Your South African law is from English law for the reason known to everyone. According to English law, hearsay can be accepted if it is coming from a traceable person. If the person has an address and can be contacted, it is enough for the court to accept that hearsay.

When asked about forced entry into the house, Zandile said the 4 gentlemen didn't lock the butler when they first came into the house earlier. Yet, yesterday she testified that she was clearing the house of cans everytime people finished drinking, and threw the cans in the dustbin outside the house each time. Msholo should have started by asking Zandile if she was locking the door and butler each time she went to throw the cans away. Most likely, Zandile would have said "Yes".

It looks like it’s already time for the defense to ask this judge to recuse himself from this case because he is so partial and he can’t even hide. His actions and behavior shows that he has already made his judgement. The defense doesn’t need to prove anything in this case, the prosecution is the one that carries that burden to. But he is acting more like a defense lawyer for the witness.
