But when it happens you need to be prepared. the WORST Case scenario is a traditional eviction. but you have a couple slick moves to avoid evictions and get back to hosting. At this point Airbnb renters need credit checks as well, it's become ridiculous that squatters have any kind of rights.

Totally different context, but I want to share my story here: I'm a real estate agent and had a client that is an investor. He told me that he was ready to sell one of his properties that was a duplex but his current tenant had removed the separation and was occupying both units. I had to go talk to the tenant and inform him that the home was going on the market and ask him to be courteous to the interested parties for showings etc. This is not a normal duty for a real estate agent, but in order to get the right to list the property I volunteered to this. Upon entering the property I became aware that the tenant was a hoarder. There were stacks piled to the ceiling in some areas and he had a room dedicated to his trash bags. I felt compassion and offered to help take the trash away for him. After removing the trash I asked him where he was planning on moving too. He described multiple options that he had so I wasn't too worried. 2 weeks later the home was under contract and the buyer intended to occupy the unit. This meant that we had to remove the tenant. I went and delivered his 30 days notice to vacate. What ensued was nothing short of a mental breakdown. He cursed his landlord for selling, he cursed the buyer's for wanting to buy, he cursed me for delivering the news! Suddenly it became my problem to find him a new place to live and to get him moved. He began to see it as my problem to get him to go. He began to scream at me and yell at me. Then he opened a bottle of prescription pills and put the entire container in his mouth. I got him to spit them out, and he seemed to calm down for a minute, but what I didn't see was that he had grabbed a knife from the counter. When he lunged at me and tried to stab me is when I knew there was nothing left for me to stay for. He later called me to apologize and I just explained to him again that I was trying to help, not make things worse. He ended up living out of his car for a month or so before finding a place to live. The moral of this story: If you are dealing with a squatter, there is a likelihood of the person suffering from mental illness. Even if there is no mental illness, you should understand that wether they can acknowledge it or not, they are feeling extremely desperate. When humans are desperate their moral compass often gets set aside for survival mode. My best advice is to not allow yourself to be put in harms way by trying to help. Leave a paper trail for everything you are doing so that you can provide it if you ever need to defend yourself in court.

You likely made a situation a bit more bearable for a person with mental health issues (even though the man did not realize it and cursed you). Professiionally unpleasant, file it under paying it forward and working on good karma.

@@michelesimone6752 that’s where you rent peoples personal vehicles and you don’t bring them back. It’s just a platform where people can put their Cars for rent. It’s Airbnb for cars.

The following works for regular landlord/tenant eviction disputes AND squatters. 1: Go to the house and remove all of the entry doors so you can, lol, "weather proof" them. 2: Load them in to your vehicle so you can take them to your shop for the needed modifications. 3: Leave and don't bring them back (due to equipment failure at your shop, if anybody asks). Depending on the season and the local bug population, they'll get out pretty quick. They can't file any complaints because they have ZERO legal standing for being on the property in the first place. As the property owner, you always have the right to do property upgrades, but "tenants under eviction orders" or "squatters" are NOT allowed to do any modifications, so any form of complaint will just be ignored. A friend of mine uses this method to evict nuisance tenants instead of the courts. It's a lot faster and as a bonus, the people on the property are so happy that they'll soon have new weather proofing (lol) that you'll usually get no beef while you are extracting the doors and windows from their frames. LMFAO!!!

@PRO-LINKS. I'm not "challenging" your recommendation per se', but simply wondering in what state you've deployed this "eviction technique?" Wouldn't you (or your property manager, or security) then have to watch the property like a hawk? Let's say the technique works & the squatters leave (within a few days)... Are you not then making it easy & vulnerable for subjects to potentially steal appliances, furniture, etc. from the property (or to commit vandalism)?

Why can't you squat on the squatters? Have a rental agreement signed by the owner. Wait until the squatter leaves the property. Get into the property and sit down on the couch with the rental agreement in your possession. When the squatter returns. Refuse to leave.

