I guess the stamp duty refund experts just split the fee and disappear once HMRC refunds, leaving the landlord to deal with HMRC if later investigate and claims back with penalty.

Exactly;y that. So you need to be careful to ensure you do fulfill the criteria. Sadly there are some who would put in the claim. Take the money and when HMRC says you don't get the relief you will have to pay back the stamp duty as well as having paid the fees to the company.

You can write to them with the evidence and request a refund.

Unfortunately property entrepreneur on KZfaq says otherwise. They always say that you can claim the money back if the property is inhabitable due to been left for a why resulting in mould, no kitchen , boiler , water etc. I bought a property last month I was tempted to reclaim back my SDLT. I am glad I watched your video and have more insight. Thanks

As you can see it is a difficult area to advise as HMRC guidance is just that. Guidance!! Until we have some cases through the tax courts we don't know where the line is drawn. However, there are companies who will assist in claiming back stamp duty for you, take their charges and disappear. Then HMRC will come along disagree with the claim and ask you to pay the stamp duty. This is why care needs to be taken to ensure that the right decision is made when the original form is completed.
