for us on the selling, but they did also state that they weren't the cheapest or most expensive to arrange that and it would be worth us shopping around. We did shop around and went with a different solicitor but kudos to the estate agent for being straight with us. 😀

I think some might start off honest but eventually become corrupted by greed to make more money and pressure from the company to do anything to get a sale.

I knew a great and honest car dealer. My dad got 2 cars from them, and they were more than helpful when something went wrong with the radio. I bought my car from there too, and I still have it, over 20 years later! The problem? They went bust after only a few years. Honesty doesn't pay...

@@welshgit I went to buy a car at a dealership. They assigned me a specific salesman. He had a trainee with him. The actual salesman seemed dodgy af. Kept obviously making up answers to questions. But the trainee seemed really nice down to Earth and honest. I left and came back a few weeks later and asked to see the trainee and was told he had left so ended up going elsewhere.

I didn't trust an estate agent selling my house so left a phone recording when he was showing people round. I was very disappointed on what I heard - one lady he obviously had taken a shine to, he told 'if you want this house I can make sure you get it, I'm sure we can get some reduction on the price'.

There's no such thing as an honest estate agent. They are pointless, do nothing, and are totally unnecessary, and then charge you an exorbitant fee for doing it! There is no need to ever use them..do it yourself. The solicitors takes care of all the legal stuff. Estate agents just look out if the office window.

Sold my house online for £100 commission saved at least 3k, did all the showings, got it on Rightmove and sold it for £35k over the prices quoted by 3 estate agents. Always try and get three valuations first and then try and sell yourself.

@@weyman4317 well done. Remember, estate agents only have their own interests/ commission in mind. They quite happily lie to the vendor, and lie to the buyer. They will manipulate and deceive anybody to ensure they get their ridiculous fees. Never trust a word that comes out if their mouth. They should be abolished.

Friends of mine are trying to buy a house in my town. They WILL NOT be shown ANY houses by a local agent if they are in a chain of any sort, FULL STOP. The agent doesn't advertise cash buyers only either, for getting clients. A relative of mine died over 20 years ago (old age) and his house was sold by an agent to his own mate, who was a builder. We only found out later what the agent had done, so lost out on potentially thousands more. The agent even said it was the best offer we could get for the house. Of course it was sold later for a much higher price, after the builder had painted the front of it.

@@weyman4317 Amen. Estate agents tend to lower the price so as to sell quickly. I knew how much my house was worth. Estate agents priced the property around ten thousand less. I stuck to the asking price and won.

I'm always disgusted by the amount of scorn that's placed on unemployed people; WHEN it seems that every ['hard working'] employed person [especially where large sums of money are concerned] are constantly disingenuine, not to say 'crooked' in their dealings with customers/clients. Fear of losing your job is of course the primary reason that so many ppl are being forced to be dishonest. What a bloody species we are!

I have been both unemployed and employed. I concur that people do treat you worse just because you are unemployed. And knowing what I do about some people's exaggeration of income, I think it is often the unemployed who are more honest (it is often easy to mask your real income if you are self-employed, for example, whether to reduce or increase it depending on what you need the proof for).

How do the courts deal with liars? They award them the judgment, in spite of evidence to the contrary. Bribery is highly suspect.

Oh yes, spot on... family courts where 'social workers' get paid to falsify reports and men have to sell their house to see their children for a few hours. Guess whether that cash is shared out or not?!

As other people of noted this has being going on for years. When we bought out first house in the 90's we naively accepted the estate agencies offer of seeing their in house mortgage broker, we ended up with a useless endowment mortgage (remember those?)

Endowment Mortgages used to be very good, as long as you had a reasonable one. When companies weren't burdened with so much taxation and regulations, they worked well, particularly in the 1980s & 90s. They also attracted tax relief. Since then, they have become outdated, because all that changed.

I paid into an endowment for years. . They then done away with them. . Thinking about it, I have no knowledge where that money went.

@@TheOriginalDaveJ I would chase it up. Just because the laws change, doesn't mean your money should disappear. It might have, but unlikely, but at least find out where it went. There ought to be others in the same boat so, if anything needs doing, you shouldn't be alone.

