ATO is sending small business like breweries bankrupt for debt offers on 70c on the dollar, the breweries go under and the ATO gets ZERO to 10c on the dollar.. I don't think the ATO is staffed by the countries brightest minds.

Gina makes a minor donation to the ALP, gets $840 million for a company she has shares in - her personal holding value went up $20 million on the share price increase after the announcement... but the ATO are chasing me for debts from 20 years ago... all with the penalties and an interest rate that reminds me of the Keating banana republic years... the fact that I lost all the paperwork in the 2011 floods in QLD means I can't easily reconstruct the ledger... The banks have changed systems in that time, so they can't provide copies of documents... A tax agent can help, to a degree, but ATO are still insistent on recovery... But I'm glad I can support Australia's billionaires - they deserve it all... Maybe I need to employ PWC to help me find a few more deductions... I'll probably end up with a nice fat refund... Funny how corporations that don't vote get all the political attention that actual voters don't... Seems like a bit of a scam...

It's about time the ATO "Deemed" some of these offshored expenses as a tax avoidance rort and incurred tax anyway. If a multinational incurs any expenses, debt or royalties from any group members in a tax haven, it should be completely disregarded. Remember when the ATO "deemed" that self-funded retirees with cash earning no interest should pay tax as though they earnt a certain percentage interest on it? They should do the same with big companies!

It is the definition of treason to sell state secrets to foreign governments. The treason was rewarded by the Labor liberal national coalition thus they support treason. Only in this light can we understand why policy is the way it is and Australia has had the biggest transfer of wealth out of Australia ever. Sickness. Not much option at the ballot box.

Because uder Australian Federal Law "Treason", like all other crimes, has a very specific definition. www.aph.gov.au/Parliamentary_Business/Committees/Joint/Completed_Inquiries/pjcis/securityleg/report/chapter4 The action of PWC and other large tax advisors may represent a breach of some other law but it is not "treason". You can't just make something a crime because you think it should be a crime. That's not who countries with a functioning legal system work.

1. Do that tax return now. 2. Ask Macdonalds for the records. 3 If they don't have the records your bank will have the records. 4 If those records don't exist, the tax office will not have them either.

Umm - the 5-year records retention period is not a blanket rule. CGT records regarding purchase, for example, may need to be kept longer because of the requirement to show the cost of the item. Also, if you have a debt to anyone, the only ways to get rid of the debt is to have the creditor write it off formally (which is not the same as uneconomical to collect) or for the debtor to pay it. A tax debt remains on the books and a future refund can be used to pay or reduce that debt. That said, there is obviously room for improvement. Cracking down on old debt is not a new thing, btw.

@@iffracem"Tax avoidance" (minismising tax in accordance with the law) is completely legal. "Tax evasion" (minimising tax by not complying with the tax laws) is illegal.

Got a tax assessment once. $180,000. Enquired as to details. Told, as it wasn't my bank account, I wasn't able to have the details. For the next 20 years, I paid no tax and structured my affairs. That debt escalated to $480,000. Reckon when I went bankrupt, my unpaid taxes totalled $1.5 million. They never got one red cent.

I don 't believe this story for a second, based on the tiny amount of information you've given. If you got an assessment you had the legal right to lodge an objection and receive a decision with reasons. That decision would have explored the source of the money, which clearly had been assessed to you on the grounds of actual or beneficial ownership. If unsuccessful on objection you had the right to lodge a request for a review at the AAT or appeal to the federal Court. You could also apply for leave to appeal to the High Court. If your debt was mounting you clearly accepted it. On bankruptcy your tax debt was probably the first debt off the rank. Not very impressed by this boast. The term "free-loader" springs to mind.

Hmmm. Again, not really enough info to verify this story. The auditor investigates a person or business to determine if their tax statements are correct and supported by appropriate documentation. The auditor's findings are reviewed by a supervisor, who may accept them reject them in full or part. That may be because more info is needed to support the decision; there are errors in auditor's figures, and so on. Once approved an assessment or amended assessment is raised. That stands as proof of the tax debt and may be challenged on objection. The auditor does not pursue the debt themselves. That is for debt recovery. I assume you mean the supervisor decided that the alleged 48 mil could not be lawfully raised or was not correctly assessed, and hence no assessment could be raised. There is simply not enough info in this anecdote to be certain. @@TheInvoice123

Just after GST was introduced the ATO sent out a memo to their staff to *_"target small businesses because they don't have the resources to fight us"_* and I believe that was a quote from that memo. How many people will have records from 15 years ago? I waited for the 7 year audit period to expire after I closed down my business and I had all my business documentation professionally destroyed. ATO changes or makes up the rules to suit themselves. Remember the ATO supplied Tax Packs that were full of errors but the taxpayer was still libel for fines etc if the error filled Tax Pack caused an incorrect tax return to be lodged. ATO slogan.. *NO care, NO responsibility.*

If I have a rental house in Australia and I'm living overseas, I must file tax returns in Australia and pay tax in Australia on the net rent I receive from my Australian rental house. All Australian sourced income is taxable in Australia - that's the ATO's standard line. So why the hell isn't this the case for Big Corporations ??? It's way past time that the loop holes were closed. Edit: add clarification.

My basic understanding is The ATO own rules states that all records must be retain for SEVEN YEARS that applied to all business big or small along with PAYG tax payers. If this the case then the ATO has shot themselves in the foot as like centrelinks robodebt it is illegal as well.

I reckon its pretty simple, all revenue over $50k PA is taxed at some nominal rate - say 10%, just like PAYG arrangements. Covers everyone and everything on revenue over $50k. No expense write-offs, no other deductions, no GST, no CGT, nothing, just a flat revenue tax on earnings from anything per entity per annum. Work out revenue directly from earnings at the point of sale like we work out GST.

For those who study what drives revolutions there is an enormous amount of wealth inequality and inequality under the law that will be accepted but bullying the weak and shucking up to the rich is certainly a good step down that road, If you work for the ATO you must know what is going on is wrong and it is no excuse to say I was just organising train timetables.

As a member of the Qantas Chairman's lounge, I can confirm that most of my fellow members do not pay tax. Some words of advice, your videos are not going to change anything. But this channel hopefully distracts you from running as an independent politician. Then we would be really concerned.
