The plaintiff’s father, the defendant, opened up a bank account for her to deposit a government grant she received for college. However, the plaintiff says her dad stole the money, so she’s suing. The defendant argues the money is his, and the plaintiff spent some of the funds to go on a trip with her boyfriend.

It’s possible that her dad would have to sign a waiver to agree to give up his right to access the joint account. I was on a joint account with my mom until I was 20. If she didn’t agree to waiver her rights to the account, she would have had access to it until I was 25. That was my bank’s policy. Edit: the max age could have been a few years lower, but I don’t remember

She more than likely has another account that she uses on the regular. Especially since it took her 2 years to realize the money had been transferred.

The judge was putting words into the defendant's mouth that he didn't even say. She gave him way too much credit. He straight up said he felt like the money was his (with no real justification). Then for him to bring up the fact that she wasn't his biological daughter is messed up. It did nothing to aid his argument. He's toxic.

He deserves to be held in low regard. He's treated her differently due to his belief about her provenance--which they both know is unconfirmed--when legally she is his daughter because she was born while he was married to her mother. The "biological daughter" bullshit is bullshit.

She should have reported it to the IRS, stealing a Pell Grant is a serious crime, any amount is a felony and if she'd reported it to the IRS or student aid he would have not only been required to pay it back he could go to jail for it for a long time.

I think the judge misunderstood his reasons for saying it was his money. He felt like he was claiming it as a debt owed to him for money he spent on her over the years.

Thank you! He was being malicious. JM has a soft spot for parents and it gets in the way of her understanding that just because someone is your parent doesn’t mean they will do right by you. The fact that he got on TV and started spilling all the tea about him not being the father and mother cheating with the drug dealer! Ridiculous!

The defendant was trying to say. The checks were being deposited into a joint account he had with his daughter . But, he gave his daughter all the money and more. She said her father was giving her money every month for books and everything else. The money in the account was his money, not hers. The defendant's English isn't good. So, he had a hard time explaining to the judge.

Judge Milian didn't get to hear what the plaintiff was saying about her father in the hallway while she was speaking with Doug. She stated that her father would hit them. The defendant seems to be one of those controlling dads. God knows what else happened in their household.

I hate when the judge knows litigants for mere minutes and decides to say some out of pocket statement about family togetherness at the end of a case. The dad pulled some dark family secrets out of the closet FOR NO REASON and the judge still played the, "I think he was trying to do what was best for you" card. The judge was so out of line.

I think the comments he made about her mother and that she was the product of an affair with the drug dealer really changed her feelings. It was clear that she was hurt by his comments, and her older sister was trying to comfort her. When he agreed to take on the role of her father and didn't want her mother to tell her differently, he also took on the role of supporting her. Whether she knew the truth or not, he was the adult and "knowingly chose" to take on that role. Either you're going to step up completely or you're not, you don't get to change your mind when it comes to being a parent, especially not after 16 years. You can't charge your minor child for supporting them. They didn't ask to be born...

I believe he was keeping so that she wouldn't use it on the boyfriend and only lied to say that it was his for a defense. I believe him when he said the sister told him about the vacation so she obviously saw an issue with it too.

I agree with you. I am the father of 4 boys (34, 26, 24, 19) and 1 daughter (my youngest who is 12). I would never do this. If I was giving them money and they had a savings account I had access to I would never touch it. If I needed an emergency loan or something I would ask them. My oldest was living with me us even though he had a job. Partly because it was right before the pandemic but he is still with us. I have no problem with that and he pays a small amount and everything is covered except car payment and his CC. Food, water, electricity, phone, internet, insurance is covered. So he had a nice amount saved (10K). Wanted to buy a side of beef because it was cheaper but it was 1500 and I didn't have it at the time but I would in a few weeks. So I asked him and told him he would get it back. And I gave it back. Never have we said his money is our money because he is getting such a cheap deal living here. My other son has "borrowed" money a lot but doesn't live here. One time he wanted 1k and I said OK but things are tight right now I will need you to make payments of 100/month. He did 4 payments and stopped. I wrote it off. The other son asked for 200 till his check cleared so he would pay off a bill before he came to see me. Said he would give it back once he got his student money. I gave him 500 since he hasn't ever asked for money since he moved out to go to college. He said he would pay me back when he got his student loan in 1 month. Never happened and I never mentioned it. When my daughter gets older the same will be for her if I am able. To be honest I am 58 and will be 64 when she graduates so close to social security age :) So far no grandkids.

Her and the sister both said he took the money two years ago and her vacation is current. When u add that all up it clearly has nothing to do with her “bad spending”

I remember a period of years when I never saw my mother because all she did was work 6 days a week to provide shelter and food for us. I would be damned to say all she did was pay for shelter and food 😂 if she didn’t work crazy hours we would have been on the street and starving. And because of her actions, my first check as a graduate I gave her as a thank you for being the real MVP.