@@TheOriginalDaveJ a lot of people sold them. i kept mine when i moved house in 99 and swapped to a repayment mortgage, but kept paying the endowment policy until it matured about 5 years ago. i got enough off it to pay off my current mortgage. they were not done away with, people just stopped taking out new ones because of the interest rates....i would dig out your paperwork, unless you cancelled it and cashed it in, it will be there somewhere

when my son bought his house the agent told him he would lose the property if he did not use their legal team...which was a complete lie obviously, but the agent got a fee if they got people to use that team...very, very shady!

That second recording, she was apprehensively trying to approach the broker topic, then when she did, the excitement in her voice, all I heard was possible referral commission here 😂

With the second, I don't think at any point I heard the agent state that the premium list was conditional on accepting the inhouse mortgage, just that they would put the buyer on the list if they made an appointment to discuss the mortgage. I have no legal knowledge on whether that makes a difference, however, it does seem that the buyer was not *forced* to get the mortgage to be on that list. I wouldn't be surprised if it is untested if the list can be conditional on making such an appointment. It did not appear from the info in this video that such lists are themselves illegal, just certain conditions to get placed on one.

I remember in 2007 pulling out of purchasing a property because the vendors estate agents were only interested in selling me a mortgage. I told them time and time again I had an agreement in principle from a very well known High Street bank but they persisted in harassing me to "come in for a mortgage check". I'd receive a phone call every day from a very pushy sales advisor telling me the purchase of the property would be in jeopardy if I did not come in. In the end it just became too much and I told them I was no longer interested in going ahead.

I had this exact same issue, I told the estate agent “no I have my own financial advisor” and was told that I HAD to use their financial advisor dropping everything I had done with my own financial advisor otherwise they would it allow me to proceed with the sale!!!!

When I was looking for a new house, I found the perfect house for us, the right location, west facing garden, double garage and close to an Outstanding school. Drove around, looked it over from the outside, checked out the neighbourhood..... perfect. I called the Estate Agent who was a not to forthcoming with info and said that three offers had been put forward and the vendors had taken the property off the market. In this dog eat dog world I drove around to see the the owners, prepared to go £100K over asking price. Spoke the owner, who was gobsmacked as no offers had been made as it had been on the market 24 hours and no one had viewed it. I called the Estate Agent back, spoke to the same bloke and asked him, he he would call the vendors and just ask if I could view it. All this on speaker phone with the Vendor. Five minutes later the Estate Agent called back and said the vendor had refused my request. No phone call to the seller, as I was with him. Long story short, the vendor raised a complaint to the Estate Agents Head Office..... and I got the house. Not sure what happened, between the EA and the seller, not my business.

Yep they are lying crooked bstds they have ripped me off big time lied similarly and EVERYONE I know has a similar story and yet there are estate agents who have the cheek to claim to be honest! We have no consumer law worth a damn in England

I had this hard-sell some years ago - apart from the mortgage hard-sell, the girl said that they advertise on all the search engines and some "that I'd never heard of"... Well I worked in web design at the time and if they were advertising on any SE i'd never heard of, then no one else had heard of them either... needless to say, with the amount of farmyard smell that was eminated I didn't use them to sell my house...

This sort of thing was common in Spain years ago and there were many people defrauded. It seems shear stupidity to me to buy anything using the vendor’s solicitor.

I’ve just bought a new detached bungalow at Seascale which is in Cumbria, it’s near Sellafield I live by the sea. I’m in the middle of a divorce. Those estate agents were shocking and DISPICABLE. I moved into my bungalow in mid October!😊

We just bought a house back in July and many EA's asked me to see my MIP document and I refused as it is not relevant until my offer was accepted. They made excuses saying it was a fast moving market at the moment so they needed to make sure we could afford our offers. I said if I tell you I can afford more than a potential offer you have no insentive to secure a good deal for us and they hung up lol. Our solicitor fees were about 1.5k just to buy, not sure how much to sell as well but if a solicitor was going to cost that man 15k that would have been a red flag right there. The second recording, notice she never really answered the ladies question as to why. She said to be on the premium buyers list they had to prove your affordability but anyone with a MIP would have done this with the lender so it was an irrelevant arguement and blatent coersion.