Why aren't there laws to protect home owners from squatters? Home owners lose their homes if they don't pay so why do squatters have any rights at all?

My community has a Hosting Club and in May 2021, we featured a local host who has a separate guest house in the Arts District of Long Beach. She described her experience of a daughter booking for her parents (third party booking - first mistake). They overstayed their 3 month stay and due to a moratorium on evictions due to COVID it took her about a year to get them removed. (They knew how to play it and planned it from the beginning) I suggested on the day they were supposed to check out to a) bring a cleaning crew of 5 in there to remove their personal items and clean the unit around them and b) bring about 5 linebacker looking guys to squat in the unit with them. I like your idea of removing all the furniture. This is an added expense but most likely brings the squatting to a close quickly.

Yes! Love this idea! Stay in bathroom for long time…. In fact my “our squatter” they lay down on the ground with a sleeping bag, in the bathroom (I would pay them extra $$$)…. Block toilet, ( access to) fake nausea and vomiting 🤮. Also, Then a very high spirited noise cleaning crew! That’s moving furniture at the same time for a deep cleaning.

I am planning on opening a B&B soon, and in my town, the regs state that no guest can stay longer than 10 days at one time, and no longer than 30 days in a year. It sucks in most cases, but it is great for overstaying guests.

From what I understand, you have another course of action. Since you are the lease holder, you are allowed to move in to the unit. You can go move in, blare loud music constantly, make noise, and be a bad roommate. Obviously be careful no to take the bait and argue with them, fight them etc. but you have every right to move in and be someone undesirable to live with. Be loud, dirty, annoying etc. I had a friend who is a host do this, and the person left after a day when he told her "I am just being me in my apartment that I signed a lease on, if you do not want to be a tenant here anymore you are more than welcome to leave". He left music blaring all day on his bluetooth speaker in the living room, spread garbage on the floor, was yelling and talking on the phone all day and night, even invited some friends over and they yelled and blared music all night. When he told her this was going to be every day...she left. From what I know, this is totally legal and does not violate tenant rights. You are allowed to "move in" as a resident if you have signed the lease as an LLC or otherwise.

I’d go get a horse and sheep and move them in as well. The smell will definitely get them out and ensure no future guests will want to stay for the foreseeable future

You really have seen it all in those seven years, haven't you? I constantly get asked by guests who want to extend if I would book outside of VRBO/Airbnb. My answer is always the same N-O! I best get the LLC sooner than later, because at seven STR's, my chances of issues likie squatters, multiply. Great tips. Thank you so very much Sean!

As a returning guest i was offered by the host to book outside of AirBnB at a discount and pay cash to avoid the fees, which i did for 3 months. But as a host i would NEVER accept it unless i personally knew the person very well.

Another thing to keep in mind is that when they book Airbnb for long term, they haven’t passed any sort of credit or background check and might be a bad risk. Be super careful with anything over 30 days!

This guy is the truth. Look how calm he speaks about his *situations* almost can hear him cursing them out in his head but the professional in him won't let it out lol. I like this guy. I'm learning all the *techniques* to prevent bad situations before I encounter them. It's best to be prepared now.

I appreciate this video Sean, I’m consistently receiving messages on VRBO to book my house for long periods of time past 30 days which makes me weary because many times they resort to the shady “can my company send you and check? What’s your information?” Type of stories. I ignore them each time. However I wouldn’t want to pass off a winter bird stay if that comes up.

I’m impressed with your attitude -I think that’s an very important aspect you convey clearly on this video along with all the other great tips! It’s an important part of what owners need to consider and prep for if they are going to handle this business well. And…OUCH…that would hurt to pay a squatter to leave! 😬 I see the logic-but so yucky-so wrong. But people like that aren’t going to change any time soon, they are messed up and fighting them would be such a headache-not worth being indignant over unfairness.

