Hello, in the state of Arizona the Department of Insurance Financial Responsibility is in position as a Statuatory Agent for an Auto Insurance Co. that is home based in Texas. Therefore, the Process of Service goes to the AZ. Department of Ins is a requirement in my case. Once the department has received the Process of Service does the 20 day rule still apply?

@@attorneysteve Hello again, I am now at the point of sending my request for a default judgement to the justice court judge. I am looking for a form to draft the information for the judge to review the evidence in my case. Is there a form I can obtain to fill out this information?

Hello, one more question for you. In Pinal County Arizona Justice Court, how many DAYS does the court have to answer, Request and Application for Entry of Default Judgement. I have heard 60 business days and also heard 60 calendar days. Is either one of these correct? Thank you very much.

I just found out after 2 months of waiting on the judge in my civil lawsuit that he dismissed my case against the insurance company. I never received any letters or notification from them about their filing in court. What procedure can I submit to the court to reopen my case> @@attorneysteve

One more tip - wait ten working days after you file for entry of the default before filing your motion under Rule 55(b). As we mention, the Defendant will get another 10 days to respond even after their default is taken. So you have to wait that extra ten working days before submitting your Rule 55(b) motion. Do you have any sample motion? I have a friend in Phoenix, the family court served him the default order after the 30 days had past.