I work on the conveyancing department of a solicitors firm. Estate agents practices are diagusting. The distress and confusion they cause to clients throughout the process is unacceptable. The agents role is to market a property and find a buyer. This is where their involvement should end. But it doesn't. It doesn't because they are Referring work to solicitors and thus We (the solicitors who actually do all the work) have to pander to these predatory third parties. This must stop. Agents should cut all connections with the transaction as soon As a buyer is found. End of discussion. Edit: oh and yes... NEW BUILD DEVELOPERS AND THEIR MINIONS. These ones are one whole different level of evil.

Tried to buy a new build recently from a well known building company. The builder wouldn't let me as I wouldn't use their solicitor. I was basically shown the door even though I had the proven funds and had already sold my house.

While renting a property the estate agent tried to charge me £50 to renew the contract/tenancy agreement, which is now illegal. My reply email was "ha ha ha ha ha."

ALWAYS make your offer known quickly and directly to the SELLER!!! In 2006, after a week, my offer never went from the agent to the seller. I spoke directly to the vendor (they needed a quick sale!), and I got my property. Local properties (here, as with a lot of other places) are used for buy-to-let, and my conclusion is that there was (at least) a profitable year-on-year letting fee available to the agent. Presume there is an ulterior motive in the agents' actions! Thank you for the video, BBB!

The simple point to remember is that an "estate agent" is an agent for the seller, very definitely NOT for the buyer. The estate agent is there to get the best deal for the vendor. You wouldn't play poker by showing your hand first.

You need to bear in mind the agent is representing the seller. Since you are spending hundreds of thousands (or even millons) it isn't wise to allow the sellers agent to handle your affairs too. If they can't process your offer quickly and professionally, then it is likely they may mishandle some further process further along up to and including completion. You need people working to represent your interests and your money. Likewise valuations from the sellers agents valuer is worthless - in my experience its from buying in the 90's it was always exactly what you offered by some strange coincidence, and probably didn't involve any actual inspection. Even if you have a 100% mortgage, you're still going to have to pay that money back at some point so get an independent valuation that will tell you about things like blocked or collapsed drains, uninsulated roofs, antiquated plumbing, cracking and all the other things that have been missed on a drive-by valuation. If you get beaten to the house by someone less careful then you've escaped being in a bidding war with someone with more money than sense which you would inevitably lose on either actually or financially by spending more than the house is worth and finding that there's still money to spend, spend, spend. Don't ask me how I know........

Statement Analysis & Conversation Analysis are very accurate. Add those to body language, lies can be detected & mostly, real truths can be found, as most people don’t tell direct lies, they mislead - unless they’re a psychopath. People who have even a bit of empathy resist lying.

3 branches of the same EA went one stage further when I was looking to buy - they wanted me to agree to see their mortgage advisor and discuss their conveyancing services before they would even book or confirm viewings. Same sales pitch from all 3 branches. Despite having a MIP already and a conveyancer sorted. It got boring saying “no” in the end.

It used to be worse than this. When the insurance companies and banks bought out chains of Estate Agents, and somebody wanted to buy a house, lots would say you can only buy the house if you arrange a mortgage through them? Otherwise the would let(recommend) the Vendor go with someone else. That's why you should always go with an independent Estate Agent, who would not be there unless they knew what they were doing. As opposed to chains of Estate Agents whom either don't know fully what they are doing is even wrong in law. Plus sometimes the Sellers solicitors on receiving buyers details, would tell their client that they had a buyer/developer and would nause up the sale.

Never, ever, appoint a conveyancing solicitor, mortgage broker, nor buildings surveyor, connected to the vendors agent. Research and choose all three to use before even approaching a vendors agent, because you want your representation to be independant of the vendors.

So the second call, technically, as devious and snide as it is, they don't appear to be breaking any rules. By restricting access for available properties to their "premier" list, no offers can be made on them by anyone declining their in-house services, clients not on that list don't know they are for sale, therefore they aren't withholding any offers on the property.

Some estate agents in Bristol wouldn’t let me view any properties unless I’d met with their mortgage adviser while I was in the process of buying. It wasn’t optional, if I wanted to arrange a viewing then they would make me meet their adviser, even though my mortgage was already sorted.

