Leah discusses recent concerns regarding the quality of veteran compensation and pension (C&P) exams. Drawing from a military.com article featuring comments from Senator Elizabeth Warren, Leah highlights issues such as examiners not reviewing veterans' service records, inappropriate locations for exams, and rushed assessments. She explains that these exams are often crucial for adjudicators in determining if a veteran's disability is service-connected and the degree of disability. Despite the challenges, Leah points out that there are dedicated and skilled examiners, urging veterans to seek legal advice if they experience a poor exam outcome.

I unfortunately had this experience, after 7 years I won my appeal and was sent to see a c&p examiner in Little Rock, it was one of contractors. The guy was a NP, and I could tell something was off with him from the beginning. To make a long story short he didn’t write down anything I said, and completely lied. I didn’t know until my rep told me I was not only being not slated for an increase, but I actually was slated for a decrease. I was steaming mad. I couldn’t believe the things he wrote. Luckily my Vfw rep had someone at the senators office to help and the exam was thrown out, and I was given a new exam. That examiner was truthful and gave me what I deserved. BEWARE. Thank you prestige for fighting for us. I’ll be in contact soon.

Recently a victim about this. I came in my exam ready to speak about everything relating to my MH. I was originally denied from my supplemental and I requested another with more evidence. The examiner, who was the same examiner from the first exam, had asked what had changed over the last year and I tried speaking about my failing marriage/separation, my sick child, my lack of being able to hold a job and and how I felt like my life is deteriorating, but she rudely cut me off and said “I just want to talk about your marriage” before I could even begin Right then and then I knew how the exam was going to be. Got denied with no doubt that she was probably the main reason for this, and now waiting for the process of HLR. Nice take on this.

Here is a VA secret to the veterans if you know that the exam was inadequate all you got to do is fill out an affidavit have it notarized attach it to your statement of the claim and request a new c&p exam to replace the exam i should know because i have done this at least 4 times in the last 12 months each time the VA gave me a new exam - on the affidavit you must state what the examiner should have done and didn't do it - The exams was two VA employee examiners and two party examiners only reason the third-party examiner's what was the cost of va didn't send the examiners the evidence or didn't ask the examiner the right question to support the claim or claims -

In my last C&P for a Rhinitis appeal, I was very nervous. You almost have to feel out the examiner. Luckily my examiner was a fellow veteran and she spoke on the current issues with the VA process. She was very open with my exam, showed me what she was marking in the DBQ, and even showed me what the initial examiner put...surprise surprise, they put "NO" for everything. She was flabbergasted since she could see all the evidence I submitted initially and said she could clearly see the physical symptoms I claimed.

I understand that there are bad apples in the bunch, but what is frustrating is when c@p examiner has you fill out DBQ's in the waiting room and calls you back and sits and types with hardly any questions asked about your conditions. then after a couple range of motion tests your done and out the door and ultimately have denials. Im learning so much, to bad i didnt learn it sooner. That's on me but now I am fighting the denials. Oh and btw....the person that went in before me came out pissed and telling me it was bullS**t which also made me nervous before going in for mine. :(

Just had a C&P examine today for mental health. The doctor was incredibly rude towards me, split our video appointment into two sessions, lost all the notes from the first season, told me that she will decide what affected me and what didn't in a hateful tone, got snappy with me, took a call from another client/patient and i heard the entire conversation, rolled her eyes at me, twisted everything i said. First doctor appointment ever in my life, that i ended during the appointment. I was nothing but polite with her, told her she was being rude to me and im going to cancel the appointment and reschedule with a different examiner. She said "oh okay".....click.. called and emailed C&P to file a complaint against her and to reschedule. Wish me luck on the next examiner. Dont let them get crappy with you, shut it down and reschedule!