🙈 lawyer, court always $$ How long I can stay in hotel, motel without paying ? 4 years ego I had to evict a tenant Was a judgement, but no $ yet for me. Now tenant appealed case )) They really know how to play system!

Glad I heard this. I am almost done fixing up private rooms to have them ready for Airbnb and I was initially not going to use an LLC, but after watching this, I think it’s better if I am going to list my primary residence to form an LLC, and protect me should I ever need to prove my rooms are treated like a Hotel and not a lease or anything like that.

I understood from a CPA/attorney that if it is your primary residence, it is better NOT to LLC because you could lose it in bankruptcy court if your business becomes insolvent. Your house, under the LLC, is considered a business asset which is salable to pay creditors.

Yeah, the LLC thing is right. This video has some bad calls. Don’t ever list your house as an LLC. It’s the ONE thing you’ll likely be able to keep of any value if you have to file bankruptcy.

​​@Sean Rakidzich Also you can easily put your home in a land trust and then your land trust can hire your LLC as a property manager. There's no renting needed by your LLC and youre protected

Another great video! My husband teases me about how many of your videos I have watched. But, they are hands down the most helpful videos about hosting on Airbnb on KZfaq. I just got a request from someone for a 3-6 month stay. I’m wary but don’t want to leave money on the table especially during slow season. What do you think about creating multiple shorter stay reservations with that person to try to protect yourself and avoid them having tenant’s rights.

Definitely concerned about squatters with what’s going on with the economy and the nose dive the housing market is going to make soon. I agree and feel like it’s safer and easier to avoid squatters with Airbnb but I also wonder if many people will stop traveling? I’m thinking of converting my Santa Barbara home from long term to STR but can’t afford long vacancies. I have been fixing it up and need to make a decision next week before I sink money into furniture. I’ve heard several You Tubers say the Airbnb market is going to collapse. Your thoughts Adam ?

@@AirbnbAutomated Thanks Sean. I was a Landlord for years and did many Evictions. NYS Moratorium made me so thankful I had sold all but one of my rental properties. Would it make sense to only Host a Guest 29 days at a time. If the person wanted to stay 2 months?

No our experiences with people squatting aren’t Airbnb or VRBO-based guests. They tend to pay enough that they aren’t part of the risk bracket

If you are dealing with a squatter and you upset them, they'll vandalize your place. Best thing to do is not deal with them in the first place. Never let them have tenants rights, never rent any where near 30 days.

Our county sheriff cheerfully told me that they do not get involved in any vacation rental issue, except if the guests are obviously violating other laws such as noise ordinances. If they are vandalizing the interior, tough luck. If they overstayed, start eviction proceedings.

Nah Sean come on big man, you got more muscles than me and you're getting soft on me here.. crooked people only speak one language Sean, no carrots, no honey, no softie-smoothie.. The stick is the way, works every time, and they can't prove a case, because they DON'T have a lease.. done.. plus, most aren't smart or educated. It is said outlaws and diligence are a rare mix. Crooked people make mistakes and get lazy. That's their weak point. My squatter #1: I put a camera outside, waited for him to step out. Change the locks. Threw his sh out in bags. Texted: "oh is that your sh*t outside? Don't forget it". Done. #2: changed wifi code. He Got bored to death. Left on his own. Sent me a formal notice to sue me. Where I live, they need to prove you got the letter, so I simply refused it from the mailman saying "oh I'm the new occupant, I don't know this guy, moved out". Lawyers sent me an email, never opened it, hit delete. No go, dead end. Done. #3: phone him explaining someone else rented, their check-in is next day, needed to clean up. No one home, locked them out, belongings in the hallway. Comes back with the police, he had no proof, no lease, police drops him. #4: guy had criminal history. texted im "coming with the cops". Guy flees. #5: I come over with hammer in hand (for my own safety). I Storm in at 3 am after hearing complaints of drug abuse and blade possession. Joe Peccie style entrance. Knock hard on his door, loud, pissed voice "what the f**k are you up to?! You gotta get the f** out of here by the end of the month cause I'm a f**ng nice guy, or the police will know about your little sh*y habits. (Like Marty McFly said once: DEFINITELY curse, George!!!) You are to hand me your blade weapons, those are illegal and this is my property, so I'm confiscating them, or the police will, choose! Once you're out, I'll give them back" replies nervously: "I'm so sorry, dude! they're just camping knives from home depot!! Here you go!! I'll go, too no problem!! Sorry dude!!" Blades looked more like curled up Arabic assassin sabers more than anything :/. Never did get a chance to hand them back. Apparently the psychological old trick of going tough to finally show some good heart enhanced the effect on him. Offering to let him stay a bit longer and cover him up, dude thought I was humane. Left shortly. Done. I suppose you can say this one was a diplomatic approach. Would hurt paying them to go though, no no no, imagine that. Being soft never worked for me :'/

