John Deneen - Not sure what state you live in but it doesn't really matter. Anyone should be able to do research on PROPERTY TAX CODE and its original intent and find the PROPERTY TAX CODE applied to corporations and other legal entities. But, if you look into the PROPERTY TAX CODE you should find "taxpayer defined in the multistate compact because of corporations from other STATES "doing business" "in this state". All of these things are defined in the PROPERTY TAX CODE. So when they say one thing and you assume you know what they are saying, they got you. And the word "person" is used a lot and people assume it means them. No it does not. The annual "ad-valorem" tax they place on the people of the state is being misapplied. And yes, they are going to try to scare anyone who challenges the PROPERTY TAX CODE but if you know it better than they do you can show how fraud takes place by the unknown actors randomly placing people on the tax roll for that purpose. Just remember it is not the STATE because the STATE is an artificial person, but the actor is a natural person whom you can hold accountable. In essence, don't challenge the STATE, challenge the actors misapplication of the PROERTY TAX CODE. Every STATE PROPERTY TAX CODE is similar but most likely rearranged differently. And for those "mom&pop" businesses, if they are not incorporated, are not required to collect sale tax because "sales tax", use tax", and excise tax" are only in the PROPERTY TAX CODE, not the state Constitutions. Some may have it but if it is there, somebody deceived the people to amend their constitution. Read, learn, and understand.

He is right. There is no statute stating that you have to pay taxes. It’s voluntary and people have gone to court and won against the government because they can’t produce the statute because it doesn’t exist.

@bvwalker1--If the Federal government was a party to your economic transactions, e.g., if you were employed by the Federal government, or you were otherwise doing business with it, then you are *required* to pay taxes on such economic transactions. Otherwise, the government wouldn't even know you exist if it weren't for your workplace sending an erroneous Form W-2 into the IRS.

He also has the losthorizons(dot)com website, containing many, many examples of people who have prevailed in their interactions with the IRS, getting *complete* refunds of withheld FICA, Medicare as well as Federal income taxes.

The US Constitution literally grants the Congress the power to raise taxes, that would include having to pay for them, and there is no provision in the US Constitution that states that taxation should be voluntary. You know what had Voluntary Taxation? The US during the Confederation, and we all know how fragile the US under the Articles of Confederation turned out to be.

Neglect to comply with those procedures may entail consequences which the neglecting party must be prepared to face, whether such party be the taxpayer or the Government.”_ *United States v. Lehigh,* 201 F. Supp. 224 - Dist. Court, WD Arkansas (1961). The U.S. Supreme Court concurs: _"...the fact must not be overlooked that we are here concerned with a taxing act, with regard to which the general rule requiring adherence to the letter applies with peculiar strictness."_ *Crooks v. For those of us in the private sector, the IRS *wouldn't even know we exist,* if it weren't for our workplaces and other payers reporting our earnings to it. The Federal income tax is intended for those who received pay and/or benefits in which our Federal government was a party to such economic transactions.

Go to the losthorizons(dot)com website, click on the *search* link, type in "victories," and you'll see many, many examples of private-sector Americans who have *prevailed* in their interactions with the IRS.

