Күн бұрынThe plaintiff says he rented out space in his garage for the defendant to park his scooter, but he didn’t pay for five months. He then agreed to buy the defendant’s scooter, but it was junk and didn’t work. He’s suing for what he’s owed. The defendant says he paid the plaintiff $100 a month and then put the scooter up for sale. He claims it always worked fine when he had it.

He actually made me hold my breath and leave the room to use my inhaler. He does sound awful and has a lot of extra weight around his middle that can cause some of his problems. I hope he sees a doctor.

People like this operate outside the law and any record keeping (buying from a shady person, not using contracts, paying cash, etc.) because they want a good deal. Then, when things go south, they run to the courts and ask to be saved by the law.

Hyper tension can lead to heart failure could definitely account for the breathing if his lungs are filling with fluid

It's probably his heart. You wouldn't think the heart would affect breathing so much but it can. I just had heart surgery last year and my valve replaced. I couldn't breathe for weeks and I'm only 27 so I thought maybe I had covid. Finally went to the hospital when I couldn't hold my head up anymore and went like blind from heart infection. They wanted to send me home on hospice. The lead cardiac surgeon at a different hospital said he would try to do surgery, only because I was so young and I was transfered. Everyone was shocked I made it. Was intubated for 2 months. Had to learn how to walk again etc. Don't mess around with health problems. Most of the time it's not big deal. But it can be something small and it gets worse because you don't take care of it.

@@reekah21 that's not true, I'm an EMT I work in emergency medical services and ive seen and had patients that sound worse them him walk down steps and to the ambulance with no problem .. people live with CHF everyday .. he's most likely on oxygen at home or when needed, however stress can make it worse .. being in court definitely could have exacerbated it

There should be no case if NOTHING pertinent to the case isn't brought. Judge MM shouldn't have to work so hard for ANY evidence. I'd dismiss one or both sides until that LITTLE amount is done. Then if still nothing....no case in my court 🙄

As a retired technician, I can tell almost certainly that the problem is long term storage with ethanol fuel. The carburetor or fuel system has been damaged by improper storage. No manufacturer’s warranty will cover that. Also a lot of these Chinese scooters come with no warranty at all.

The seller is not obligated to provide them with the warranty. The new owner could call the manufacturer or the dealership and give the VIN and get the damn warranty. The judge can't be all about owner to owner sales being AS IS and then be harping on him to be providing him the warranty like this. She can't have it both ways
