What? I'm still trying to figure out how Soda thinks a twitch stream isn't fair use. I suppose if the NFL streamed on twitch we probably wouldn't be allowed to react to those easily. Maybe Soda is big braining us but I won't believe it until I see it

@@martin14madsen yeah, since then I've been looking at fair use and everything is so biased. On paper I think Soda is right and I didn't want to doubt him because he's been doing it for so long. My biggest question was how is he going to enforce it and while looking through comments, youtube videos, and twitch TOS he does have a leg to stand on

I mean the raid will only be viewable from a raid member's perspective. So anyone streaming it that isn't in the raid will have to be using a raid member's footage, which belongs solely to that raid member. So Soda can absolutely DMCA anyone using that footage without permission.

There are multiple factors that can determine if a court would apply fair use to it assuming it even went that far and adding commentary is just 1 of those factors.

There are multiple factors that a court would need to take into consideration and just becouse u check 1 of them dosent automaticly make it fair use as mutch as ppl would like to think it does. The reson why very few have even got to court is becouse its simply not worth the trouble even if u know u are 100% right and even if u win your not gonna make the money back from what u spend on your legal costs. To many youtubers a reaction is seen as a free advertisment. Not everyone think that ofc but most do and if most ppl dident think that there would be ALOT more claims on videos then there actually is and reaction style content would not be as popular as it is today.

​@@JasperJHNS Even if that is true Twitch cant simply remove footage unless the owner files a DMCA complaint on the stream vod. ppl can say they dont allow ppl to restream there streams all they want, Twitch cant do anything until an official complaint is filed. Just saying they wont allow anyone to do it on a stream dosent mean anything if they dont send in a complaint on the video itself. If Twitch does start to remove streams without a proper request asking for it they could lose there safe harbor protection that protects Twitch from getting sued if streamers stream copyrighted material like full movies or TV shows.

Fair use does not apply to re-streaming a live copyrighted event. You can't just go and steal the live NFL footage for your KZfaq channel, even if you are reacting, best you can do is audio commentary with no video, or highlights WITH commentary and analysis afterwards.

People have been seeing clip channels so much they think it's 'okay' when in reality every clip channel could be struck down immediately and court won't bother. Fair Use is only for adding actual context to the video that is seen as transformative, in other words you have to make it your own video. Fair use sure, i think soda misspoke tbf about DMCA. It falls under twitch guideline/tos. Can't restream without permission or cant stream if the streamer says you are not allowed (i dont remember with way it is). Kick is a problem tbh. They will not do shit. So maybe you can use DMCA logic there somehow, i dunno.

@@julose2678 it's in the twitch rules but it's not in the law. if they restream it on youtube or kick they can't do anything about it because it is fair use. the reason twitch is different is because their policy has special rules in place. The reason you can't restream live NFL footage has nothing to do with fair use, but instead broadcasting rights. Streaming another person's stream is different than streaming a company's stream, which is sad but thats the law. Individual streamers have far less "ownership" than copyrighted broadcasts owned by corporations.

@@davidsantiago7808 its not im sorry, streaming someone else's stream is literally the same as streaming someone else's youtube video. that's why if you are a clip channel you have to have the streamers permission or they can take your videos down easily. And streaming someone else's stream is the same thing. Like use logic for once are you telling me I can create a youtube channel and just stream sodapoppins stream the entire time? ofcourse not, and multiple people would be doing that. A stream is literally the same thing as a video for copyright, you can not just stream it or create videos of it. unless it is transformative.

Unless I missed extra context, I'm pretty sure he never once cited DMCA, takedowns, fair use, etc. He literally just stated he will say "no" to people outside thr raid reacting. The law isn't everything. Publicallly going against his request is a bad look and can get you "blacklisted" within the streaming community.

Unless i misunderstand things he's got a point about the fair use. I'm not really sure what grounds you'd have to dmca a reactor watching your wow stream. I may be wrong but I'm guessing it won't work and maybe requesting and giving your reason why would have had a better result. But i guess we'll see. I also see comments below saying soda didn't threaten a dmca he just said "no" so may not be at all relevant anyways. I am curious now though, so if anyone knows if you COULD dmca something like this i'd appreciate you letting me know.

Legally no, but it would be a community guideline violation, so Twitch could act on that and remove the restreamed content. This could be done by all streamers that stream the raid, so its not like there are no repercussions (in theory). But I am aware how unreliable Twitch is with their guideline violations. DMCA does not apply here, but I guess for a content creator IPR, copyright, and community guidelines all blurs into a single thing.

@@davidsantiago7808 Sure, but you're missing the point, I think. Preventing ANY kind of restreaming is impossible and Soda is not really trying to do that (IMO). He is talking about the other big Twitch streamers that did not participate and might "leach" off of their work. The Quartering is not among the people he is talking about. He can't do much regarding Kick, as they don't give a fuck anyway. I am not sure how KZfaq works, but if the restream is transformative enough, then he can't do much either. He knows this, I mean he does this shit for a few years now. What he is trying to say is that there are consequences for restreaming their raids. I would imagine that Soda would think twice about to working together with people that ignore his request in the future. Just because you cannot prevent a restream from happening, does not mean that there are no professional consequences for the people that ignore his request. Networking if fucking important in the streamer sphere after all.

