What is the extent of the reasonable accommodation and appropriate measures that an Irish employer is obliged to take for an employee with a disability? This video looks at section section 16 (3) and (4) of Employment Equality act 1998 to see what measures the employer must take. The case referred to in the video, Nano Nagle School v Daly, has been in the Labour Court, the High Court, the Court of Appeal, and the Supreme Court. The Supreme Court's decision is awaited as the video is being made.

Quick question, If a employer tells you to give them medical reports from your treating doctors for a long term illness and to wait more than a year to make sure you are ok coming off a medication and have been uneffected by the illness for more than 15years, Is it fair of them to not give you a second medical test even though they give a second medical/chance to other candidates but not you for some reason.... even though they made you wait. It seems unfair to me not to give that person anything but to waste their time and make them wait just to tell them no instead of just saying no in the first place. It is complicated I know but it doesn't sound like this person was treated fairly and is it discrimination??

Quick answer: if you want your situation assessed you should consider going to a solicitor for legal advice. Or Citizen's Information for a good steer if you want free and can wait

@@terrygorry Appreciate that, I feel like I have been treated unfairly as they made me wait nearly a year and a half which I won't get back just to tell me what they could have told me at the first medical assessment. It is completely unfair as they give others a second medical and I have not even been offered one despite being very cooperative and patient. This sounds like unfair treatment if you ask me. I am waiting for a friend to give me the go ahead to appeal it but I need them to state that in writing first.

Being treated unfairly is neither here nor there, to be frank, life is unfair. The question is whether you have been treated unlawfully or not, or whether you have been discriminated against. Different solicitors charge different consultation fees ranging from €100 to €400/500.

@@terrygorry Well mine is related to discrimination of medical history. Even though my treating neurologist said I am healthy and fit to do the job.