Thank you for this video. I'm researching ways to protect myself. I have a room for rent in my home which I'm contemplating doing a 6 month roommate rental agreement or short term room rental on Airbnb. But either option scares me due to the potential of renting to a serial squatter without knowing. Since I would be living on the property that would be a nightmare for me. Any tips or suggestions?

Great info! What if I am a landlord I create a separate LLC and under that LLC I made an Airbnb where do I stand? Do I still play like as a landlord or Airbnb business holder?

All the squatter has to do also is go to the court and see if the home has a home mortgage and the hotel BS goes out the door

So if a person books via Airbnb & squats, Airbnb can’t do anything? The Airbnb booking (obvious check in & check out date) doesn’t mean anything to law enforcement?

Really enjoyed the video. I am not in any sort of squatter situation and never have been but I do have a question. If there is a squatter could you not hire a company with members similar to 1970's hells angels to also inhabit the property. Perhaps give them a lease , if necessary, to justify their stay. Of course there would be a significant bonus to the Hell's Angels company when the original squatters leave. ???

They became squatters because the homeowner decided to rent the room outside the app, so, now they aren't trespassing because they paid rent as a tenant, not like renting a hotel room for a night and that's it.

Do you have a video explaining how you rent the property to your LLC? I have a space, have an LLC, but haven’t started yet. What does the lease have to say? How much do I have to charge my LLC (myself) minimum? Can I lease my space to myself for $1 per year? Cannot find any info on this.

You don't have to lease your space at all to your LLC you can just make a management contract.

landlords SHOULD go after bad tenants in court. Even if you get no money from them, their eviction goes on their record so future landlords can see that in their background check and not rent to them. A few years of concerted efforts like that and squatting as a profession would be obsolete

I live in Upstate SC. We have a different and more effective way of removing squatters. It involves your crazy 1st cousin Jeff, who did time on 2 occasions and a Louisville Slugger.

Great hacks and information. My question is, if you have tried this avenue, is it possible or legal to have part of the forms or electronic documents used for renting to produce a rights waiver on squatting? If you can have an airbnb tenant sign this away as a right in the first place, can you legally enforce them to move by having this waiver signed? You can sign other rights away in other matters and in this case squatters would avoid places that made you sign to even stay in the first place.

I prefer the ARBNB platform. If you are using it correctly and have your "no instant booking" and your " guest with a positive reviews and stays," you don't have "squatters." I'm pretty tired of these platforms bashing Independents. Most people aren't staying at a 1200$-3000 a night private home. Most people are staying in modest places like our own. (Which is a whole property rental), but we may be on site to water or tend our gardens. Some guests still like human interaction. That's why they choose to stay in smaller, more quaint places. All the advertising in the world won't change the fact that ARBNB is a household name. 😀

I have an airbnb long stay in california. The guest cancelled and my cancellation policy took presidence that states full refund 5 days prior to arrival(moderate). Now he is squatting from feb 4, 2023 to March 4, 2023 because according to him that is the last part of money he paid. The cancellation policy won't allow him a refund.

