He was not asked questions the police filled the questionnaire and he just signed. The police told the doctor and the magistrate that he has a heart problem because they knew that he can collapse at any time because of the tubing.

How then do you explain the recording made to the magistrate of his confession but was not ordered not to inadmissible as evidence because it would render the trial unfair to him because he wasn't aware that the confession was recorded? Surely it must be detrimental to his case which why the defence opposed its admissibility and the state argued for its admissibility

A critical point indeed. You may need to watch a little bit more of movies ...they may help your attention span...

The state is failing to show that the statements/confessions were made freely and voluntarily. Which is the main purpose of why they are on this trial within a trial. They will argue that the accused cannot be trusted. They are unable to pin the confessions to the accused persons.

About qeustinaer, simple answer is the police had medical reports prior from the mine in Carltonvile. Mogale entered the the dentist office alone. Who knows he gave the Dentist the file n went back to fetch ntanzi n the dentist completed the questionare while ntanzi was outside

4:07:48 "let's proceed" was thinking to himself 'I got him'. Then Ntanzi reminded him that he didn't ask to go see those people. "let's proceed" forgets that the investigating officers are also common in these instances. Him and "iiiiiiiiii-indeed my lord" would do anything to get a conviction.

The state must prove beyond resonble dout that Ntanzi was not coerced to make the confession statement. I'm not taking any side to all parties involved, but I'm curious to know why currently as Witness of the defense, Ntanzi is on stand, Judge Ratha can be mistaken of not present in court, but by the previous occasions whilst the state witnesses were on stand, in more than I can tell, witness were guided and protected by constant interjections by Ratha, for fairness respect maybe judge is tired or came to procedural introspection.
