The plaintiff rented the top stories of a home from the defendant, who claimed the basement was used for storage. The plaintiff claims the defendant and her son lived in the basement without telling them. They’re suing for the difference in rent because they claim the defendant violated the lease. The defendant is countersuing for unpaid rent and damages.

I'm starting to think someone who runs this account heard that their job just ended (yes, the show was canceled a while back, but maybe this SM account was going to keep going) and is doing some Mildly Irritating stuff as retribution. Sad thing is, I have no idea who to complain to since I'd be surprised if anyone's still working on the show now that it's canceled.

Both sides were awarded money. The plaintiff was a little bit ahead because of the utilities. The defendant got $300 for damage. I don't remember how much the plaintiff got

Judge, there is a HUGE difference between renting out a basement with your full knowledge, versus somebody else, a STRANGER, living off your utilities (your money) with no knowledge and no agreement! I think that's the point she's not getting. They were living off their money. Using their utilities without their knowledge or agreement. A stranger! If I was the plaintiff, I would have really pointed that out, because I don't think the judge was understanding the difference. She's acting like it's the exact same thing, and it's not. In one case, you are choosing to rent out the basement (including utilities), and then you are getting that money. So you're actually making money off the rent. In the other case, you have somebody sponging off of you without your knowledge. It's a big difference. HOW could they come to court without proof or the utilities they paid??? ALL the utilities. You are the one going to court; you can subpoena her records.

They plaintiffs did NOT do the exact same thing as the defendant did when they rented out the basement. The difference is that they were not informed that anyone would be living in the house AND use their utilities, while everything was out in the open when they rented it out.

I don’t think the judge was empathetic enough to the plaintiffs. I would be mortified if I thought I was living alone and all of a sudden find out a young male is living in the house with me. It doesn’t matter if they decided to rent it out on their own a year later. They then had control over who they rented it out to. That’s MUCH different then having a secret squatter hiding in your home!

@@lcam9241 Not if youre used to minding your business and know that sometimes houses makes noises, could think that sound's coming from outside; some might even chalk it up to their mind playing tricks on them or that theyre just hearing things bc you have no reason to think someone was living down there, esp if they both worked. Some ppl know how to quiet & unseen. I was staying over my ex-boyfriends home, once. As far I knew, the only other person who lived in the home was his mother. I was 6 months pregnant at the time so I was using the bathroom pretty frequently, I also didnt go out much other than work, which was from 9 to 5. One day, the door to the spare room opens, and an obviously pregnant woman walks out. Turned out, she and his brother had been in there for days while my ex and I were none the wiser. It made me think of what they were doing to keep themselves hidden for so long, esp, bc she was further along than I was. They def didnt shower bc, theyre extremely lazy & disgusting, plus we wouldve noticed if someone else had showered bc his mom was basically lived at her boyfriends. They lived in a small apartment. The spare bedroom was right across from my ex's bedroom. If they can pull that off, then it'd be a cakewalk when u have a whole floor to yourself and nobody expects anyone to be down there.

EXACTLY! I agree 100%. She acted like it was the same thing, when that's a huge difference. In one case, you're choosing to rent out the basement to a person of your choice, with your full knowledge, (including utilities), but you are going to make money off of it. In another case, you have someone living in your house without your knowledge, and that stranger is sponging off of you. It isn't even close to the same thing. What the defendant did was theft. But the plaintiffs were foolish not to bring actual proof of the utilities. I can tell you that I would have never paid the utilities unless I got a copy of the bill. If it's not going to be in my name, I have to get a copy of the bill so I know that I'm paying the utilities, and only the utilities that I've used. Since they foolishly did not insist on that, I would have subpoenaed her utility bills.

@@lcam9241 I agree that was strange, but they did say they thought she was downstairs moving things around. Maybe the guy worked and wasn't there very often. (and she probably told him to be quiet). But I do notice that the defendant did not say they're lying. That makes me think that they are telling the truth.

they ALWAYS conjure up "damages" when they've either spent a deposit or don't want to pay what they're being sued for, and it's always for dumb silly "damages". Gotta hand it to landlords, always predictable.