There's A Lot More To Taxation Than The Income Tax By Dr. Ron Paul There's a lot more to taxation than the income tax. There are so many hidden taxes that most people don't pay attention to or even think of as taxes. As a matter of fact, the income tax is a lot less important than the hidden taxes. Many people will say: "Well, poor people don't pay income taxes". This is true. However, tariffs are taxes, and they hurt the poor tremendously. When the government "slaps a tariff" on China, they're really slapping the tariff on Americans. After all, it's the American consumer who pays the tariff, not China. So even if you're not paying income taxes, you're paying government's hidden taxes, of which tariffs are just one. The big hidden tax that I've talked about frequently is the "inflation tax". This one is really devious because it's not one that you can directly see or point to: like a tariff. The inflation tax hits the poor and the middle class the most. Of course, the culprit of the inflation tax is the Federal Reserve which prints up dollars for whatever the government wants. If the government wants war, the Fed will print. If the government wants to dole out more welfare, the Fed will print. Every time the Fed does this (and they print by the trillions) they reduce the purchasing power of the dollar. In other words, they pick everyone's pockets without the victims even realizing that they've been robbed! Americans ultimately do realize that something is wrong when they see consumer prices and their bills constantly going higher. But most people (at least at this point) don't make the connection to the Federal Reserve. There are many other excuses that are fabricated by politicians and the media in order to keep attention off the Fed. They don't want the American public to kill the goose that lays the paper dollar egg. Another tax is the "withholding tax" which forces all businesses to be unpaid tax collectors for the government. If a business doesn't withhold taxes from their employees, they're in big trouble and can go to prison for it. Businesses are enslaved to keep the records, collect the taxes for the government, and send it off. Once again, most people pay little attention to this. They don't look at their gross income. They just think: "What's my check going to be?" We're obviously in another presidential election season at the moment. When you go to the various candidate websites, you'll always get the impression that they're not going to raise your taxes. You don't win elections by openly saying that you're going to raise taxes. That's why hidden taxes are so valuable to politicians. They can raise your taxes with their policies while telling you that your tax burden will not be increased! Government also promises FREE stuff. We're definitely seeing a lot of that these days as well. But politicians are merely acting as if they were magicians. While they hand you something with their right hand, they're picking your pocket with their left. There are no free lunches, no matter how much emotion and excitement politicians are able to generate in their campaign speeches. Don't focus squarely on the income tax. It's through the multitude of hidden taxes that the government's really going to get you.