@@davidsantiago7808 Okay, let me try to explain what I think his thought process is. Soda is a professional content creator. He has been for a long time, one of the OG's if you will and the has the pull/cloud to match that. What is the #1 rule for CC's? You DO NOT copyright strike (or what ever you wanna call it) another CC. You just don't. If he is willing to kick that rule into the bin, that should tell you how serious he is taking this. Restreaming their raids will have consequences for whoever ignores his request. You have to understand that he is part of OTK, who are a big part of the core of the Austin streamer scene. If you make yourself a persona non grata there, you have made a lot of enemies in one of the two big CC networks. This is a huge risk to your career. It does not matter if he can or cannot prevent all restreams. The fallout from restreaming the raid might be worse than a community guideline strike. Much worse.

God TheQuartering is such an annoying guy. What Soda is doing is completely under Fair Use. He's stating that if you want to watch it live and stream it, then just ask but if you don't he will DMCA you. He set a clear rule and it's pretty god damn simple to follow. You can't get away with re-streaming sporting events or live television without the channel/organizations permission so what makes him think re-streaming a live content creator who laid out a simple rule isn't following Fair use?

I don't think he can enforce any sort of restream policy for other content creators perspectives, sure he can control restreaming of his stream, but not others. And if they don't agree with his restream take, sure he can bench them, but then that overlooks what is that players in game progress and work over an arbitrary gatekeeping mentality because you feel bad for other guildies despite anyone trying to engage in endgame content probably knowing that raid groups have limits? Maybe, just maybe, they can all form another raid team. But its not about the hardcore experience its about milking it.

I kinda doubt that anyone in the guild would really go against this decision, though. After all, Soda is doing this entirely to support the smaller and less lucky streamers who have nonetheless been contributing to the guild, its events, and its community, but won't be getting much out of it come raidtime (at first, at least). It comes off as gatekeeping, but it's actually a rather altruistic sentiment, imo, and I can totally see the rest of the guild wanting to help their benchies vs. letting all of the views get gobbled up by giant variety streamers who have nothing to do with anything. Soda's also already explained why there isn't a going to be a "second" raid team. It's because in his (and many of the other WoW streamers/player's) experience, "off teams" generally just don't *do* as well in general - they don't have the same kind of focus, attention, and energy going into them, and they also do much worse in viewer engagement. In hardcore, all of that is a recipe to wipe away a lot of people's really hard work with very little payoff for them (or anybody, really), which would really be a downer. Especially, again, for the smaller streamers involved, who really deserve to get their moment of glory. Realistically, a lot of OnlyFangs sucks. There are gonna be deaths, and disasters, and most benches are prolly gonna end up hopping in *eventually*. It's less about Soda "milking it", and more about him being fair to everyone, and having respect for the fact that this is literally their livelihood.

Why are you spamming comments here? Who cares about "fair use", did you even watch the video? All his points are reasonable, it's not about the law. It's about the fact that it's a streamer guild and the ravenous react-vultures will swoop in and dilute the views away from the streamers in the guild who have to sacrifice their time to be sitting around as backup players. It's more about morality than law, the law can shove itself right where the sun doesn't shine. This is not even slightly, even remotely about the law. This is about the morality of it, and it's a very noble gesture by Sodappopin that shows a deep set respect to his guildies. Any other take on this is just nonsense drama farming.

It is fair use but under twitch guidelines it is against their guidelines, if hes restreaming it on youtube or like kick or something either than twitch then yeah he cant do much, the guideline was created to stop people from restreaming other streams content without consent. So yes, Quartering is right it is fair use outside of twitch but soda is right that he can do it within Twitch itself. Overall he doesnt care he just doesnt people like Asmon who said they would join the guild but not join leech content off them sicne the guild was created as a content guild, if they joined the guild and arent part of the raid group he doesnt really care.

Well... Kick is a problem, but if you are streamer on twitch, and stream someone else's TWITCH stream on TWITCH and they say you can't do that, and you still continue to do that. That is bannable offense on twitch and can get you banned. And this invloves big streamers, so they 100% gonna catch a ban. But like I said, Kick is problem, hard to DMCA or do anythign against that. Soda used word DMCA; but i think that is little bit wrong term to use. Twitch guidelines is the key word here. Now someone else might ask, why people can react to other people's vods and clips. That actually does not fall under the guidelines. Vods i think you can argue, but clips are free use all the way on twitch. But even there is rabbit whole, if you watch someone's twitch vod that is uploaded to youtube and watch that, that is 100% free use also. So you right and wrong. HE CAN, but not with DMCA. DMCA is more if they upload to their reacting content to youtube or other paltforms.

Agreed, i am not a twitch streamer but I am seen a few arguments that are their TOS that say they can't just watch other streamers.