Thankfully there are Chartered Surveyors and Valuers who ultimately survey the property to be bought in the interest of both the lender, to whom the property will be security during the mortgage term, and most importantly the buyer to ensure they are buying at a fair, not “ inflated” price. That valuation should exclude valuable cash incentives to the buyers like cash back deals, such deals must be clear and transparent. Valuers are no ones friend initially if they refuse to accept a purchase price or put a figure on the property lower than the agreed price, either because comparable evidence showed the price to be too high or because faults affecting value were revealed at the survey stage, not taken into account when the price was originally agreed. The practice your video exposes is just the tip of the iceberg believe me. In the later case of faults being uncovered by a survey,it’s not the end of the world and once the cost of essential repairs are established the sale can still often go through albeit at a slightly lower price more accurately reflecting property condition. In that instance the surveyor becomes the buyers friend, allowing purchase at a more realistic price and warning of the inconvenience of repairs the lenders may insist upon carrying out within a fixed fair time period after purchase. Estate agents invariably hate Surveyors and Valuers who carry out their professional duty and value at an accurate figure reflecting condition. They call that lower figure a “down valuation”. It is of course no such thing, it’s an accurate one. The term was invented by estate agents. The most important thing any buyer can do is make sure that they have a good surveyor and valuer with local knowledge to advise prior to purchase. Anyone needing mortgage finance will have the minimum type of mortgage valuation essentially to make sure the lenders loan is protected by the value of the property. It is always best if a buyer opts for the extra protection a more detailed survey and valuation brings, specifically undertaken for their benefit. So that’s a homebuyers report, or better yet where funds allow a full “structural survey” enabling a purchase decision with as much knowledge as possible about condition in addition to the price. After all mortgage repayments, large as they are, aren’t the only costs of owning a home you need to be aware of. You have running costs, which is where the energy assessment comes in looking at insulation standards, heating efficiency etc. And all properties come with maintenance costs too which can absorb a lot of hard earned cash if expensive repairs are required such as re-roofing, woodworm and rot, damp treatments or dreaded foundation underpinning if you are really unlucky. I know this because this is the very work I did for over 30 years. Never liked by estate agents worried that I would discover hidden faults and delay a sale…their fee coming through. You have no idea how many times matters were not disclosed as they should have been to Valuers by selling agents at the offer stage, such as known structural issues. How often “undisclosed” structural engineers reports would suddenly appear once agents were aware I was about to ask for one because of a potential serious structural issue!!! Oh here it is, we “ forgot” to tell you, we already have one of those so you don’t need to ask for another one do you? That report no doubt obtained for a previous potential buyer who then pulled out. Such things not uncommon at all. Mortgage brokers would have certain companies doing valuations for particular lenders, known as panel valuers. Believe me if brokers became aware of diligent Surveyors and Valuers, the ones experienced and capable of identifying and diagnosing property faults, reflecting those faults if need be by assessing a lower valuation, they would literally approach managers at surveying companies to “complain” about what they called a “ down valuing surveyor. They would threaten to try to redirect survey business elsewhere if that “rogue” valuer was not brought to heal by accepting overly high purchase prices. They never did quite explain how they expected you to “unsee” the faults you had noticed though. Managers to placate disgruntled brokers who did not get their fee because a potential purchase fell through….with good reason….would agree to “ have a quiet word” with their valuer to apply pressure to let inflated prices through in future. This happened and I suspect was a common occurrence and could be said to be a potential factor in fuelling unrealistic property price rises. The general public and indeed a lot of the legal profession I suspect are unaware of the undue pressure some would argue was historically applied on Chartered Surveyors and Valuers, sometimes by their very employers, to accept inflated purchase price figures either with undisclosed buyer incentives, condition issues, or a price arrived at through horse trading between competing purchasers which is a practice not meant to happen but still does. If comparable evidence suggested a price was on the “high side” perhaps a tolerance was given to still accept it. Fortunately some major mortgage lenders appreciate more than others the value of having conscientious competent Surveyors and Valuers on their books who after all ensure their lending is based on a proper valuation and risk assessment. It is so so important that a lenders valuer has the backing to carry out a fair assessment without the implied pressure to always accept a stated purchase price without exceptional reason. If that doesn’t happen it is at the core of creating inflationary pressures on house prices. Very very few outside of the surveying profession understand fully how the process works and why it is so important to have valuation professionals with the gumption to occasionally so no, that’s not right, you would be paying too much!! A professional duty of care to the customer is paramount and overrides the commercial and personal pressures sometimes applied on individuals normally employed in a surveying firm (since surveying firms do the vast majority of lending valuation work). I know it seems like extra money you can ill afford at the time, but please if you can get the peace of mind your own private survey will bring over what for most is their lifetimes biggest purchase.