The founding fathers had a poll tax to be charged as government needed it. Government is only supposed to tax according to its needs. Unfortunately, the whole money system is a mess. Currency isn’t money and in our case it’s credit loaned to the corporate United States who made the U.S. citizen responsible for the debt of the dollar. This is a lot to say no doubt but this MIS-UNDERSTANING and mis-categorization of Income Tax into this magic tax that most have come to assume it is NEEDS TO BE CORRECTED !!! The income tax is only an excise tax and all began back in 1913 with the passage of the 16th Amendment. The 16th Amendment is commonly referred to as the Income Tax amendment. Excise Taxes are taxes imposed on certain privileges or activities that fall under Congresses Authority to tax. The right of property and ones own earnings as well are NOT excise taxable things and therefore excise taxes have nothing to do with the average guy, Never did and never could nor does the law say that the average guy living and working in the private sector in any one of the 50 states of the Union is liable to pay an excise tax called income tax on their own domestic US source domestic money. For example, you can avoid paying gasoline taxes by NOT buying gasoline. A gasoline tax is an Excise tax imposed on the Federal and State levels. There are 54 Titles to the US Code (federal law). Title 26 USC is the "Internal Revenue Code" and under there you have "Subtitles A - K". Here's a listing of the Subtitles under Title 26 - Internal Revenue Code...... So you can get a visual. Here's a listing of chapters under Subtitle A - Income Taxes SUBTITLE A " INCOME TAXES" CHAPTER 1 - NORMAL TAXES AND SURTAXES (§§ 1 to 1400Z-2) CHAPTER 2 - TAX ON SELF-EMPLOYMENT INCOME (§§ 1401 to 1403) CHAPTER 2A - UNEARNED INCOME MEDICARE CONTRIBUTION (§ 1411) CHAPTER 3 - WITHHOLDING OF TAX ON NONRESIDENT ALIENS AND FOREIGN CORPORATIONS (§§ 1441 to 1465) CHAPTER 4 - TAXES TO ENFORCE REPORTING ON CERTAIN FOREIGN ACCOUNTS (§§ 1471 to 1474) CHAPTER 5 - REPEALED] (§§ 1491 to 1494) CHAPTER 6 - CONSOLIDATED RETURNS (§§ 1501 to 1564) Under subtitle A, entitled income taxes, chapter 3 starts with Section 1441 and contains not only 1441 but 1442 + 1443 + 1461 AND keep in mind that this is the only section pertaining to withholding agent. There are none others. The title of that chapter is "*withholding of tax on non resident aliens and foreign corporations*" as you can clearly see from the listing above. Now here also direct from the IRS's website in relation to Whom is a withholding agent we find the following (link provided also) "You are a withholding agent if you are a U.S. or foreign person that has control, receipt, custody, disposal, or payment of any item of income of a foreign person that is subject to withholding." And that came from www.irs.gov/individuals/international-taxpayers/withholding-agent Notice also that it's located under international taxpayers... As the income tax is an excise and has nothing to do with the average guy. Again, there is NO OTHER SECTION PERTAINING TO WITHHOLDING AGENT! Very important! And this i just the tip of the iceberg. But, here's more info anyway ..... The Supreme Court has made this point very clear in 1916 only 3 years after the 16th Amendment, commonly referred to as the Income Tax amendment, was ratified. The 16th Amendment confirms that the Income Tax can ONLY be imposed under the category of Indirect. The 16th amendment is a moot point in the scheme of things anyway. All it did was to confirm Congress' taxing power according to the US Supreme court concerning income tax as an indirect tax and nothing else! The 2 US Supreme Court Cases in 1916 that settled this very question are as follows: BRUSHABER v. UNION PACIFIC R. CO., 240 U.S. 1 (1916) AND STANTON v. BALTIC MINING CO, 240 U.S. 103 (1916) The Court said specifically in the Stanton case the following: " it manifestly disregards the fact that by the previous ruling it was settled that the provisions of the 16th Amendment conferred no new power of taxation, but simply prohibited the previous complete and plenary power of income taxation possessed by Congress from the beginning from being taken out of the category of indirect taxation to which it inherently belonged, " So here we can see, beyond ANY shadow of a doubt, that the court confirms that Congress can lay an income tax but ONLY as an indirect tax as it can NOT be imposed directly. And as a side note, most tax professionals do NOT read the law to determine who is liable for the tax. Most tax professionals read IRS publications and just ASSUME anyone who makes money now owes an Income Tax. The most important aspects are glossed over like whom is subject to the tax, whom is liable for the tax (yes, it's different than whom the subject is), under what circumstances domestic US source income becomes taxable. So the who what when where and why are for the most part discarded as important by practically anyone whom works in the tax industry. IRS Publications tell the story a bit different than a tax "professional" would. IRS Publications are sort of like "News Letters" put out by the IRS to the tax industry, including mostly ALL CPA's and Tax "Professionals". The IRS has a manual available on their website which any one can go read. Here's what THEIR OWN manual says about their own publications: 4.10.7.2.8 (01-01-2006) IRS Publications "IRS Publications explain the law in plain language for taxpayers and their advisors. They typically highlight changes in the law, provide examples illustrating Service positions, and include worksheets. Publications are nonbinding on the Service and do not necessarily cover all positions for a given issue. While a good source of general information, publications should not be cited to sustain a position." The IRS has plainly stated in their OWN manual that Publications are NOT to be cited to sustain positions about the LAW even though that is what all tax professionals do anyway. This is because IRS publications and pamphlets are NOT the law. The IRS has already vindicated themselves from people who WRONGLY use publications like law. And again, this is ONLY the tip of the iceberg!!! People need to learn the truth behind the Income Tax. Because this IS the method used to destroy "average Joe American's" wealth.