I got a new roommate claiming PTSD. he has called he cops 11 times in 2 weeks, then waives them off, he's on/off meds....he was weilding a knife at imaginary people so its not technically assault.....he says he hears people who have guns and want. to kill him and us....None of us want to come home now. trying to get him out with a 3-day emergency eviction. its month to month tenancy....he says he has a lease (delusional as usual)

I don’t believe Airbnb is a good platform for long term rentals (anything over 30 days). If you do run across someone who wants to book longer, why not try them for two weeks, then if it’s a fit for both parties, then either take their deposit, references, background check and lease or if you trust them go ahead with the long term stay.

To get a squatter out of the home, can you remove the refrigerator or put a lock on it? Can you turn off the hot water? Can you release mice or bugs into the home? lol

Expert squatters print fake leases (you can download them online) and when the police show up they present the phony lease. At that point the police throw up their hands and say, "Well she has a lease. This is an issue for the courts now." And they leave. Hence a win for the squatter. A year later they've destroyed the place and they're still refusing to leave because the courts are backed up with too many cases.

@@IzzyOnTheMove Exactly right, but the police aren't going to look into the validity of the signature. That's going to have to be adjudicated by a court. Which means they probably have a year of living on your dime until the sheriff finally shows up to evict them.

The reason why I came to watch this video actually was due to the fact that seeing the video that he implemented within this video of the girl having to deal. With that lady that was squatting in her house I found it astonishing absolutely discussing an unacceptable that anybody would ever think to be A. Squatter on airbnb. It's exposed to a for renting a room at a someone's personal home in that person actually lives in residence within that home that you're running A. Room from and you have the audacity to. Squat there and if there's children involved my gosh are you joking me. I mean seriously what kind of couth do you have or i should say lack there of? Honestly, atrocious doesn't begin to express my feelings on this aspect of renting air bnb or similar short term rentals. I honestly couldn't believe that this sort of thing could ever possibly happen. I felt for this victim in the video he included in his video. I'm sure she needed the money she gained from renting out a room in her own personal home, I mean who would ever want to do this unless they desperately needed the money. Maybe it's just me, but I do not like ppl enough to ever welcome strangers into my home, not to mention I trust no one. So this makes my skin crawl, I literally cringed when I watched the original video that this poor lady had to go through. I just wonder if she was ever able to get this good 4 nothing, poor excuse of a human being out of her home finally. I wish there was an update.. Thank you 4 creating this video, it really helped to better educate me on these facets of renting through air bnb. I at one point actually thought about this as another source of income, but I wouldn't do it until we were able to buy a 2nd home which thankfully we haven't been financially able to do that and I'm so grateful I have seen this video.. I was at the point of not doing it anyway now its obligation solidified my desire not to go into that venture..lol

Been at it since 2014 with over 1500 reviews. I disagree with most of this. 1st, If you give them keys to a new place, you have the same problem, somewhere new. If you're going to do that, give them false keys and they are screwed. I doubt they'll fall for it. I tried it myself. They work in pairs. 2nd. Remove all your furniture? and they don't give a crap! Pay thousands to move it all out and for what? They will stay anyway. Look it's simple. Wait until they are gone. Move there stuff either out front and of course change the door code. (Better to put it all in a storage unit and leave them a key and a note detailing ONLY the code to the unit) Then when they call the police and they will, either A. Don't answer. (Best option). Or B, answer and tell them under no circumstances will you let them in the house. They cannot force you to, even if he or she is a long term or 1 day renter. It is now a civil matter and they will have to go to court and wait months and pay fees and a squatter is too lazy to do that correctly.

Lol they then have a verbal contract with you to stay in the second property 😂 then he tells this elaborate story about removing the entire furniture/toiletries in a unit to force someone to move out 😂 Why did you do that mr smart guy? Cause I thought this whole video was about how to avoid having to do something drastic like that "welcome to Texas, you're going to jail" right? Follow his advice and sue him when it doesn't work.
