It is good that our judicial system has now embarrassed ADR. As wonderfully articulated by Madam Deputy Register. This will go a long way in reducing case backlog in courts. However; it is not fair that as we implement ADR we tend to ignore the system that has been doing ADR and solving many cases ever since independence - Natilional Government Administration especially chiefs. It is a fact that in Kenya, for every 1 case that go to court, chiefs will have successfully and amicably solved 100 plus. They are doing all this without relevant training. What if chiefs were all trained and accredited by the judiciary so that they and the court system became one seamless dispute resolution system. Sadly, during this interview, the interviewers were visibly and purposely stirring the conversation away from the role of chiefs even after Madam Kendakor brought it up several times. Every time she did so they stopped her and directed to conversation elsewhere. That made them appear biased against chiefs.

I'm a Certified Professional Mediator (CPM) and accredited by the Mediation Accreditation Committee of the Kenya Judiciary. There needs to be education on ADR since we still believe that a judge is the only one who can make a final decision on a matter. However, conflicts can be resolved without recourse to even the legal system as long as the actors understand what their conflict is all about. Hon Caroline Kendagor advances this education pretty well

Good interview...But MDR Caroline was abit biased and disingenuous with her answer/remark that ppl with legal profession background are the best suited to be mediators. Actually the mediation training emphasizes on counseling skills. Its common knowledge that some attorneys and magistrates dont like psychologist's and counsellor's becoming mediators, according to some they are, [to use their term] "encroaching" on their territory, by wanting to become mediators. Counselors going for MAC interview to become mediators face alot of bias from the interviewers.... They have found a brilliant way of discouraging them by placing a six month mentorship program before one can be accredited... This is a slap in the face for highly trained professionals who have been helping people navigate far more complex issues... Mediation doesn't not require a strong grasp of the law... Since one can research the law if they felt compelled to do so. Mediation is about understanding ppl and their issues and helping them navigate those....
