The plaintiffs says they wanted to buy a limo business from the defendant and paid him $1,000, but he backed out of the deal at the last moment. They claim he’s refusing to return their deposit, so they’re suing. The defendant argues the plaintiffs missed the closing date twice, and he’s countersuing for time lost.
Case 29-319

So very many signs the gentleman couldn't afford to buy this business. I was horrified to hear he had his grown child borrow 10s of thousands form their 401K for him to buy this business.

I can't understand why a man of his age and in his health would borrow so much money for a company. Even if it was for his kids future he and his wife will be struggling with the stress for the few years they have left, I wouldn't be surprised if the heart attack was brought on by all the stress of trying to raise the money. If you have a nice retirement fund, just use it to enjoy the next 10 to 20 years together, let your kids get their own business.

I watch a lot of legal content on many platforms. I always see so many comments of “He seemed like a nice person”, and “ No the plaintiff/defendant should’ve won because he appears to be”, or “They shouldn’t have won because they acted…”. I just hope that the American people keep in mind that: Our legal system cannot base lawsuits or any court proceedings on feelings, bias, or someone ‘seeming like they deserved a different judgement’. It is so important we enforce that court rulings are based SOLEY on case evidence and established Credibility.

Usually that’s correct. However if the parties both don’t dispute the particulars of the verbal amendment to the contract or if there is evidence that they acted in accordance with the new agreement then the judge can enforce it. It’s always best to get things in writing though.