"The income tax is only an excise tax and all began back in 1913 with the passage of the 16th Amendment. " Wrong. It began in 1861 when the first income tax was enacted. It was amended a few times and its constitutionality was upheld by a unanimous Supreme Court in 1881. The authority to impose an income tax comes from Article I, Section 8, Clause 1 of the Constitution. The only reason the 16th Amendment was necessary was because the Supreme Court held in 1895 that a tax on investment income was a tax on the underlying property producing the income and was therefore a direct tax that had to be apportioned. The 16th simply removed the apportionment requirement for all income taxes. "Excise Taxes are taxes imposed on certain privileges or activities that fall under Congresses Authority to tax." Wrong. Excises reach non-privileged activities as well, such as gifts. Moreover, the Constitution specifies only one thing that Congress can't tax: exports. "nor does the law say that the average guy living and working in the private sector in any one of the 50 states of the Union is liable to pay an excise tax called income tax on their own domestic US source domestic money." Wrong. The law says precisely that. "we have to find to determine who is a withholding agent" Wrong. For the average worker, the requirement to withhold tax on his wages is found in §3402(a)(1). "Withholding agents" aren't the only ones who are required to withhold. "So here we can see, beyond ANY shadow of a doubt, that the court confirms that Congress can lay an income tax but ONLY as an indirect tax as it can NOT be imposed directly. " The Supreme Court has held on numerous occasions that the only direct taxes under the Constitution are capitations and taxes on the mere ownership of property. The income yax is neither; it is an excise on the receipt of income.

@@prof5string hey Mr Wrong... The income tax is an excise. Withholding agents or others that may perform backup withholding are the only ones required to and authorized to withhold. The command under 3402 (f) (2) is the requirement to sign a w4 form which allows for withholding. Go read 3401 (c) which is the definition of employee. And don't forget 7701(c) which is THE definition of "includes and including" And while you are at it, go point out for me others who are required to withhold, UNDER THE LAW! Also, from what u wrote, u clearly have little to no understanding of what the law says... And the 1860s income tax was considered an indirect tax. Also, since u are such a genius, why don't u explain why THE US Supreme Court stated clearly in 1916 in brushaber and again in the Stanton case that the 16th amendment's clarification was to simply class the income tax as an indirect excise and not a type of direct tax not requiring apportionment. Because the 1895 pollack case was in error. The 16th amendment did not grant any new taxing powers. There is NO direct tax without apportionment. According to the brushaber case.... The court states THE following: "But it clearly results that the proposition and the contentions [240 U.S. 1, 12] under it, if acceded to, would cause one provision of the Constitution to destroy another; that is, they would result in bringing the provisions of the Amendment exempting a direct tax from apportionment into irreconcilable conflict with the general requirement that all direct taxes be apportioned. Moreover, the tax authorized by the Amendment, being direct, would not come under the rule of uniformity applicable under the Constitution to other than direct taxes, and thus it would come to pass that the result of the Amendment would be to authorize a particular direct tax not subject either to apportionment or to the rule of geographical uniformity, thus giving power to impose a different tax in one state or states than was levied in another state or states. This result, instead of simplifying the situation and making clear the limitations on the taxing power, which obviously the Amendment must have been intended to accomplish, would create radical and destructive changes in our constitutional system and multiply confusion."

I already did -- IRC §3402(a)(1) requires employers to withhold ("every employer making payment of wages shall deduct and withhold upon such wages a tax..."). I suggest you read it. And please don't tell me you're one of those idiots who thinks that an "employee" doesn't include a private-sector worker. That brain-dead argument has rightfully been called "inane" and "a preposterous reading of the statute". See U.S. v Latham, 754 F.2d 747 (7th Cir. 1985). I agree that the income tax is an excise, but excises aren't confined to taxing privileged activity. The gift tax is an excise, but there's clearly no governmental privilege on making a gift.

