you have a point. and that detail will probably not make it to the public. how much was the repair cost in the 2018 assessment? 7 million or more? that money is extra, that doesn't come out of the association's pockets....these associations are nothing but a bunch of crooks like car rental companies. Associations collect maintenance fees and spend as little as possible on repair or maintenance, car companies charge you for a dent on their car but won't fix it.

Aaaaaaannnndddd Pandora's Box is officially WIDE OPEN. That place was a ticking time bomb, sadly. My son worked as a valet, about 5 years back, at the Champlain Towers; and when I told him he said he was shocked but not surprised. He told me he always thought the building was too heavy, had too much water intrusion flooding the parking lot constantly; and that they basically put "band aids on a broken arm" regarding the reports of which he filed many. He eventually realized they were being swept under the rug because no real repair was really ever done. He also said the building manager at the time was a real ahole. And my son gets along with just about EVERYBODY, so I know the guy must have been a peach to work with. I used to pick him up and drop him off at work many times...and I have to say, THANK YOU FATHER FOR SPARING US THAT DEMISE. It could have happened at ANY TIME to ANYONE that visited the place. My prayers are with everyone that is hurting; may God's angels surround and comfort you. May God have mercy on all of the souls that departed and any that may still be alive. This was a clear result of GREED and could have been COMPLETELY avoided. Shame on those responsible.

A retired civil engineer neighbor said years ago that he wouldn't buy a south Florida condo owing to their poor construction. "They look like they'd collapse" , he told me prior to buying a single family home next door to me instead.

If that was true we’d have hundreds collapse already due to all the hurricanes that come through. Now maintenance is another issue and in Florida beach property maintenance is very expensive so no one wants to pay for it but everyone of course wants to live on the beach. You can KZfaq multiple news reports of property owners fighting with the city and county and state over whose going to pay for it. This condo association says in 2018 they knew the repairs were needed but they didn’t have the money.. so the question is why didn’t they have the money and where were all the HOA fees going all these years. Why didn’t they have a reserve?

From what I've been reading, all condo owners were aware of the deteriorating condition of the building. The HOA was trying to figure out the special assessment to pay for the necessary repairs. It probably would have come to over $100K per owner.

There isn't someone else who owns the building. So... you're saying that the condo owners are / were greedy? How? @@Maryannam78903 I live in a condo, different state, but the same problem: HOA board owners propose assessments, owners vote that down. Nobody wants to pay assessments or take out a lengthy loan on a property you might sell, or if you are on fixed income. I was on the Board of my HOA, and let me tell you: first of all, never again, second of all, if this kind of tragedy happened to us, the very people who voted against the repair assessments would be the first ones to sue the HOA. It's so so so political in HOAs, it's crazy. All the HOA board members are usually volunteers. And now they might be sued by the people who most likely voted against large assessments to renovate. As I said, I would never make the mistake of running for the Board ever. There should be a mandatory assessment for any structural renovations, required by law, without that kind of burdensome decision being put on any board members.

This is time to change. No more waiving of reserves. Full repairs as needed. This building should have been condemned. The state has the power to take over a condo in receivership, make the repairs and pass the cost to the owners. This was avoidable and everyone knew how bad this condo disrepair was. Sometimes the board just has to make the repairs but they were talking 15 million, 100K EACH, and those owners just did not have the money. They should have sold. Now they are gone

There is a 40 year recertification requirement, but there is no requirement to wait until 40 years. If you own a single family home that corrodes over time and you do not maintain it, and there is a catastrophe as a result, who are you going to sue? Not very different here except there is a group of owners instead of 1. It's a condo, you bought it, you get it fixed. Plus who are going to sue here? The HOA that you are a member of? First, half of them are dead, and if they had any money in the HOA account, they wouldn't have needed a loan for the repairs.

It turns out the condo residents already knew about the damage and repairs that needed to be done, but had delayed the issue because of the huge assessment cost. Residents voiced concerns at the condo association meetings about the amount of the proposed assessment and having enough financial oversight on it, delaying the repairs. 75 days before the collapse, the Condo association sent out a letter which would help residents better understand why the coming assessment would be so costly, - yet some residents had stalled the process believing the condo board was "assessing too much.” From the doomed condo, the last memo: “Your Board of Directors is working very hard to bring this project to fruition,” [indicating the board had consulted with engineers, accountants, and attorneys.], “We have covered so much ground already to get the project rolling. … We have discussed, debated, and argued for years now, and will continue to do so for years to come as different items come into play." But not "years to come", just 75 days.

I am one of them, I pay rent on time, never late yet I live with mold, and its killing me and my son every where we moved the same thing! and the landlord will not help they just give option to move and the amount of money it cost to keep moving and now look! the same thing happening here they ignore the obvious signs they choose to do nothing and all these lives lost! such a tragedy this could have been avoided I pray for the victims and their family 🙏🙏😢

The Wall Street Journal today, referring to articles on the Champlain Tower South in the Miami Herald in 1981, reports that the developer put a massive and illegal penthouse on the roof of the 12th floor, adding a 13th (lucky 13) floor that was not part of the approved architect plans. More stress loads on a building built on the cheap. The city of Surfside will end up also getting sued - for its total corruption and incompetence. Surfside later gave the developer a key to the city.

Did you look at the report? While repairs were needed in a timely manner, there was nothing indicating severe structural compromise or life hazard. Nothing to indicate a building in need of condemnation. Heck one of the local news channels was just showing a local much bigger building that is much much worse. I suspect what we are going to see from this is the tightening up of engineering construction and building standards with regards to near salt water environments. They will probably start mandating all new construction use higher density moisture resistant concrete on at least the lower level parking decks and main supporting columns. There are some reports, as yet unverified, that there were multiple incidents of Salt Water getting into the parking garage. That’s likely to be the ultimate root cause.

