Great presentation Ma'am . Trying to get a straight answer from VA on this subject is like trying to herd cats. I asked them "When my COPD goes to 100% and I already have another condition rated at 60%, and others at 30% and I have been deemed PTD permanently totally disabled, will I qualify for SMC?" They get real huff, "SIR WE DO NOT MAKE DECISIONS OVER THE PHONE." I tried to be calm with them, good luck.. So my question is " I will soon have a 100% rating for COPD (on 02 24/7) and other rating of 60%, will the qualification be automatic? Or do I have to file for the SMC?"

Thank you Thank you for being here. We have needed your knowledge in all the different medical conditions that my Hubby has. We need you help. He is 100% but he doesn't get the income that a neighbor that gets 60% gets. I do not mean we are greedy but we dont have a vehicle that can take him to appt. He never never leaves the home. He. I am needing help.

I would contact a VA social worker for resources. Also, reach out to a VSO (Veteran Service Organization) such as the DAV (Disabled American Veteran), American Legion, etc. They can guide you & help you file paperwork for free. In addition, does your husband get Medicaid or Medicare? I believe the provide medical transportation for free. Contact your nearest Department of Social Services.

I hurt my hand by trauma in November 2017. It is my dominant hand. I pay someone to clean for me as I can’t. From the first time I walked into the ER I was misdiagnosed. To make a long story short, and show how long it took them to diagnose. My first surgery didn’t happen until January 2019 and my 2nd surgery to correct the first one was feb 2020. I filed a torte claim and wondered if I did the right thing. I can’t use 2 of my fingers 1 is deformed and chronic pain. I will never be able to play the piano again. Did I do the right thing???? I can use my thumb and pointer. Thank you for sharing ladies🙏 I get 70% with 100% unemployability I don’t understand the difference. You ladies are the bomb. Should I hire a lawyer????

Excellent explanations. I tried to go from 90% to UI. I ended getting 100%, and it ended up as SMC S. I didn't try for the 100% or SMC. The mental health doctor recommended me for this. During my conversation with the doctor I told him I rarely leave my house because I don't feel comfortable out in the public. This is the truth, but I didn't expect to get a higher rating or SMC out of it.

I have a question about this. So I am 100% disabled as far as benefits go, but not the pay, but I'm SMC S? It's easier to explain to people that I'm 100% disabled. Trying to explain to people that I am SMC S gets tricky.

I'm getting SMC L, but was in increased to SMC P. I can not find anything about SMC P, but I saw on a forum that is concerned to be a 1/2 step in the process. Is this correct? I'm in the process of SMC T claim; I have two SMC O's and at a 94 for my third O. This is my understanding that I have to get three O's to reach SMC T. Is this correct as well?

Hi, I am rated at 100% p&t for PTSD and receive smc k, I also have two other conditions rated at 10% each. I was denied secondary sleep apnea eventhough I have a nexus letter from va. Should I appeal because 50% would bring to the amount for smc a but do the 10% Need to be related to the 50% sleep apnea. I don't want to waist time and money for a new nexus if I won't qualify. Thanks

I had knee replacement surgery and given temporary SMC For housebound for a year . Since then I was rated 100% permanent due my hands that bump me up from 90 to 100 . Currently I am still in rehabilitation for my knee and Now i don’t have total use of my hands . The decision later didn’t award me SMC . What can I do .

Currently in wheelchair basically home bound from both physical and mental disorders . Along with 100%, I'm getting SMC-k with loss of use of body part (Ed). Thank you for the great information you answered some of my questions I do have TB I and have started experiencing Non epileptic's seizures and/or minor strokes they thought word due to some of the medications they had me on when I changed VA hospitals because I had to move Where I had around-the-clock care It has been nothing but a fight with the VA I do receive the $3104 for the 90% and the permanent total unemployability The VA has not altered my payment automatically what do I need to do to see if I qualify I do have some of the other Disability you listed I am not blind but my eyes are very light center to I have short term memory loss or confusion And as I'm sure you all know dealing with the VA is a fight And my physical condition has gone to the point where it is hard for me to continue fighting with them

Great video and information! I have just been awarded SMC-L for aid and attendance(using my 100% P & T rating). The VA did not bump it up using the remaining 320% of VA rated disabilities. Should I send a VA-21-4138 and ask for an audit or do a supplemental claim and attach the calculations I did on an excel spreadsheet? Thanks 🙏

