Courts don’t make medical decisions, only doctors do, and that’s why the the lower court decision granting a TRO is as wrong. The real problem here is that the doctor was too afraid of being prosecuted so wanted a green light from the court , but that’s not the court’s job. If the doctor thinks Cox qualifies for an abortion, under the law, then the doctor can perform an abortion, and if the doctor doesn’t perform one, Cox could sue the doctor for malpractice. That’s the mechanism the law sets up for challenging it and setting a precedent, but patients don’t want to sue doctors. So they leave out of state.