Except only the most expensive survey is really worth anything, the fully invasive kind. Not many homeowners are going to let a buyer turn their home upside down for a survey in a heated market when there are plenty more buyers willing to pay or better the asking price. Perhaps the law should be changed to demand an independent detailed survey prior to the lawful listing of the property on the market. If only someone could make that happen..... hmmmm

Same here. I literally handed a brown envelope full of cash to the manager of the branch. About £1k in today's cash i woudl guess this was about 40 years ago. It was a well respected building society that still exists today. I ahve no doubt there was no corporate knowledge of this just a dodgy manager and maybe his manager as my mortgage case was somewhat on the edge so maybe teh money went up the chain.

Some while ago I was subjected to DCS (Debtor Creditor Supplier) and was led don the garden path. It put our house in jeopardy and three solicitors wouldn't take the case on as they'd say we'd lose. Anyway, a McKenzies friend did take us on and saved the day.

Thirty five years ago I agreed the asking price on a house. Turns out that the agents never put my offer forward because my mortgage wasn't through them. Lied to the seller telling them I couldn't obtain one. I was young so did nothing about it, much older and wiser now.

This type of activity has been going on for years. I had an Agent refuse to pass on my offer(of asking price) until I spoke to their Team even though I had finance in place elsewhere. Not going to happen!

The best advice is that whenever you commission professional services (estate agents are supposed to be professional, preferably registered with RICS) ask yourself who benefits from the services on offer and be as cynical as you like. If you come to the conclusion that you benefit most then its probably a good deal, if not then walk away. We are in the process of selling a house at the moment, we interviewed several agents about what they could offer, one agent was pushing using an on-line auction, a bit like an Ebay system but any successful bidder has to commit to paying a percentage fee within the prescribed period of a few days to make the bid valid. When interrogated the agent finally admitted that the fee would go straight into their pocket and as a seller we would still have the risk of the deal falling through with all the costs, which makes the normal reason for a deposit completely sidelined, yet initially being committed to a bidding process that would probably see a much lower selling price. Who benefits? Not the seller as they have a low price that they could expect, but the agent is guaranteed his fees quickly. Suffice to say we have not taken this process on even though it is now suggested by our current agent.

Quite right, I wonder if this is the valuing Clive that I know. The estate agents wants the sale to go through as quickly as possible, as smoothly as possible. Sometimes operating on a fixed fee basis but often on a percentage of the purchase price, it’s more important for them to see the property sold quickly, to get their fee quickly than hold out for a few thousand more. They don’t get paid any less if the sale is quick but incur less costs that way. If a property sells very quickly there may be a suspicion the property was being offered at below market value or even that the agent has a “ friend” who wants to buy it for less as a buy to let investment of for their own son or daughter. All the agents will say is the quick sale just proves what good a job they did selling it so fast. As a valuer with experience you would see a pattern of certain agents tending to initially market at an “above market” level, with little interest the asking price would be dropped with the marketing ploy of a “ reduced” tag on it, making a buyer think it was now at a bargain price when in fact it was now at the correct market value. Other agents you would notice would more commonly recommend reasonable asking prices, not too high to deter, but with a little wiggle room too. The ONLY person in the process who does not have any vested interest in whether the sale goes through or not is the surveyor valuer. He or she can offer genuinely impartial advice about the price and ensure property condition doesn’t affect that too. Not all estate agents by any means commonly carried out sharp practices, but in the surveying community we pretty much knew which firms were more likely than others not to be straight with you. Some seemed to forget that surveyors meet regularly during continual professional development, we pass on information and experiences, we know what goes on despite a minority of agents thinking they are being clever and getting away with things to earn more commission.

Life's experience once told whether or not someone was lying. We now have a shallow, throw away age where seldom we find persons that can tell if someone is lying, and it is not always body language. We all know, should know that estate agents lie in order to sell you a property. Never had any problems with estate agents because I know their game, and have played my own on them, on one occasion I saved a thousand pounds on a property by manipulating the estate agent, whilst the seller also profited by the same amount.