I'm a vet, either tinnitus. It is getting worse. When I mis that with sleep apnea. Acid reflux, two failed surgeries, arthritis on spine back hands, feet, prostate leading to out 9f control urinating, which makes sleep difficult, depression, losing several friends and family. Losing my commercial pilot and drivers lic. From sleep apnea, cant work. Tinnitus combined with these other things. 3ould I be on line for 100%

Can a veteran recieving housebound (SMC(S)) also be qualified for another SMC and or stackable SMC?, say extra disabilities add up to that 60 percent aside from the 100 from one disability?? Thank you for this great information. I noticed that the additional amount for TDIU with a spouse and SMC-S with a spouse is the same amount. Would a married Veteran receive the spouse benefit for TDIU and for SMC-S, or is the spouse benefit only applied once?

I was just approved for SMC-S (100% + 60%)...the answer to my question is that the Spouse Benefit is only applied to Rated Compensation, not to SMC-S. Thank you.

I'm VN vet rated 100% pro for congested hrt failure. Rec filed new claim for Parkinsons. Also have COPD & sleep apnea. Add to that mess, RA presents mainly in my left wrist, which allows me little use of my left hand. My wife (GOD LOVE HER) is left to do every thing. I don't leave the house much. What do you think I would qualify for and how do I get things started. That 2nd claim is 10 months old. Did a video tet to tet with VA Dr who commented, "we know you have Parkinsons", from my filings. ???

I recieve SMC(L) Aid and Attendance. You wil need to have a caregiver. Look at VA Form 21-2680 and go from there to see if you are in need of this benefit. I have a 24/7 live-in caregiver. I'm in real bad shape. I went from SMC(S) in 2017 to SMC(L) in 2019. Your doctor is supposed to fill out this VA form for you on your visit to her or him.

I was in the US Army, 19 Delta Cavscout June-October 2001. I got hurt, but the injury healed a month later, but they did also get me for respiratory problems which is listed as preexisting condition, a MED-200 discharge. You can only get benefits from VA if you got a MED-40 or were in the military for at least 2 years! So basically if you don't fulfill your Commitment they give you nothing. Sucks.

@@RedEmpire36 I did 4 years I had 2 months left in the Army was struck with an ax over the head . I spent 6 weeks in the Hospital they cleared me assigned a driver to drive me home was never given a Medical discharge and had to go through the VA to obtain 100 % took 15 years. Do you think a lawyer would take my case in getting awarded a Military discharge? Every time I talk to one they want like 5 grand and I’m not handing 5 grand to anyone not knowing the outcome. This happened in 1989 so I see lots of back pay and should be token on contingency

@@LLJR the way I have seen it around here is like you said take it on contingency and then either 10% or often a year of what the backpay amount is, all depends on the lawyer. I wouldn't pay out of pocket personally but it is harder and harder to find one for your purpose. Also retroactive medical discharges with pay at only 4 years time in service are very hard to come by.

Hello! VA should automatically give you Special Monthly Compensation if you qualify for it. You do not have to apply. I'm 100% pt for PTSD and am receiving SMC for 6 other service connected disabilities. One of the 6 is rated at 50% disabled and the others are in increments of 20%, 20% and 2 of 10%. 1 is 0%. Obviously that totals up to more then 60%, but that's the percentage I get because the VA combined all of the 6 to come up with the 60% rating for SMC. I don't know if I should have this looked into if it's wrong or right, but my question is, if I get new disabilities like ED does that get me another SMC for loss of organ?

Simple question. If I filed a V. A. Claim for PTSD (combat-related to Vietnam service) and my claim is denied will I pay your firm a one time fee for representing me based on a monthly payment amount or will I have to have continue to pay you a percentage of my monthly benefit checks? @usmcretired2112, generally speaking, VA should automatically give you Special Monthly Compensation if you qualify for it. You do not have to apply. If, however, you believe you qualify for SMC but are not receiving it, you can call your VA regional office or contact an attorney.

