All this stuff about "military use weapons," and "common use," and the right "is not unlimited," and "dangerous and unusual," and all that crap. .. its a bunch of crap! I see NONE of that in the 2nd Amendment's clear text, and it sounds pretty damn UNLIMITED to me. Shall not be infringed....

The supreme court said we cant have short barreled shotguns because there is no military use for it. That was 1934. But what that says is that any weapon that has a military use is a weapon we should be able to have.

Shall not be infringed means the government cannot take away your right to own a firearm, it says nothing about there not being any limitations or restrictions. That same Constitution gives Congress the right to make laws in the interest of the citizens. Can you turn on the fire you just can’t own whatever you please.

It does not say no limit, no exclusion. It just says shall not be in fringe, which means the government cannot take away your right to own a firearm. Does ‘t say anything about you owe me today’s military grade weapons. And that same constitution gives Congress the right to make laws, which they have.

The issue i see with SCOTUS,they are completely stuck on "semi" automatic when the focus should absolutely on "arms." Arms are simply arms. Be it military, militia or citizen, arms are FOR the people. There is no distinction of arms. That alone makes any arm, accessory or passive defense protected under the second amendment. The average free citizen is afforded that freedom and i believe that includes people that have been convicted of a felony and has served their sentence, in whole, because they have paid their debt to society. If a felon is so dangerous and unusual (see what i did there) that they are not trusted to own or handle a firearm, why are they being released?

Look at US v. Miller (1939) - SCOTUS said that weapons that are not fit for military use are not necessarily protected by 2A. Wrong on the facts because the SBS in that case is a weapon that I think military might use in a breach-and-clear operation in urban combat. But the implication is that civilians should be permitted to own AR with a 3rd switch location because select fire is even more military-like than a semi-auto.

A hundred and twelve years ago, in 1907...our great-grandparents were first able to buy the rifle pictured. The semi-auto Winchester Model 1907. This is a gun they could buy from a Sears catalogue and have delivered via US Post. It was/ is a semi-automatic, high powered centerfire rifle, with detachable, high capacity magazine. About 400,000 semi-automatic rifles were produced before WW2. Civilians had hundreds of thousands of these for 40 years, while US soldiers were still being issued old fashioned bolt action rifles. The 1907 fired just as fast as an AR15 or AK47 and the bullet (.351 Winchester) was actually larger than those fired by the more modern looking weapons.. The ONLY functional difference between the 1907 and a controversial and much feared AR15 is the modern black plastic stock. The semi auto, so-called "assault rifle" is 110 years old. It isnt new in any way. The semi auto rifle was not a weapon of war. The government MADE IT a weapon of war 40 years after civilians had them. The semi-auto can be safely owned by civilians. The proof is that literally 3 generations of adults owned and used them responsibly and no one ever even noticed.

Current checks and limitations on free citizens should not be on exist. That scrutiny should be pushed on felons, who I also believe should retain the right to bear arms after incarceration/probation/parole.

The "military use" test is particularly ridiculous when you consider that our nation was founded when the King tried to confiscate the "military weapons" of the colonists. That is literally what the "Shot heard around the world" and "Paul Revere's Ride" where all about. This is also why the law banning machine guns is also pretty ridiculous.

Same question as before, what's to prevent these lower courts from dragging their feet? Justice Thomas has said it's going to get overturned (all but). He also said it won't happen until a final merits case is decided. The 7th Circuit sat on a case for 13 months and only took it up when it looked like it might get SCOTUS notice. If no decision is made it'll hang in limbo with the ban in effect. EXACTLY what they want for as long as they can keep it.

@@Redneckerthanu It's not being addressed. And won't likely ever be addressed. SCOTUS isn't going to put an arbitrary deadline on a case nor should they. There should be a schedule tho and if it's not being kept, there should be a reason given.

No where in the second amendment does it refer to any restrictions based on if it would be considered a military use weapon. If you go back in history many people possessed military grade weapons for the time. Plus not to mention you had privateers that literally had their own warships. If the argument is that it is military grade, then the argument is already lost because there is no provision that prohibits military grade weapons to not be used for general use

The men who fought to overthrow the British had to supply their own arms. Their arms were often better than the British Brown Bess musket. Most of the cannons used were privately owned. Today, those arms would include (but not be limited to) a select-fire carbine. If you look at it from the militia standpoint, a militia is drawn from the people and must supply its own arms. Thus, we the people have the right to arms, particularly those of military use.

In fact, the only specified reason for “why” we have 2nd Ammendmemt is so that we could from militias for common defense, and militias need military arms. So military arms of individual soldiers should be the specifically allowed.

@juicejuice11550 That's not true at all. You can register an SBR or an SBS with a Form 4. It's the same one I used to get my silencer. And you can still get full auto guns as well. Before the NFA of 1934 we allowed to purchase those things from Sears. But when they passed the NFA the reason they said we can't have Short barreled guns is what I said above.