I regret watching this video, as it ends without resolution, the end is cut off, and I could have simply done anything else, than wind up aggravated and disappointed, this video was a bad experience. I hope that going forward they'll fix the issue, as well as re-upload the complete case.

I don't like the audio only ones, so you are now giving us only 1 episode a day to watch, and even that is now useless!! I know episodes might be running out due to the show ending, but why do you even bother without the verdict?? You include the crap segment from Harvey, but not the verdict!! I am DONE!! I have no idea how she ruled, although I'm guessing she ruled for the defendant, but I just came here to say this: The plaintiffs' problem wasn't that the defendant was down there, it was that they didn't _know_ she was there. They were essentially paying the utilities for two families, when they thought they were only paying for one. It pissed me off when JM kept saying "But now you have no problem with her being there. You had a problem before, but now you don't and you still want money. Okay." It's like "Bitch, we didn't *_know_* she was there before. We thought we were the only people there, but it turned out that that we were paying for the utilities of _two_ families instead of just ours." Then the judge had the nerve to mock them for renting out the basement and using that money to help them pay the rent. I swear, half the time I think these judges either need to go back to law school or just get off the bench entirely. They can't seem to make up their minds what they think, first they say one thing in one case, then say the complete opposite in another. And get mad if you call them on their bullshit. Does she have a show just so she can mock people? She mocked the plaintiff for wanting money, and the plaintiff explained that the housing market is different now. And yet judges just _love_ saying "Cars depreciate in value, so I can only give you what it's worth now." but they throw a fucking bitch-fit if something goes _up_ in value.

I completely agree. Sometimes I feel like the judges have some rough days and just want to end it. The plaintiffs had every right to rent out the basement because the new tenants down there are AWARE. The plaintiffs didn’t now that the old lady and son were dwelling below using utilities etc. that’s a-lot of money, especially if you don’t have access to those parts of the home.

Pretty strange when your landlord invites you to a bbq in your back yard and asks oh by the way do you have a bbq I could use? Why not ask them to bring the hamburger and all the fixings while you are at it. The smirk on the landlord’s face is very telling, she took advantage of the plaintiff’s.

I don’t understand why so many folks think that landlords take advantage of tenants moreso than the inverse. Laws are not friendly to landlords. They don’t let landlords get away with anything outside of what is in a lease agreement. Tenants tend to game the system more

Now I wnt to be Nancy Drew and get to the bottom of this. 1) fall case posts have been dwindling since the cancellation announcement. 2) two days in a row of "full" cases with no verdict or Doug in the hall/Harvey on the street. Theory: someone who runs this account heard that their job just ended (though the show was canceled a while back, maybe this SM account was going to keep going) and is doing these irritating acts as retribution. Problem is, if I want to complain, who do I talk to at Stu Billet productions since I highly doubt anyone's working on this show anymore. They're all in the wind.

I would have left as soon as I found out the son, or her, with sponging off of me (using my utilities). I would have texted her about the situation, and the fact that she was using our utilities without our knowledge or agreement ("You said you were only going to store some things down there, and then I find out you're living there, using our utilities..."). Then, if she would have admitted it, I would have said we're moving out. She breached the agreement by having somebody else living off of their utilities. If I didn't have enough proof to prove that you've reached the agreement, I would have only paid a portion of the utilities (pro-rated based on the number of people in the house), and I would have insisted on seeing the bills I also would not be okay with having utilities in her name and us paying it, unless I saw the bills.

Unfortunately it's not that easy to find an apartment. Ppl think it's magic or something there is no way she would have for a place in a couple of days. She didn't find out until her last lease was up and she was moving in to the new place. I have literally been looking for an apartment for months now. I have good credit my husband has good credit and a successful business and we still can't find anything. Imagine only having a day or 2? This is what I hate about both Judy and jm they really don't seem to understand finding an apartment isn't like going to the grocery store. It takes time.

Who comes to court in shorts and a tank top??? I still say there should be a dress code for court appearances. You don't have to wear a Versace dress or a three-piece suit but, for goodness sake, dress appropriately. The People's Court needs to get with the program and stop posting videos with no verdict. This is ridiculous if they want to keep viewers.
