संविधान को बाबा साहेब अम्बेडकर व उनकी संविधान कमेटी ने preamble को बहुत सोच विचार कर लिखा था। Preamble में कुछ भी जोड़ना या घटना पार्लियामेंट के अधिकार क्षेत्र में नहीं आता है। इंदिरा गांधी ने वामपंथियों के प्रभाव में आकर secular को जोड़ा जिससे मुस्लिम समुदाय को फायदा पहुंचे। इंदिरा गांधी ही वह प्रधानमंत्री हैं जो अफगानिस्तान दौरे के समय बाबर की मजार पर चादर पढ़ाने गई थी, बाबर जैसा लूटेरा भारत को लूटने व महिलाओं को गुलाम बनाने के लिए भारत में घुसा और दिल्ली तक पहुंच गया, अपने सेनापति को दिल्ली का तख्त सौंपकर वापस चला गया। इंदिरा गांधी को बाबर से बहुत प्यार था।

यदि SC कहता है कि हाँ preamble मे भी संशोधन किया जा सकता है तो फैसले के तुरंत पश्चात preamble मे फिर संशोधन कर भारत को सीधे हिन्दू राष्ट्र घोषित कर देना चाहिए.

Where was the secularism when the country was partitioned based on religion? The very creation of India as a country is due to non secularism. So how can it be basic structure of constitution? Yes we are secular but not for those who are basically non secular. This one sided love has not been reciprocated and would ultimately prove fatal. High time to set house in order.

Madam, I have two questions. 1.During the time of emergency, means there was no opposition, there was no parliament in other words, then how can Parliament actually invoke 368? Ideally no bills can be introduced during emergency period correct? 2. When parliament used 368 to add those words in preamble, then why should we go to supreme court to remove those words? Cant the same parliament use same 368 to remove those words from preamble?

Supreme Court should not have this power to review the preamble of the Constitution. It is the sole discretion of Parliament.

Jo PIL dono word hatane ke liye dala gaya hai use Supreme Court Kharij kar dega kyonki jo word joda gaya hai usase desh ka koi nukshan nahi hai aur sabse badi bat ki jin do word ko hatane ki bat ki gayi hai woh Samvidhan me pahale se hi majood hai aur sansodhan karke ise sirf highlights kiya gaya hai aur dusari bat ki prastavana ki bato ko hataya nahi ja sakta lekin isaka matlab yah nahi ki usame kuch joda nahi ja sakta..... Samvidhan ke mool dhaanche ko bhale hi hataya nahi ja sakta lekin un mool dhaanche ke sath sath aur bhi bate jo desh hit ya lok hit me ho to use joda ja sakta hai... Hataane se bhale hi roka ja sake lekin uname kuch Naya chij add karne se nahi roka ja sakta hai... Mool Dhaanche me sansodhan nahi karne ka matlab yah hota hai ki moujuda mool dhaanche me sansodhan karke mool dhaanche ki bato me se sansodhan karke kuch hataya nahi ja sakta na ki sansodhan karke Naya chij jodane se rokta hai.. Pahale Samvidhan banane walo ke uddeshyo ko samajh lena chahiye PIL dalane wale ko phir bat karni chahiye ki woh kya kar rahe.... Prastavana ya Samvidhan ke mool dhaanche me sansodhan nahi Kiya ja sakta isaka matlab hota hai ki moujuda mool dhaanche me shamil bato me se koi bhi bat sansodhan karke hataya nahi ja sakta lekin sansodhan karke Naya chij joda ja sakta hai kyonki jodane se nahi roka gaya hai agar jodane wali bat Pahale se hi Samvidhan ke anooropp ho to isliye jo do word jode gaye hain usase na Samvidhan ka mool dhaanche me koi bura parivartan hua hai ya na prastavana me bura parivartan hua hai jisake Karan ise hata diya jaaye.... Naya chij jodane ka matlab hota hai ki jab bhi prastavana me Naya chij joda jayega sansodhan karke to phir prastavana ke anooropp hi woh bat honi chahiye na ki virudh kyonki prastavana ya mool dhaanche me sansodhan nahi Kiya ja sakta aur sansodhan ka matlab hi hota hai parivartan aur is hisaab se prastavana ya mool dhaanche me parivartan nahi kiya ja sakta yani yaha parivartan ka matlab hua ki moujuda bato ko hatake naya bat shamil karna lekin Naya bat jodane ka matlab yah nahi hota ki mool dhaancha badal jayega balki mool dhaancha to tab bhi rahega jab naya word joda jayega....

The present Constitution is Constitution of Dominion of India. It needs to be replaced by the Constitution of Hindu Republic of Bharat duly enacted by the Parliament. This can be achieved by a Legislative Exercise of expert Constitutional Lawyer
