It's very easy to answer the question "Are you cheating?" when you cheated past tense. The affair happened last year. So unless you ask "did you or have you cheated on me?" the cheater will just simply be like "Nope. I am not [currently] cheating on you. Secondly, if your girlfriend is going back and forth with her about "are you going to tell him?" multiple times isn't something you just brush off. It stays. She's lying!

I feel it was a weird question. It was almost a dead giveaway that it was fishy.

I believe she cheated, it was a spur of the moment thing, it is not an ongoing relationship, and Max will never know the truth about it. She did it and got away with it. The reaction to the question about her marital status was the give away. Edit; IF he had taken the text to HER and asked about it, he could have gotten a face to face look at her reaction and might have gotten to the truth.
