Refusing To Split The Ashes

The People's Court

Күн бұрын

The plaintiff and the defendant had a son who passed away a few months ago. After he was cremated, the funeral home divided his ashes into separate urns for them. The plaintiff claims the defendant took both urns and refuses to give him his half of the ashes; he is suing for their return. The defendant says the plaintiff wasn’t even in their son’s life until he was 13, and was a terrible influence. The defendant claims the law says the ashes are the property of the parent who had 100 percent custody. The defendant does not want the plaintiff to have the ashes, as she fears he would something unethical and illegal with them. She is countersuing for the balance of a GoFundMe account.

I’m a mother who recently lost my son to suicide. Since he was married I had no legal right to his ashes. But his wife allowed me to purchase a broken heart pendant and it was filled with a tiny amount of his ashes that I attached to the chain he always wore. It now hangs in a shadow box below his picture on my living room wall. Was that enough for me? The answer is yes because in the end all you’re really have is memories. And no one can take those from me. The woman is petty. Give the father his half. Let him honor his son in his own way. I know they’ll never be at peace because no parent should ever have to say goodbye to their child, but fighting over the ashes just makes the wound deeper.

You are so right and i am so sorry for your loss. When my father died, his wife let her close male friend and her son have first dibs on the valuables. She called me after a few days and asked if i wanted to go through his things. When i walked in the house, i immediately noticed all the bare spots in the house where his knife collection and other prized possessions used to be. They had already been spoken for and removed. She had all his old work clothes, old tools, VA/Army paperwork and other "valueless" things laid out for me to go through. I knew the name of the game. She had the legal right to his things and he had a will that i read myself although he didn't mention his belongings in it. It didn't matter, tho, because when i rekindled my relationship with him 13 years ago it was for the things that were worth money to ME, a relationship with him and making up for the past. In the end, that's what I was left with, memories and no regrets. And I did take some of his things that i could use: some of his shirts that i sleep in, some tools that i could use, his Army records, etc., they were all things that i could use and remember him every time i did so. The knives would've just gathered dust. I have what matters which was his love, time and great memories. 💕

After hearing all of this, my heart really goes out to the daughter. She lost her brother and I can only imagine all the back and forth she has to hear when it comes to her "parents". I believe we have only heard a fraction of what she has. She is only 24 at the time this was filmed, but I don't even want to think about losing any one of my siblings let alone my older brother at that young of an age. If anything, the two "parents" need to get this resolved quickly for her.

I am a remaining sibling after the death of my brother 46 years ago. My parents fought over who was responsible for his death for decades. I ran away from home and resented that I was ignored while they carried on spewing hatred towards each other. I ended up with 2 hospitalizations, a failed marriage, and decades of therapy to piece my life back together. My parents went to their Graves miserable and bitter. They suffered terrible sicknesses and I vowed not to be like them....and I'm not! I was there all the time for them, and yet they were so blinded by blame, they couldn't be there for me, the remaining loving child who desperately needed them. I don't write desiring pity, but to reach out to other parents who have lost a child as a reminder that if you have other surviving children, that they are just as important and need you too!

@@debdo1960 it’s so sad how often death brings out the very worst in people. When we lost my grandpa my aunts and cousins LITERALLY looted my grandparents house for anything and everything they could get their hands on and not just valuables EVERYTHING including things that were only sentimental. He wasn’t even in the ground yet!! Then we found out they sold the majority of it at a garage sale. I was so disgusted by them I broke all contact and 25+ yrs later I still don’t regret it! But they weren’t my parents so my heart really goes out to you. They should have been there for you and weren’t. I don't know about the people in the comments: Raising a child or having a relative who turns out to be a drug addict can harden your heart quickly. They steal from you, they put your life at home, and your job in jeopardy, and make life miserable when they are high and refuse to seek treatment. Her disposition where she goes from upset and crying to speaking regularly... Is actually quite common amongst parents who have a child addicted to drugs, or have lost a child addicted to drugs. I had a cousin I knew from birth like a brother turn to drugs. I loved him, but he couldn't stay at my place. Like this lady: he could eat here, he could shower here, but eventually he couldn't come around anymore b/c he'd try to break into our rooms, our neighbor's houses, cars, w/e. Anything he could steal to sell for drugs, he would. My dad actually threatened to shoot him, cocked the shotgun and everything. One neighbor actually took a shot at him. Eventually, when he died of an heroin overdose, I mean... we cried. He died last month. We were sad for his loss, but after of looking back on it, *I* personally can't shed another tear for him, and I'm glad he's dead. Because of him, I had to carry my valuables with me to school everyday b/c I'd fear he'd break and steal my shit. We never had locks on our individual doors until his mother caught him stealing from her, and my mother caught him stealing from us. We don't live in the hood -- the locks were SOLELY b/c of him. I understand this lady's pain, and her disposition.