@kenndeaux317, SMC under Level S is given instead of being compensated at the 100-percent rate, not in addition to that type of compensation. You can, however, receive both Level S compensation and Level K (loss or loss of use) compensation if you qualify for both. Interesting... I retired in 1997 with a 20% disability and now, I have a 60% Disability for other areas of my body for knees, lower lumbar, tinnitus, and shoulder but have a 0% for a loss of a reproductive organ while on active duty in 1981, but have never been compensated for such a loss or have received SMC of any level. I did 20 years of active duty. Please advice, and Thank you in advance.

You need to be at 100%… With all of your issues does any of that affect you mentally? Do you have any anxiety? Look at the mental health scale... Do you exhibit any of those symptoms…? Keep in mind the hallucinations is also feeling something that may not necessarily be there… Make sure you look up the definitions for the symptoms as well sometimes we experience things but do not realize that we actually qualify

Hell,I was rated 100% P&T back in 2010. Then I got an additional 60% rating in 2017. Does this qualify me for SMC "S" statutory house bound?

You can get SMC-S if you are 100% for one disability by itself and 60% or more for additional disabilities, with no need to be housebound or in need of care.

SMC is supposed to be rated with all claims! It is automatic with certain disability or diseases! Like diabetes, and often times medications can cause ED, that would be the loss of use of a sexual organ!

Hi 3 year’s ago I had my prostate removed do to prostate cancer.I have tried all medications and still have ED.Can I file a claim for SMC .l have had a 100% disabled status for over 10 years.So having lost a reproduction organ and the use of a connected body part an i eligible to file a claim?I served in Vietnam in 1969 with the 101st airborne infantry and was exposed to agent orange.I have filled once and they have denied my claim saying it was not service connective.How can I fight this.

Appeal the claim you filled. The A always denies the first claim. They are crooked, and this is one of the schemes they pull.

My husband has alzheimers and parkinsons at Advanced stage. He was rated as P1 for A&A and SMC. He has lost movement from his torso down he is totally rigid. He has to be repositioned every 2 hours and is homebound. He cannot move his buttocks, When I requested a high level review they agreed that there was a failure to assist error but no increase in his benefits. He had double exposure with AO and toxic water. I have appealed to board of appeals but docket has not bee, assigned.

My husband is a Vietnam Vet 75 and was exposed to agent orange. He is in hospice care for alzheimers (2009) Involuntary movements (2021) and Parkinsonism (2023). Because he is in more need for nursing care at home (he is total care bed bound for the last 2 1/2 years) we have requested to expedite his claim and submitted requested documents from hospice. Is a very frustrating process. I need help.

Hello, I am currently 100% IUTotal and Permanent service connected with my Lower Back condition and I am 70% with somatic symptoms with depressive dormandent chronic pain secondary to my service connected condition. Now can I file a reconcileraton on my 70% service connected because I have new evidence on my claim. So if I get a total of 100% will I then qualify for SMC

File a supplementary claim on that with new evidence. If don't a favorable decision file an appeal and use an appeal lawyer for it probably to get your benefits on track and more

Hello. I have a question. I am at 100% P&T with SMC(L) Aid and Attendance. I receive Higher Level of Care from my caregiver by direction of my doctor. For the HLofC SMC(R-2) would I need to be in receipt of another SMC to get to for example to SMC(O) then to R-1, then to R-2 or could I go directly and file for R-2 HLofC? Thank you.

You have smc-L for aid and attendance. You will need another smc-L-N for a separate condition to qualify for Smc-O then you will get SMC-R1

@@livininmexico3811my current rating is SMC-P2. I have a single disability at 100% which meets the criteria for aid and attendance and still was denied. Whoever rated my claim for aid and attendance claim was clueless. According to the M-21 if a claimant have a single disability at 100% considered it for aid and attendance .

To everyone you will get SMC S and as your conditions worsen your SMC levels will increase. You will be starwith housebound first. TBI is one that will go up passing the rest level R-2 level. Ibhad to submit for SMC and they started me with SMC level S. Now I'm seek a higher level for mental health snd head trauma that is service related. 10:13

@@laverlemartin6922 I could not say, I have what is needed or required to receive SMC(R-t). The Ca Veteran service Rep. told others that medial evidence was not meet requirements. Every Dr. gave me approval on Aide Attendant, Even my eye Dr. I have a hearing 29 January hopefully it all works?