@@prof5string u definitely do not understand how definitions work. First off some basic understanding: Ever hear of West Law? They are one of the nation's premier resources for legal professionals. Their books offer what's called "keys" which are succinct statements that West Law has concluded are legally true based on the US Constitution, statutes and court decisions. In their "keys" they have 2 very unique keys. Here are 2 West Law Taxation Keys we find in their volumes addressing taxation (hopefully u are familiar with west law). Taxation Key, West 53: "the legislature cannot name something to be a taxable privilege unless it is first a privilege" Taxation Key, West 933:"The right to receive income or earnings is a right belonging to every person and realization and receipts of income is therefore not a "PRIVILEGE" that can be taxed . " (emphasis mine) Secondly, you absolutely do not understand the definition located under 7701(c) of includes and including. Here's that definition : "(c) Includes and including: The terms “includes” and “including” when used in a definition contained in this title shall not be deemed to exclude other things otherwise within the meaning of the term defined." The definition of includes and including state that anytime u encounter a definition that uses "includes" or "including" that you are encountering a class of enumerated objects. Of which you can't exclude like minded things that would fit into the enumerated class just defined. For example, if congress defined "food" and the definition said "the term food for purposes of this chapter includes apples, pears and oranges" this would then mean you can't exclude things that would fit the general class just defined such as "peaches, pears, papayas, mango, etc....". But you COULDN'T INCLUDE things Ike cheese, steak, eggs, bread, milk, etc... Because even though we call that food too, the definition doesn't allow that context legally. In 1987, in a US Supreme Court decision Meese vs Keene, the court said: "As judges it is our duty to [481 U.S. 465, 485] construe legislation as it is written, not as it might be read by a layman, or as it might be understood by someone who has not even read it." And this too: "It is axiomatic that the statutory definition of the term excludes unstated meanings of that term.“ Which that basically says that when congress has provided a definition, we must use that definitions meaning even if it varies from that terms ordinary meaning. Or in other words, your basic common household dictionary definition of "employee" NO LONGER APPLIES. Now back to the statutory definition of "employee": (c) Employee For purposes of this chapter, the term “employee” includes an officer, employee, or elected official of the United States, a State, or any political subdivision thereof, or the District of Columbia, or any agency or instrumentality of any one or more of the foregoing. The term “employee” also includes an officer of a corporation. Now explain to me how the "average American citizen" fits in this definition. There's ZERO mention of anything even remotely related to "average Joe American citizen". And you CANNOT, under these circumstances include things not listed or within the class of that which has just been enumerated just to fit your own world view of the dictionary definition your are familiar with for the word employee. And the last phrase in the definition "the term employee also includes an officer of a corporation" must be read in light of the previous words in the same said definition. Which could include say an official from Fannie Mae, Freddie Mac, etc... Things that have a federal nexus. Dude, I can keep going and going. But all the income tax is, is nothing more, generally speaking, then a tax imposed on foreign entities whether individuals or corporations with US domestic source income. Thats it. Which also is the nature of an excise tax. Which is why when a "US person" has control, receipt, custody, disposal or payment of any item of income belonging to a foreigner, that US person is the LIABLE party to pay the tax out of the money now due the foreigner. Which is an excise and also most Americans have NOTHING TO DO WITH. The right of a Citizen of one of the several States to "earn a living" cannot be classed as an excise taxable event. The power to tax is the power to destroy. In American Airways v. Wallace the court said: "The terms "excise" tax and "privilege" tax are synonymous, and the two are often used interchangeably. Bank of Commerce v. Senter, 149 Tenn. 569, 260 S.W. 144." The average American is not exercising any privileges when making a living in any one of the 50 States in the private sector. On the contrary, it is an absolute right to do so, of which an" indirect excise" has no bearing. Hence why the law says what it says. Why a "withholding agent" as defined says what it says. You on the other hand are reading things into the law that are just not there, to fit "your own personal view" of what you would like the law to say. One more teaser for you. Treasury decisions are official interpretations of the Law by the US department of the Treasury which also carry the same legal weight as the law does. Go read the following US Treasury decisions: TD 2313, 2382, 2401, 2815, 2988, 6500 And spoiler alert, they have nothing to do with that "average Joe American citizen" in relation to his or her own US domestic source money.