Of course Doug pushed his buttons and the dad turned around and said her dirty laundry, it was like ‘OMG, why did he say that?’ She wasn’t a perfect mother either. You are defending a sociopath. Among his efforts to hurt her, he did not want the ashes properly taken care of. He wanted to just dig a hole on the ground in a cemetery, which was illegal, because he was too cheap to pay for a funeral, or a burial, even though he had a Go Fund Me for it and she said he would pay half for a proper burial. The ashes would have to be exhumed, and no mother wants her child’s ashes disturbed like that. I think he DID get the kid on drugs and addicted to get back at the mom.

Why is Doug Lewellyn taking sides by saying "No, YOU were the one in jail!"? What does that have anything to do with right versus wrong? Makes you think about how a woman crying takes great impact on sympathy and empathy when deciding who is the better suited person. This case is absolutely disgusting. Is that what we as humans have become? Putting each other through pain and suffering over remains of a family member? Classic King Solomon "split the baby" case. Rather than fighting over gaining or retaining half of your son (clearly a control issue), give up your half to let the boy rest in peace (not pieces). For crying out loud, his spirit lives on in the memories, not in the ashes! Who is fighting to do what's best/ right for the boy? Clearly, and unfortunately, he was a pawn in the game between these two parents. Maintain control over the child to stick it to the other parent... for shame! The fact they are still carrying on like this even after his death is evidence that they did it time and time again while he was alive.

The title of this case is accurate. Heart breaking. I love how the judge handled this one. Looked like she was gonna cry. This one brought tears to my eyes. I can't even imagine the the loss of a child nor would I want to. My best friend lost her one and only child (at that time, thank The Most High she was blessed with another daughter 6 years later) and she's never been the same. She was 14 when she passed. You never have the right words to say to someone who's been through this. All you can do is be there for them. It's a horrible thing to happen to anyone. So sad.🙏🏽😪

This lady is a liar. He went all in that his son had not said that in counseling, even though she had said it was written in a psychological evaluation that she had read. He wasn't worried about that because he knew she would NEVER produce an evaluation saying anything like that. How did he know that she didn't have that? He knew because he knew she was making that entire story up.

Even Judge Milian could hardly hold back her tears. This is one of the saddest cases I've seen...two clearly dysfunctional parents, and they wonder why their son turned to hard drugs! SMH people need to do better with themselves BEFORE they have kids! Your mistakes can have grave consequences on your kin.

This was absolutely heartbreaking for both parties...I thought Judge Milian handled it with extreme sensitivity and understanding. Doug on the other hand was complete moron and hypocrite in getting the guy worked up, and then when the plaintiff starts talking about his ex, Doug's reaction is telling the guy he doesn't have make a dig like that. Doug just couldn't offer his sympathy to the plaintiff and let him be on his way?? I guess that wouldn't have made good television...

He told me one day wish i would have told your mom how i really felt but i didnt want too look weak and havent seen him agin i was like 14 ... not knowing he looked more weak pretending to not like her vice versa... My mom would say I cant stand your dad he was so ugly nobody wanted him blah blah then another day i would say so why is he my dad? She then says he was so funny cool and good to be around ... Then shows us a picture this man who i thought was ugly and all this was handsome beyond thought! My whole life was a lie from both sides.... Im the one who suffered... Whatever happened, happened. It's in the past. In my years of experience in parenting, what I've witnessed is that cases like this are the result of failed parenting. Split the ashes. That's what a probate court is going to require. It's time to for both parents to put their battles aside. Until then, there can be no closure, and no healing.

The mother may have come across as overbearing at times, and she may have been hyper-sensitive when it came to trying to protect her children, which can be smothering. However, I do believe what the mother said in regards to the psych evaluation the son did prior to his death where he stated that the father forced him to sell drugs at school, provided him with drugs, and did drugs with him. The father seems like a real piece of work. While I do think both parents probably added to their son's mental health issues, at the end of the day that young man chose to do drugs, he chose to put drugs into his system and self-medicate to numb himself or level himself out and sadly it appears that he died from his choice.

I am the sibling survivor of my brothers death. My parents fought for 36 years over who was responsible for my brothers death. I was forgotten and ended up running away from home just to get away from their bickering and all the memories were too much for me to handle alone (he was my only sibling). I had a breakdown 15 years after my brothers death trying to keep everything inside. It took me two hospitalizations and decades of therapy to piece my life together. What I want to say is no one held a gun to this boys head in this court case. He CHOSE to do drugs. Period! All the blaming is not going to bring their son back and the remaining kids will grow to resent both of them. So in the long run, they will have not just lost one child....but possibly all of them! Split the ashes and get help....for your other childrens sake. It was their loss too!!!! You don't have to like each other and there is no perfect parent. Get over it!!!! Grieving is not fun, but blame is worse. Remember....the son CHOSE to do drugs, even IF the father may have offered, the child could still choose not to do them. I feel sorry for the remaining children/siblings. Not helpful to watch two grown adults hashing it out over a very tragic situation. GET COUNSELING IMMEDIATELY!
