Possible medical issues? She claims not to have drank or ate anything, and then blacked out, it can be the case that this happens and the other person has no clue and it’s an internal issue, in which case it’s something fully unaware by the other partner and would be unfair to claim a rape charge as the reasonable person would have no idea about such things as they only have an outside perspective. That is if you believe her story at face value, where you could also argue she felt threatened and a lot of victims simply don’t want to have to go through trauma of resurfacing