We are collecting them incorrectly. If you read the 16th Amendment, you are supposed to pay all your taxes to your state (not the federal government) and the state pays the federal government on your behalf... Here: "The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration."

You misunderstand the concept of apportionment. It simply means that if a tax has to be apportioned the revenue collected from taxpayers within each state must be in proportion to the state's population. So if State X has 4% of the country's population then X's taxpayers will pay 4% of the revenue from the tax. You also need to know that the reason for the 16th Amendment was to overturn the result in the 1895 Pollock case, in which the Supreme Court held that a tax on investment income (rents, interest, and dividends) was a direct tax that had to be apportioned. Apportionment of such a tax would be politically impossible because it would lead to different tax rates in each state. The amendment says that no income tax need be apportioned.

I am a 67 year old army veteran who along with his wife was thrown into prison and lost everything we had (though it wasn't much) for standing up to the IRS because we knew the IRS collected income taxes from people who didn't owe it. I can't work any more. An old injury makes ageing difficult.

im challenging them right now,i have sent them affidavits requesting they show me the laws where im subject to an income tax, i have even pointed out to them there own codes on what they can and cant do,as well as challenged them the show me where can i find my tax liability within the code, they have refused to respond,and have kept silent,i even spoke with an irs representative got her NAME AND IDENTIFICATION NUMBER,asked her to provide me the law, and pointed her in there own manual where there is no delegated authority for that agency to file a 1040 substitute for return for anyone,that constitute fraud

all affidavits you send them challenging your tax liability and citing law as proof of the unconstitutional nature of it, it builds a paper trail thats admissible in court, and if you have the clerk to serve process and you dont get a response to your questions you can have the clerk to issue a default judgement in your behalf

I communicated with the IRS for 15 years in registered writings. I have a good working knowledge of the tax code. We had a ton of evidence. It don't matter how correct one's knowledge is when the system is totally corrupt and judges assist in helping the prosecution block all exculpatory evidence from the juries. Judge Mary Lisi even instructed the jury that the law was what ever she said it was. Funny thing how they persecute, I mean prosecute people who they admit has no money by appointing lawyers for the defense because the accused is penniless. We were even denied a "Bill of Particulars".

Good luck. We did all that and more. The best we could do was get ourselves put in prison. I went back and forth with the IRS for 15 years to no avail. They will answer all your inquiries with threats and will totally ignore what the law says and even ignore Supreme court mandates. They will save everything you send them then arrest you and use it to make you look like a cook in front of the jury. All your knowledge and efforts will be for nothing. God,.... I hope you beat them. But your going up against a monster that eats patriots for breakfast. Take a look at Erwin Schiff the father of the Tax Freedom movement who recently died in federal prison in his late 80's.

Money is not a treasury Note or a Federal Reserve Note, but money is Article 1 section 10 of the United States Constitution. My question is how in God's Just name can a person pay income taxes or back taxes with a promissory note that is 100% Unconstitutional on its face, and how are these so-called government judiciary offices/courts able to identify an American citizen or individual by their all CAP's Name and Social Security number in order to collect a debt by a debt instrument known as the Federal Reserve Note and why and how has the Supreme Court allowed this?

the government should not collect taxes until the end of the year, not collect it proactively. Employers have been withholding taxes on pay checks since World War II. This system was introduced in the 1940s to raise money for the war effort. Before that time, taxpayers would pay their balance owing the following year, quarterly. Employers deduct income tax, Social Security and Medicare tax.

2 issues Liability and Jurisdiction The IRS is an administrative agency with limited legal collection authority so it resorts to fear and threats with the collusion of the news media and politicians. Most Americans born in one of the 50 states are nationals that fall outside the jurisdiction of the federal government and have no liability for income taxes... the Supreme Court has defined income as corporate profit...Do your own research and decide if you want to give up your rights every year and your property, and pay something you don't owe to the federal Mafia, under duress or fight the fraud of our giant criminal government....it can be done but its not for everyone.
