Train Simulator 2022: Baldwin AS616 | Pirated Sounds etc.?

I initially made a video of this product and was pleasantly surprised until mere minutes after posting said video It was found out that the sounds for the pack were possibly yeeted from another developer(s), for freeware use only (also without consent) - as well as the grand possibility that sounds, not only for this pack but the Alco RS3's as well (which were removed from their website) were "borrowed" from ESU/Lok sound. Quite a shock considering DW made some decent content as of late which the NA market had been severely lacking.
We'll go over the new sounds for the AS616 as well as recent events which've taken place.

Ya know what? Kudos to them for acknowledging they messed up and attempting to quickly fix it. I'll actually give them the benefit of the doubt when they say they had a "misunderstanding". I hope they're able to bounce back from this.

Such a shame, was waiting for the SP version. Funny though, I reckon there will be a patch come out for this once things blow over. I hope people still support DW, as they should not be punished for what was an honest misunderstanding and mistake.

Shame to hear about this situation and hope that DW can recover their reputation. I liked their G12 (Taiwan version) engine for narrow gauge rail and thought it made a great alt-engine for those S. African routes. Like many of us, I also planning on getting some of the RS3s and this new loco. I guess until they can improve and over come this issue with these reviews. I also do the same thing with Farm Simulator mods, since the same issue comes up with that community too.

Makes me glad I picked this up the day it released. Also grabbed the WM RS-3. I like them a lot, and I absolutely love their steam locomotive side of life as well. I can understand the freeware developers upset that their permission wasn't gotten first, but I find the thing with ESU to be BS. They're fine with people charging to add their sound files to model train decoders. They're fine with other developers charging while using their sound files. NOW they draw the line? I don't buy that. Yes, DW should have contacted any of the freeware developers about using their sound files. Most of the world, including DW, agrees there. But, I also get the misunderstanding part. One must remember, these guys are based south of the 'Murican border, translations don't always chalk up correctly.

I'm a little disappointed over this. I love dieselworkshop's RS3 and was planning to this loco as well but man oh man, using freeware without permission isn't cool. Piracy drove VRC out of business and it's still a problem.

Diesel workshop posted this one minute ago: Sound upgrade for all DW locomotives -- "After the latest release from Diesel Workshop, unfortunately we had a little misunderstanding about some internal and bell sounds of the AS-616 locomotive. At this moment, everything is being resolved privately, that is, no person has forced us to do this. For this reason the section of our store on the site has been temporarily removed, until everything is 100% resolved. All those who purchased the AS-616 will receive a notification in their email with a significant update. Unfortunately, none of the creators/developers from whom we used the files without proper permission, came to directly or indirectly question Diesel Workshop for that reason; We sincerely apologize, and this will never happen again."

A little perspective on the issue would serve the TS community a great deal more than knee jerk reactions. I'm on both sides of the fence on this. I understand the freeware controversy but at the end of the day what is probably going to happen is a very good modeler, a genius at his craft and a much needed kick in the ass for the N. American TS franchise will be driven out of business which will serve no one or at the very least a great model will end up sounding like this. A sad day for all parties concerned and another dagger in the heart of Train Simulator.

@@LP_LP_LP_LP Asking would have gone a long way. True. I don't know how CJRF creates their freeware sounds, but I would wager that before the editing process and file configurations of those files to work in TS, they were probably public domain sound files to begin with. Unless he makes all his sounds with his own synthesizer or actually recorded a working RS in the field, both unlikely. So claiming ownership of what amounts to editing PD files is something that probably wouldn't hold up in court. It's not like DW stole 6 minutes of a Led Zeppelin track. It's sounds for a cartoon train. This is what I mean about perspective.

@@LP_LP_LP_LP Be that as it may or may not be that, the word stole seems a bit of an over reach. Borrowed without asking perhaps. (allegedly) If someone buys the AS now, it will have sounds that wouldn't even pass DTG's muster. And when the sound people can produce a working model of such ambitious detail for TS then I might find myself more concerned. DW should raise their prices (they were too cheap to begin with) and pay off these whiner sound people. Or better yet, raise their prices and hire their own sound guy. DW's models are well worth damn near twice what they been offering. Again asking permission would have been the better way to go, but had it been my sound they used with or without my permission, I would have been honored. Have you ever run one of these locos? They are about as close to exquisite as TS can get. Sound people....modeler wannabe's.

@@daviddryden8088 I have run these locos before and the audio was perhaps my favourite part. Not a surprise it was nicked from a large company who spend time and money recording this audio only for a group of developers to nick it and redistribute it without credit or a piece of the pie. Sadly copyright law does not work in the favour of who you personally want to win

Rather odd claim about piracy. It seems to have been unintentional and has now been corrected. Seems odd that everyone is more than happy for DTG to release sub par products with expectations that others will add mods to fix them for free. I agree they should have spoken with the authors but the error once discovered was corrected. Hopefully someone will produce a mod aka DTG to fix the sounds! A chicken and egg question perhaps. One thing to remember is that if something is released on the internet as freeware, how that is treated in other countries can well be different.

The main thing is the esu/lok sounds, hence the removal of their rs3 - While that certainly is no admission of guilt it's clear something is going on and they're reacting

With respect -- I don't think anyone is happy with DTG releasing subpar anything but its not like any of us are in a position to do anything about it.

Brazilian copyright law doesn't apply to the 567 sound mod. USA copyright law does.

Since I assume US law does not apply in Brazil, everything Diesel Workshop is doing is purely voluntary. Hopefully they can come to an amicable arrangement with the modders.