The defendant is angry with his ex-wife and he's taking it out on his daughter. His wife kept cheating on him. They had two daughters. They made a deal, they won't tell anybody that (the plaintiff) wasn't his biological daughter. Then his wife got mad at him and she told everybody (including) the plaintiff, Just to hurt him. But, she really hurt her daughter. A lot of times family come to court for one reason and they start talking about something completely different. 😢 This reminds me of the case where the young man was suing his mother. He started talking about stuff that was going on in her house, when he was growing up. His mother quickly jumped in and started saying all kinds of horrible things about her son 😢

The judge was too biased here. Pushing the narrative that he’s a good father when we don’t know him. He kept on demanding that it’s “his money” when it’s not. It’s a government grant she got for going to school. It was in savings for two years before any issue came up and he took it without telling her. Just because you raised her and spent money on her along the way, doesn’t give you the right to 4 thousand dollars in grant money.

This is hard to watch at the end.. not sure why the father revealed so much personal info at the end. Seem like he wanted to hurt her but I bet he is her father. Hope she finds peace and forgive him for everything and don’t let it affect her future! 🙏🏾

What a spiteful defendant; there was no need to air all of that dirty laundry in public. He claims the mother told the plaintiff that he wasn't her bio dad to hurt him, but what does he think he did to his daughter...and on TV?!? A rational person might realize that his daughter would eventually be grateful that he didn't turn his back on her and raised her as his own. What a small man he is...

He is now almost 44 with a wife and children and would help them whenever he could ! We help our children if and when we can and don’t do it for the expectation of repayment. I respect Judge M so much, but I think she didn't really get why the father took the money...he felt that he'd paid towards her college and that the money in the joint account was his because he'd contributed so much more. He also wanted control I'm sure. The father spilling all the family secrets in such a public forum was despicable & hateful. He was angry and vindictive and really immature. This was really sad, I wonder if that relationship was even worth salvaging. I wish the very best of luck to the plaintiff, she seems like such a mature & sweet young woman.

Even if he contributed to her college education, which if she's receiving grants it's likely he's not because grants are typically for students who don't receive any family contribution, those grants are in her name and awarded to her not him. It seems his thought process was that he footed the bill for her in life so now he was going to get some of that money back from her, basically making your child repay you for raising them. It wasn't right of him to take it, I would never do that to my son whose in college, and for him to say it was his money is despicable, and the way he just verbally vomited her origin story was disgusting.

The Judge had this one all wrong... I could instantly tell that there was so much more going on between her and the father. Her body language, and the fact that she was continually holding back her tears and emotion, spoke volumes and you could feel the tension and darkness between them. I don't doubt that he loves and cares for his daughter but I do think that he has an unhealthy and toxic way of showing it and he clearly got his priorities out of line for him to put money before family. I also believe that the Mother's affair, that resulted in the daughter being born, remains a sore spot in their family and he never truly got over it. And despite raising her and loving her as his own, I think that he has subconsciously taken out the Mother's mistake on the daughter because even though it's obviously not her fault, she's still a constant reminder of that infidelity and betrayal. Additionally, I believe that there are a lot of cultural and generational differences at play here that drives that disconnect going on between them, giving them completely different perspectives on life. For example, the DV that she mentioned happened to them growing up. Not to excuse or defend that behavior from the father but to him, growing up in a completely different culture and generation, that is typically seen as a normal form of discipline and not as taboo as it is here, especially nowadays.

A huge red flag is any parent saying "I did xyz for my child for xx years!". No good parent would ever lord that over their kids. I feel so bad for her. I hated JM for this one. She's a judge so she's meant to be unbiased but it feels like all her cases lately are completely biased. I honestly hope she changes her ways because if she keeps being biased like this, it's a quick way to lose her judgeship. She's literally going against the fundamental rules of what being a judge is. You ask questions but never be personal about the case and never insert yourself into the case either. You don’t relate to any person and you simply look at the facts. The facts of this case was that she got grant money and he stole it. He stated he felt entitled to it but its government money that was given to her and her only. This was such an open and shut case. Letting him take the stage and venting his aggressions and anger about her mother's discretions and the circumstances of her birth is just horrible. JM even saw the daughter shocked and getting upset and saw the sister comfort her yet did nothing to stop the madman from spilling things that shouldn't be spilt. Not every parent is good. Not every parent has a right to have anything to do with their child. This father showed his true colours and instead of seeing it, she ignored it. I've seen her do this before and I seriously hate it. Not only that but "all money is mine" but gifts and "support" is not something that needs repayment. Giving a child a phone or buying food or paying for extracurriculars are all covered under "supporting a minor". Thats a given. They are entitled to have those things. To say that she says to her kids that their phone is hers and that she demands passcodes and it's not an invasion of privacy is so wrong. It's almost criminally wrong. Imagine giving a child a teddy since they cry when sleeping alone but you decide to put a hidden camera in the teddy. This is the same level of invasion yet the teddy would be considered more of a crime than the phone. But both things are invasions of privacy and both things are a gift given. I'm so disgusted with JM for this case and her own admission of her treatment of her kids.
