At the camp I went to on Chesapeake Bay the first thing we all had to do was take a swimming test. The counselor had us swim laps in the Bay doing 4 different strokes. Based on what she saw we either had to take swimming lessons before doing any other water based activity (sailing, waterskiing, etc.) or we were cleared based on our performance. To me this makes sense.

I've been to a dozen summer camps over my lifetime with swimming, equestrian, hiking, campouts etc. Except for some unchecked bullying every one had adequate staff for individual care, and at no time swimming events went un-guarded!

So the lawyer believes that asking the kid, who reportedly knew how to swim "do you know how to swim?" Would have changed things?