Some years ago I saw a for sale sign go up on a house I was interested in. Contacted the agent same day for details. Was told they would send them out when prepared. A week later called again and was told they weren't ready yet. This went on for about 6 weeks.... when a sold sign went up. I believe either the agent or a friend wanted the house and made sure the seller thought there wasn't any interest.

You can go in see a estate agent and put your name on their books and they will phone you if anything comes up, that’s their job to show you properties it doesn’t matter if you use their mortgage advisor mortgage or not.

Sometimes the sellers are less than honest. I know a case where an area claimed by the seller as a patio, was actually a public right of way. Another one in London where the buyer found they had been sold a house including a parking space that was the property of another person.

I’m an estate agent and hearing this is shocking, and I know it happens 🙈. Not In my agency for sure. The second call I’m sure is legal for the first part, but it’s certainly very unethical. The second part on insisting seeing the mortgage advisor that is illegal. It’s also not best service for sure. As a seller I would be disappointed to know that they are trying to stop all potential buyers seeing their property and limiting it to those buyers where they are making more money. It’s disgusting and is banned for a reason. The whole industry needs a shake up. And agents should be licensed. Also even in hose mortgage people shouldn’t be selling it. That surely would be a break of GDPR.

As a prospective buyer, I approached an Estste Agent about a property whose details had just appeared in their window. She told me that there was a fantastic response to the property and I would need to be offering at least the asking price. I arranged a viewing, during which I quizzed the vendor about aspects of the house, slipping in the "Have you had much interest?" question. He said I was the first, having instructed the agent a fortnight ago. I told him that it had only just been advertised, and thet the agent was lying. I offered him the asking price minus 10% as a one to one sale, no agent's fees, and he agreed on the spot. I'm still iving in the house.

Having had been through a bankruptcy when we were going to buy a new home, we were pre-qualified for a mortgage up to $130K we bought a house for $80K. My realtor stayed within our budget not going to the higher end. I know in American the realtor is separated from the mortgage lender/broker.

You learn something everyday - it never occured to me that provided your financial capabilities to the estate agent is a bad idea because then they can provide that info to the seller. I appreciate the ease and speedyness of going all in-house, but at the same time it can lead to missing some things. For example we had an issue with a potential costly liability when purchasing our last house - it took ages to resolve because our solicitor and their solicitor were slow to put the appropriate solution in place (we had to negotiate the solution with the seller separately and then instruct our solitors to check and implement), but the issue was at least flagged up and a solution could be put forward that was in my interests because there was no conflict of interest.

I used to inhabit a UK financial forum dealing with housing and it was very common for newbies to the forum to post saying the EA had said they wouldn't pass on an offer until it had gone through their in-house broker. One loophole these EA's use is to say the vendor has asked them to do a financial check on the buyer and this is what they are doing so its not illegal. I don't know what side of the law this falls on.

The only way to stop these shysters is stop estate agents having other in-house services such as mortgage lending... As for the call itself, this is what 'customer service' is about these days. They call it 'value added calls'...every contact with a customer is considered a potential sale. I know someone who worked in customer services for a well known, well regarded credit card company. They told me that customer service agents were expected to have reached targets for selling products or obtaining potential leads for the sales team. The person concerned was shocked to be given a demerit for not trying to sell PPI to a customer who just wanted to report their credit card stolen! Practically all first line customer contact is seen as a sales opportunity, and the CS agent is usually reading a prompted script, telling them what questions to ask. I guess that practices that were once the purview of big companies are now being used by small companies.

I was lied to on a renting property, told me I had to pay 60 quid to get the pay as you go gas and electric meters taken out, good job I rung up the electric and gas companies to ask if that was true and was shocked that it wasn't true... Estate agents are like car salesman... Always approach with caution

I would be interested to know why buying or selling a house is still as slow a process as it was 40 years ago when I bought my first house ? Despite the advances in technology particularly communication speeds. The need to use the postal service is virtually eliminated entirely as most communication that would have previously involved letters and certificates can now be done by email. Similarly with communications that may have previously involved telephone conversations. Surely with these advances things should move a lot faster.