Or that water was from broken roof drains and sewer, water supply lines. When a building sinks, it will damage all the pipes underneath it. And that salt is a added bonus. I am in a older 7 story building on the coast and we have problems our board won't address. My motto here is if u spend it u can't steal it. My problem child was built in 73. You would think the water intrusion would effect the other buildings as well.

I can’t imagine what the upkeep costs would be in a high-rise building like this one. Pretty high most likely. Especially a 40 year old building. Continual upkeep is the key so the costs are pay as you go along so the repairs do not become super costly and all at once. Hopefully there will be stricter rules put in place in the future so this type of thing never happens again.

People here are confused about condo’s. The owners are the individuals who own individual units. This is represented by the condo association sometimes called a HOA wherein each unit owners as a votes in the association . They pay dues to maintain the building and vote to approve those dues as well as special assessments. Basically the dude is suing himself. moreover the only assets the condo owners have is the building and any insurance. This is NOT wherein tenants rent a unit from a corporation or landlord however some condo owners can/do rent out their units

@@md9710 For houses and new construction, yes. But Hurricane Andrew back in 1992 is what made the codes strict. That condo was built in 1981. Codes only apply when you build something... not what you get recertified or even sold. Companies put off major renovations because that would entail bringing the property up to modern code and cost way more than just doing the renovation to the code from when the property was built.

Having seen some of the pictures before the collapse it appeared this building was in bad shape. Rebar coming up through the garage floor, big chunks of concrete missing from support pillars and lots of water damage throughout the building. I am No expert but I have been around construction and home building enough to know I wouldn't have bought there no matter how low the price was. People tend to see what they want to see and turn their heads to what they don't want to see. I don't need a building inspector to tell me to stay away from this building or to get the hell out of this disaster waiting to happen. You can bet there are plenty more buildings in the area in the same condition.

Definitely need to see all the notes from the meetings. Would like to see how cheap the condo owners were. Plus to get insight into the accepted monthly dues & if they covered minor ongoing repairs along with more structural repairs (& if the condo owners passed special assessments to pay for the more expensive repairs).

I agree, but what’s amazing is how fast they are running to their lawyers. There won’t be any money left after they pay the non survivors families. This guy should be running to church and giving thanks he’s alive instead of running to his attorney. South Florida at its best.

I believe the homeowners were to start paying a special assessment to begin the major needed repairs July 1. It would be curious to know what this guys stand on that assessment was prior to the building falling down? I don’t know why but something about him just radiates “loud guy in the meeting screeching about the costs of repairs”. Maybe it’s that he’s dropping his lawsuit before the bodies are recovered.

@@andrewtaylor940 I don't think that people understand that the condominium owners are the ones that bear responsibility for this. Insurance companies generally do not cover losses caused by structural failures/deficiencies. The only assets that the HOA has to go after, is whatever is in the maintenance account, and the land that the buildings sat on. Most of the surviving condo owners will be deceased before the litigation is sorted out with this disaster.

I am not in any way an expert, but I have worked in construction all my life. It does seem pretty clear that all the support columns failed within seconds of each other. The second section begins to fall towards the first failure, but rapidly corrects to a straight down decent as the opposite columns obviously fail. I say obviously because no other event I am aware of could cause that change in velocity.

This is time to change. No more waiving of reserves. Full repairs as needed. This building should have been condemned. The state has the power to take over a condo in receivership, make the repairs and pass the cost to the owners. This was avoidable and everyone knew how bad this condo disrepair was. Sometimes the board just has to make the repairs but they were talking 15 million, 100K EACH, and those owners just did not have the money. They should have sold. Now they are gone

The scary thing is from looking at the 2018 report and what little we have seen from the 2020 one, while repairs were needed, There wasn’t anything screaming imminent danger or life hazard. There is nothing in any of the reports that would seem to have triggered condemnation. I’ll be real curious to find out what was happening on the roof? That seems an odd place to begin the repair work.

All the tenants fight paying any hikes in their HOA fees. And no way anyone of them wanted to pay that $100,000 assessment to repair the building. Over 500 repairs needed. They we’re doing patch jobs if anything.

I read they just took out a 12 million dollar loan for repairs. The tenants get copies of repirts. They knew about 2018 report but at a meeting with building officials they were told IT WAS SAFE. that's the head that needs to roll.

Partial blame will be spread to a few people, so the worst that will happen is a slap on the wrist for everyone. The engineer hired will be partially blamed for not raising a bigger alarm. The condo association will be blamed for not doing repairs fast enough. The condo association will blame the engineers for not telling them the building will need to be repaired ASAP. Everyone will blame a defunct corporation from 40 years ago that designed and built the condo. In the end, each victim's family will get $200,000 and their lawyers will get $400,000.

This guy is gold for the media because he knows how to talk and describe perfectly what happened before the crash, so he and we deserve a full interview of at least half an hour! In Fox News, for example, he talked about the whole chain of events until the tenants reached the renewal agreement that cost him 135k 800$ per month for 20 years, from which one begins to understand why the "repair" was delayed and why the state does not participate (and will now cost the state much more)

These condo owners "are" the HOA. they probably knew about the report about repairs, they probably talked about how much does it cost for repair. If there are enough greedy owners who never agree to pay for the repair and nothing can be done to the building. They are now just trying to find some way to have HOA company insurance policy to pay for the lost rather than tapping into their own Airbnb juiced bank account. Instead renter should sue those rich greedy owners for the lost.
