A marital settlement agreement spells out the terms of the divorce and the relationship between the two spouses after the divorce. These agreements usually cover property division, child custody, child plans, debt division, spousal support and any other relevant issues related to the divorce.
While it is not required, filing a marital settlement agreement does have advantages:
Lays out all of the agreements in writing, limiting uncertainty.
The spouses may not have to go to court. The judge might honor the written agreement if it's written correctly and covers all material aspects of the divorce.
Proves to the court that major issues were thought out, and the case will move more quickly though the system.
Marital settlement agreements can be entered into at any time before the final judgment. They are typically filed with the final judgment.
If a spouse is receiving welfare, the District Attorney's office may need to review and sign the marital settlement agreement before it is filed with the court.

Sir humne divorce+settlement ka agreement court me sign Kar diya hai(with 1st installment amount),6mahine ka time diya tha court ne,ab 6mahine poore chuke he,lekin ab wo humpe jo cases he wapis nahi le rahe he,(unhe humpe bharosa nai he ke hum second installment denge case withdraw ke bad)to aise me humne Kya karna chaiye.

Property issue me high court me case dalne ke baad notice kab tak issue hota hai. Property me 4 name hai papa, mummy, bhai, bhabhi ab papa aur mummy nahi rahe mujhe mere papa ne will banake diya hai property ka notarized hai aur mai papa ke ghar me hi rehti hoo ab bhai case karne jaa raha hai pehle settlement ke liye ready tha police me baat bhi ho gayi ab firse dusre advocate se notice bheja hai ghar khali karne ab mujhe kya karna chahiye ? Hello sir.sir agar husband or dever ne 9 month pahle wife k sath marpit ki ho wife woman cell pe call karke police bulva leti hai but padoci k dabav ki vajah se raste se hi police return kar di.9 month se separate room me ek hi ghar me husband rah raha hai wife k hath ka khana pina b band.wife tab se mana rahi hsi Compromised ko 7yr ki beti b hai.abi December me husband ne divorce ka case jhute aligation k sath file kar diya 9 month se recording kar raha hai wife ki uksate the inlows. January ki date thi ese pahle hi wife ne direct mediation me counciling ka latter daal diya but koi result nhi husband ready nhi Compromised ko.abi 19 april ki date hai wife to divorce chahti hi nhi papa bhai na apna koi ghar hai mamy rent pe rahti hai.sir pls advice kare wife kya kare 10 month Chal raha hai ek hi ghar me separate rahte hue.kya judge sahab k samne koi request application de sakte hai apni condition ki.9 year chal rahe hai marriage ko.inlows k kahne pe husband chal rahe hai. Wife to pyaar bhot karti hai emotional fool ban gayi suicide ka man b khayal b aata hai.pls advice

498A mai compromise karna he kyu hai Case jeeto or jeetne ke baad IPC 193, 499, 500 ,or 120B Main return case file karo.

Sir mere husband ne divorce case kiya h, cruelty n mai mentally disturbed hu iska adhar le ke jabki mujhe aisa koi problem nai h, wo mujhe jaan buch ke bhadka ke jhagda karte aur mera recording karte jiska mujhe pata nai chala, sath rahte hue bhi pata nai chala mujhe kab mere khilaaf 2 baar police complaint kiya hai aur likh dete the ki mai koi karwai nai chahta abhi jarurt padne par kaam aa sake aisa likh dete, mujhe dhoke se mayke bhej diye ki ek week me lene aaunga bol ke fir mujhe divorce notice bhej diya, mai apne pati ke sath rahna chahti hu mujhe kya karna chaiye

If your daughter is minor, custody claim can be made... However, you are talking like an orphan, if not, have our own family members/ relatives failed to amicably settle...not clear...Anyway,, if you have already decided to move alone, you have to approach authority for claiming custody of your child...You may contact a local advocate to strategise your move based on facts of your case....., which may include filing police complaint... to ultimately move to court....