There is no transparency in the C&P exam. The veteran is left totally in the dark with little recourse. I have had four C&P exams, one excellent, two so - so and one absolutely unacceptable. The unacceptable one was for three conditions. The examiner called three days after the assigned date at 8:30 pm, complained about how busy she was, could not find the documents I filed with my claim, complained about the size of the file the V.A. sent her (I filed approximately 50 pages) and spent the majority of the 15 minutes trying to diagnose one condition and tell me what I needed to do to remedy it, instead of asking about the severity of the symptoms of the three conditions. The three claims were denied, big surprise. Typical V.A., substandard service, the V.A.'s talking points are always what a great job they are doing, but the actual results are often less than acceptable.

I remember going for a C&P exam for MS about 10 years ago. I saw a Dr. that was probably on General Washington's staff. This guy did his very best to try to talk me out of actually having MS. That I really wasn't suffering from the ailments I had. I didn't have cognitive issues, my brain just couldn't remember everything so it had to prioritize what was important and forget what wasn't. I left his 4th floor office, walked down to the parking garage to get into my car and realized I'd forgotten my glasses in his office. I'm guessing my brain didn't feel my glasses were important enough to remember. Claim for cognitive issues denied! It seriously seems like those giving C&P exams get a bonus for every claim denied.

Had a C&P exam and the examiner literally neglected to mention the fall I had occurred in the military (scar on knee), now I have to get a nexus for secondary (left knee strain ) to service connected foot injury. Doing the Nexus through Prestige (1st time), paid the fee for the review and waiting on a response. It's been over 3 days (which is their listed response time) but I can wait if everything goes well. I am one of the fortunate ones, in terms of my C&P examiners. I had no idea what to expect and didn't see or search for YT videos on exams. My circumstances were different from a lot of people's and because of this, I was straight-forward in every case. I had to go back to one examiner once she received some clarification from the VA. I had one video exam because there was no female psychologist in my state. From the time I applied to when I received my rating, it was 16 months. This was understandable to me, after the fact when I found all the "how to" videos on KZfaq, because I honestly gave the VA very little to work with. Then I was given outside contractors and the primary one asked if I preferred male or female practitioners. I was so relieved to have been asked, I answered 'female', thinking this was related to my PTSD claim. In fact, every practitioner was female and I was grateful and can accept it took longer because of this. I just wanted to give you a different perspective. This changed my life and I am grateful to my examiners for taking the time to ask all the questions needed to bring clarity to my particular case.

I went to a C&P exam last month for arthritis (67 y/o 2/75 airborne ranger). The doctor was a pediatrician and he didn’t use a goniometer. VA denied my claim due to "lack of evidence". My VA/PCP, actually got upset when I told him about this and ordered another set of full body xrays. He sent the results to me for additional evidence. I already contacted my attorney, but I am not very please with their responses and am currently looking for another firm that will actually fight for me!

I guess I hit the jackpot both my examiners one a psychologist (mental health)the other a physician assistant (Migraines) listened to my concerns and was straight forward questioning me. It helped that I had a fully developed claim and Lean's professional letters helped my case. I went from 10 percent to a 90 percent disability rating

I recently had a hearing test and for some reason I took the test in her office sitting in a chair rather than in the booth sitting outside her office, the kind of hearing test booth I have always been tested in. She sat behind me as I took the test which seemed weird. She also put these suction type things in my ears that still have my ears feeling somewhat blocked the way you get when on a plane that is descending. Haven't complained but doesn't seem right...

