Scientists say the NYPD has forced them to alter the results of many tests to favor the prosecution. Steve Oh, Wes Clark Jr., and Malcom Fleschner, hosts of the The Young Turks, break it down. Tell us what you think in the comment section below.
"Scientists Shannon Morris, Melissa Lee and Kevin Rafferty are suing the crime lab that they were fired from at New York State police department. When the two tried to correct errors they saw in the lab, they say they were silenced and others retaliated against them because the errors were working out in their favor to garner more prosecutions.
The department was working to implement a computerized DNA analysis system called TrueAllele which would guarantee results of the tests are correct. But because of pressure from the police to get more convictions, the use of the system was scrapped.
Their attorney John Bailey explained, “there are people that are very pro-prosecution. They were putting pressure on scientists to reach conclusions that were not scientifically valid. That’s what my clients were objecting to.””*

The crime lab should be completely isolated from everyone else (police, prosecution and defense staff). They shouldn't know any information about what the case, the people involved, etc. There should also be a second lab that is isolated from the first lab and both should run their analyses at the same time. This would also help to identify scenarios where evidence is unintentionally contaminated by lab workers.

Two labs would be extremely expensive, but you are correct on the first part. The police should have no knowledge of who works in the lab, as it should be a different entity.

This happens more than the general public knows. I live in a town one-tenth of the size of New York. In the 80's & earlier 90's, we had a crooked medical examiner who would call the DA and ask what he needed the medical evidence to say. He never preformed the autopsies. John Quinones interviewed him & he had body parts in his family refrigerator. It is also not uncommon for DA to hide evidence. DA's are under pressure from media, the public, the Judges and police to get convictions. They forget their duty is to see justice is served not racking up conviction rates. A large portion of exonerations are from exculpatory evidence which DA failed to disclose. But make no mistake the system isn't broken, it works exactly like they want it. When Judges & DA's see themselves on a team against the defense attorney & the defendant, it will never change.

If a cop on the street is happy to lie to get an arrest why would it stop there. The system is corrupt and stacked against the citizen, it has to be to financially support itself. Do not ever expect true justice.

The majority of cops are just people like you or me, trying to do their job, trying to make a salary, trying to build a life for themselves. Unfortunately it is the system of police departments itself which is flawed and churns out bad cops at a high rate.

Reminds me of the L&O episode, Myth of Fingerprints. The point is, we don't really know enough about Fingerprint and DNA analysis to be able to say whether it's accurate or not. Furthermore, we don't really know enough about the people interpreting the tests to say whether they're biased or not.

Agreed. "Scientist" is such a random qualifier. There's no degree required to apply the term, so it could be anything from a CERN engineer to an astrologer who plots the pre-existing data done by astronomers. Any flunky screwing up your prescriptions at the pharmacy can be called a scientist.

Failure to report the unlawful misconduct of another police officer should be a felony. Police accused of criminal acts should be tried by independent State or Federal prosecutors, and investigations handled by the State Police, or FBI...not their own department's internal investigators.

The labs should have the same protection and anonymity as jurors have. They testify the same way as witnesses and are judging part of the crime.

The problem with using a blind testing service is that it would be much more expensive. If you don't know which results to fake, you have to run many more real tests. Also, the defense would gain access to the same facilities as the prosecution (in the rare cases when they can find a way to afford it.) The status quo court system will never allow this to happen.

Reminds me of the Duke Lacrosse case, where DNA evidence showed that none of the lacrosse players had sex with the alleged victim, but the prosecutor asked the crime lab to withhold that information from their report. This allowed the prosecutor to continue with the case, though all the evidence was on the side of the defense.

At every hospital I have worked at, if you are thought to be intoxicated (on anything) and upper management has resonable suspicion, they can ask for the appropriate lab tests to be obtained (blood or urine). Refusal, usually indicates guilt and loss of job. However, when these tests are obtained, they are sent to another lab in a different area of the state (blind testing) names are not used, only security codes. In the last 15 years, I have seen staff members both lose theirs jobs and keep their jobs, I have never seen a guilty staff member keep their job, unless they admitted to having a problem immediately in which case at least one facility I worked at had a policy that would send this person to rehab for X amount of months and let them work day shifts with restrictions. In the case of a police crime lab, I feel as though, at least high profile evidence should be secured and tested at another facility under a security code, not a persons name.

The example of 'the guy chopped the body into 18 pieces and ate the liver' is ridiculous. It is not the nature of most cases. And this seems to be happening more than the one case of this magnitude that occurs every ten years. There is ongoing pressure on multiple cases. Furthermore, if the evidence does not show that suspect is guilty, then faking results willingly lets the real killer go while punishing the wrong person. That is not merely dumb. It is evil.

Sadly this isn't an isolated problem that has happened, the prosecutor, judges and public defense always tends to pressure defendants to take a plea deal or have the lab put the finger on the scales there's even judges and prosecutors that will over charge people or over sentence someone so that they can send them to a private prison because the more people they send and the longer they stay the bigger the kickback they receive

i feel like instead of addressing the million and one actual issues with law enforcement the gov just sets aside about $2billion or so for lawsuits. at this point doing that is probably way cheaper then training them to actually serve and protect properly.

KZfaqrs: Is it at all possible that not everything is a massive conspiracy? As someone that has studied political science (read: how to create a survey) I can tell you that slightly different worded requests yield vastly different answers. Also it is not uncommon to find that management at these types of institutions require a quota (in this case DNA in favor of the prosecution) because they wrongly fear a loss of state funding or state contract if they continually find against the state.