Really this is deplorable. I would have terminated the call after the first set of lies. AND it is not confined to sellers agents. I have a file from my last sale where the agent simply ignored my instructions and went off on a frolic of their own in order to control my sale. In the end I sold but told my Solicitor not to deduct the agents fees as they worked against me. Of curse they tried to sue but I confronted them with my file that I would defend myself with and they backed off. Can't name the big agency but I believe they use contrails in their ads.

Regulated agents when discussing a buyers position they only need to know if they buyer has the amount to satsify the offers. We can not ask how much can they borrow upto. If in doubt conduct everything in writting with the agent.

Estate agents can really be scumb of the earth. When I was selling my last house my agent tried to get me to sell my house for 25K below the market value to his business associate. I smelt a rat and withdraw from that sale and switched to another agent, within a couple of days it was sold for 25K more. He as a real con man!

The majority of agents have referral arrangements with law firms which they use, so they often also have a financial interest in keeping control of the situation. In my experience agents are not above slandering lawyers in order to put people off from using their own legal team. If the general public were aware of how shady some agents are, they would be outraged. Referral fees need to be banned just as they have been with personal injury claims. Any referral fee paid by the law firm is passed straight on to the client, so there is a genuine financial interest in NOT going with the law firm recommended by the agent, and this can be hundreds of pounds. Do not be bullied.

That these foul practices are so widespread indicates to me that the Property Ombudsman is not doing enough to control their industry and the penalties for being caught are not high enough. I work as a mortgage advisor in my area and am regularly frustrated for my clients when they tell me these practices are happening, often with more and more complicated schemes to “control” the transaction and make more money which, at the end of the day this is all about. Whilst I do give them a copy of the Ombudsman’s guide and recommend they complain, I can’t make them complain (at the end of the day it’s their time & effort to do it) and despite searching I’ve found no evidence of the ability to “blow the whistle” directly to the Ombudsman so these practices could be called out by those of us connected to the industry that are more aware how common these practices are. The worst offenders are the agencies that are owned by bigger operations behind the scenes, you only need to scratch the surface a little to discover that a fair few “local” often well known names on your estate agents high streets are not the locally operated firms you might think but part of a national group often owning more than one agency in the same area operating the same sub standard practices.

It seems many Estate Agents ignore the law in other respects too? Locally they erect signs "all over the place" e.g. fixed to street name signs, railings near flats etc. Also leave them for many months (years in some cases). I think there may be laws prohibiting the fixing of signs to objects where the agent does not have permission to do so? And they must not be left on display after a property is sold? And it must be clear that the sign is to related to property sale. e.g. "Let" or "Sold" is permitted, but "Success" is not?

The courts are just so shite and corrupt/corruptable in the UK - I had an old friend who used to go into courts, appear all humble and so well spoken/dressed and just make up laws and citing cases that never existed - never once got caught out.

When we sold my dad's house they were very slow and couldn't be bothered like they were more interested in bigger sales,contacting them was terrible slow,I still believe they were trying to sale it cheaper to there clients with housing portfolio stock,I ended up having to do a few viewings as they were always unavailable, even my solicitor had trouble contacting them

In my opinion we don't need estate agents. They pretend to be your friend. Offer mortgages you don't want. Do a few photographs of the property....stick a few in their window and advertise on Rightmove etc for a short time. THEN comes the sting........silly charges for basically doing *uck all !!!!!

That second transcript sounded like a Timeshare sales (wo)man. Having said that, when the buyer challenged asking what would happen if she was a cash buyer, the response (particularly re source of funds) sounds like your run of the mill MLR thing, anyway.

My partner and I renovate properties so we view a lot of them. Most if not all estate agents know us in our area now so we often get marketing calls offering us properties that have just come on the market which is fine. The second call reminded me of one particular estate agent who always makes things difficult for us to view a property or offer on it. Demanding proof of funds and a mortgage in principal just to view it. Pretty weird. When I said no one else asks for this stuff before viewing, it’s the wrong time ask as we might not be interested in it at all she acted surprised. I actively avoid their properties because I can’t be bothered with it. Happy to confirm verbally how we’re paying for the property but a mortgage in principal for the property in question specifically doesn’t make sense. The second sales call went far too far being misleading and I would’ve been shorter with them. Not because I know the law that was mentioned just because I know what’s normal between agents.