How can courts deny the “militia” use of weapons “reserved for military use.” As an aside, If (when?) the 7th circuit ignores SCOTUS precedent and upholds the Illinois law, what consequences do the individual circuit justices face? Likely none

Need to quit applying for preliminary injunctions and just go straight for a merits decision.

It's a double edge sword. If you are in these states the preliminary injunction can help stop the law from ever going into place. For example Oregon and measure 114.

@@ArmedScholarLike in New York, the Preliminary Injunction now will allow you to carry in Sensitive Locations. The Second Circuit will have to decide the case once again.

@@ArmedScholar Cases should run parallel - attempts to prevent a statute from going into effect obviously should have a case going for a preliminary injunction. But they should have a parallel case that skips the preliminary injunction stage and goes for merits. Likewise in cases challenging statutes already in effect - especially "as-applied" challenges should only go for merits decisions. I'm working on a challenge to 922(g)(1) and California's 29800 statutes for a guy who wants to buy a gun. I would never advise him to go for a prelim injunction because even if you get a prelim injunction to go into effect, there is high risk in purchasing until you get a final decision with appeals exhausted.

Everybody complaining about the pass on the Illinois case sounds like they are still willing to consider it after and round of back and forth. The 1773 edition of Samuel Johnson's dictionary defined arms as weapons of offense, or armour defence. Timothy Cunningham's important 1771 legal dictionary defined arms as anything that a man wears for his defense, or takes into his hands, or useth in wrath to cast at or strike another.

They are literally NOT reserved for Military use. The military isn't ordering standard cap, P-mags from Primary Arms. Nore is the military using a spikes tactical, semi-auto, intermediate cartridge rifle (for example) outside of the private market. If you live in Illinois, buy lowers now. To claim the most popular rifle in the U.S is "reserved for military" might be the most ridiculous argument I have ever heard next to the pistol brace ban.

Barring m16 style rifle would be like banning Enfield's after the Civil War or Brown Bess after the Revolutionary War. The rifles are so ubiquitous because those were the weapons used in the conflicts of the time. The minute men picked up their hunting rifles are marched. Today, Stoners rifle has almost reached that level of commonality across a much greater area and in much greater numbers.

all arms otherwise the founders would have specified. I am sure that they were smart enough to realize weapons would change over time. The founders had to have knowledge of that famous inventor who drew his design of a helicopter thousands of years ago.

The Founding Fathers personally knew of multi-shot firearms like the 1777 Belton Flintlock, the 1630 Kalthoff Repeater, and the 1779 Girardoni Air Rifle. They knew technology would improve because they were seeing it happen. Same reason why they didn't limit the First Amendment to quill pens, hand-cranked printing presses, and shouting in the town square.

"and to petition the Government for a redress of grievances" - we don't make or present a formal request to public employees for signatures of approval, we make or present a formal request to other members of the public (the authority) for signatures of approval to have our public employees set things correct. petition (verb) - make or present a formal request to (an authority) with respect to a particular cause. redress (verb) - remedy or set right (an undesirable or unfair situation). The Declaration of Independence declares the authority - "We, therefore, the Representatives of the united States of America, in General Congress, Assembled, appealing to the Supreme Judge of the world for the rectitude of our intentions, do, in the Name, and by Authority of the good People of these Colonies..." The authority is not that of the representatives we employ, they "do, in the Name, and by Authority of the good People" The fact that so many do not comprehend this, IS THE PROBLEM. We, the people of the United States of America, are the government of the United States of America. Those in our offices "do, in the Name, and by Authority of the good People". It is past time we again tell them what to do.

After considering the length of time that transpires during these lower court cases I believe the following needs to happen. A time limit needs to be placed on these lower courts. Thus requiring them to operate as intended instead of playing political games.

I have a Kershaw knife. I have their biggest detent assisted blade with all copper furniture for my camping cook knife. It's a heavy boy, but I love the balance and it's great for chopping onions and garlic and slicing steaks. I got copper because it's antimicrobial...and sexy...

It is intertesting, how there was no "Gun Problem" until about 20 soild years into the Dumbing Down process. Thus, verifiably the problem is aptitude not physical capability. As we've seen in every aspect of modern society, the bar has been repeatedly lowered to accomodate the lowest common denominator. The lower the bar, the more deminished the performance. Such results in extreem excuse making and side stepping; educate and hold accountable.

I worked in a large maximum security state prison where many of the purveyors of gun violence were incarcerated. Cop killers, robbers, rapists and murderers of every stripe. I can remember having conversations with some of these characters about guns. Since a gun was a necessary tool for them in their day to day activities while out in the street. I was told, by these criminals, that they are able to obtain guns when needed, off the black market.