I had one last year and the examiner wasn’t great. When I read their DBQ and report, I saw inaccurate and incomplete information. There were also things noted in the remarks that should have been in a specific section (i.e. DBQ SECTION X was marked “N/A,” but the applicable symptoms of that section were just listed in the remarks section). So I had to appeal the eventual decision because the RO apparently didn’t read the comments. They sent me back a few months ago to the same person (separate exam for a different condition). I would have asked for someone different, but I wanted to give the examiner grief. And I did. They were patient enough to let me vent my frustrations, then showed me why they filled it out the way it did (they couldn’t “diagnose [me]” for “VA purposes” for a condition I am always diagnosed for via an MRI). From there, they were extra explain-y with everything they did during the exam. And they were flat-out explaining they weren’t going to give a positive opinion on Condition X, because they “can’t diagnose” me with those conditions. That made clear that a thorough record review was not accomplished, because I know I had diagnoses, and I know it has been in the VA record for long enough that the examiner should have been able to see it. Well, that and I pulled my records before the exam and wrote down the diagnosis date and name/title of the physician so I’d be prepared for questions. They didn’t have my full record, openly complained about how large my file was, and they didn’t even have my statement in support of claim, which I carefully wrote to include treatment dates, diagnosis date, onset, etc. so they could just go to those pages. Basically, they said “I can’t do a word search.” 🤷🏾‍♂️ Whatever. On the flip side of that, I went to an eye exam with a VES provider and she was-by a mile-the most prepared of any examination I’ve been to. It was clear she reviewed the record before I got there, because she brought up an injury and treatment that I’d completely forgotten about. She looked at all aspects of potential SC, as well as TERA/regional exposure, and even diagnosed me with something that I didn’t know I had. The VA asked only for a TERA exam, but she was sure to identify potential secondary etiology, too (the other person did not do that). So there are some great examiners; but there are some really bad ones.

I received a very mediocre C&P exam when I retired from the army. The exam was conducted by a contracted RN, who took it upon himself to answer questions that he never even asked me. After submitting several appeals and supplemental claims, it took me almost a year to get the rating. I should’ve gotten when I first retired. My advice to anybody early in the process is to make sure you go line by line through the DBQs with your examiner.

I just went to an exam for my feet I filed for aggravation of my existing Pes Planus that I had before I was drafted at that time I had no symptoms when I went to exam I could tell that the NP was new to this and obviously had not looked at my service treatment records I had to tell her what had gone on during my service the exam was maybe 10 minutes all she did was look at my feet and never touched them or manipulated my feet to see where the pain was I have no doubt I will be denied. I live in Northwest Indiana and they continually send me to Illinois for exams mostly 50 plus miles away I find it hard to believe that there is no examiner in Indiana the one exam I had in Indiana was 85 miles away. Your mention of some examiners respect Veterans well my one exam the NP told me how much she respected Veterans and cared about vets and handed me her business and wished me luck and then got me denied saying my severe obstructive sleep apnea was not due to my weight gain due to my service connected hip injury she said it was due to my age sounds like a real stretch.

13 years and still counting. Filed for neck, lumbar and knees in 2011. Had to go to appeal on all despite evidence in medical records. Knees granted in 2012. Case has been to the Board 6 times and the CAVC. My case was reversed and remanded after denial and very specific instructions given to a new evaluator. This month lumbar spine was granted and my first evaluation on my cervical spine was performed. That's also the first time a contract evaluator used a goniometer on me. I've gotten a 6 figure back pay for my lumbar, brothers and sisters. And waiting for the outcome for my cervical. Don't give up. I repeat. Don't give up. Force the VA to do their job.

when i started my VA claim process, my first outta many C&P exams was a mental health. the doctor took me into his office, and then said he'd be right back. i didn't want to sit down because i believe its slightly rude to be sitting when someone walks in the room, so i stood off to the side till he got back. as he came back into the room, he almost bulldozed me over then started yelling at me, asking me why "why are you still standing, that's so weird, who the hell does that". the rest of the interview was down hill from there from him slightly cough-laughing at my answers and the gaslighting me and arguing with me saying I'm contradicting myself.

Where can you turn for help if you believe there was something unethical about how your recent VA claims were decided? What steps should you take if you think the claims examiner will never provide a fair assessment? For me this goes beyond just a simple disagreement with the decision; there is something more serious happening here. A Higher-Level Review (HLR) won't address this underlying issue.
