The plaintiff got into an argument with his cousin, and he says the defendant damaged his car with a stick. The windshield cracked, so he’s suing for damages. The defendant argues the plaintiff tried to run her over, so she stopped his car with the stick.

I think JM should've split that one down the middle or ruled for the Defendant. The Plaintiff was trespassing & clearly came with the intent to harm. The Defendant was defending herself. Family knows your triggers. If the incident happened somewhere else, maybe the defense was excessive BUT when you pull up to my house, I'm standing my ground. The other issue is a cultural one. JM didn't like that the Defendant wasn't acting remorseful; technically, she shouldn't have to. The Plaintiff quite literally went to her house playing silly games and caught a prize he didn't like. They went over there to bully her. They could/should have arranged to have the items dropped/picked up at church, if no harm was intended.

Exactly
@synnove1046
@synnove1046 8 ай бұрын
How is this a cultural issue? Many judges make rulings based in part on how remorseful the defendant is, I see that often, in much bigger crimes than this one. I don’t necessarily think it makes a lot of sense though. In this case, even if she was in tears, apologizing and saying she felt bad about losing control of herself, that wouldn’t help fix the broken windshields. So no matter how apologetic a defendant may be, JM can’t base the dollar amount awarded on emotional reactions. But I think he should have been held responsible for half. He clearly could not see what was wrong with his behavior and attitude. Now that he won this case he’s going to think that he did nothing wrong. Unless he makes some dramatic changes in his life I pray that he does not become a minister.
@panamafernandez4641
@panamafernandez4641 8 ай бұрын
@synnove1046 I kinda feel like you asked the question & then answered it yourself. So, do I need to say anything further?🤔 People aren't going to act remorseful when they don't think they've done anything wrong. TBH...this case should have went to the Defendant. The Plaintiff was instructed not to go access the property by the owner (grandmother) so, he was trespassing. He went over with malicious intent. How/why are is testimony being considered from the admitted assailant? The only reason she ruled the way she did was because the Defendant wasn't acting weak & teary-eyed.
@trekgirl65

@trekgirl65 That's exactly the point. He shouldn't have win the case, his actions got his window broke. She had bias because the Defendant came to court in religious clothes, defended herself from the 2 ton girl & wasn't kissing the judges posterior.

One time at my church we couldn't find the cord for the coffee percolator and it was Sunday morning. The church ladies scrambled to find it but one ran home quick and grabbed her cord and saved the day so we could have coffee. When they cleaned up, they found the cord. It was in the percolator so they ended up brewing the cord and everyone drank it.

Both the plaintiff AND the defendant AND their friends are a MESS! How can they act like all of this is no big deal! If this is how they act even though they’re active in their church, how would they behave if they weren’t involved in it? I do think the plaintiff should’ve been held partially responsible for the cost of repairs because he encouraged the fighting and he didn’t just leave when he could have. Also, since when does anyone refer to a joint as a stick?

Tbh I actually believe her about the stick. I would even believe her even if she hit the back window with the stick still in her hand. He had no reason to reverse at her. They all behaved badly. And what is a dude hanging around with women like that. Is he gay? Because that's not what a straight black man would be doing.

I dont think the full amount should fall on her. For her own cousin to show up with 2 cars full of people and make like she attacked them is just vile. Too bad she didnt have the maturity to stay in the house and call the police on them all. One day she will learn you dont have to fight every time you're invited. Anger issues or not, i feel like the cousin and his friends got what they were looking for and she should've dismissed it.

FACT: If you're going to be telling everyone about the huge fight you were in with whomever, the first thing you don't want to do is tell about how religious you are. That's a bad reputation, not only for yourself, but also (to an extent) for your church family. If you really want others to think you're all grown up, ACT LIKE IT‼️

@synnove1046
@synnove1046 8 ай бұрын
I think JM wanted to know what the stick was to figure out if it was solid/heavy or something hollow. Or maybe she wondered if the defendant had brought it outside with her with the intention of using it in the fight or to vandalize, or if it was a part of something that could reasonably be expected to be found outside the house, like on a porch or in a garage/carport.

Yes, everybody sins, and all sins are equal. Also anything can be forgiven by God. But we are supposed to make a true effort not to sin, not just use God’s forgiveness as an excuse. Fortunately we humans aren’t going to make the actual judgement, and God always knows what is in our hearts.

This case is exactly the problem with the church. People are growing up in the church but not in Christ. Then they see a career in ministry for all of the wrong reason. Finally, they have no real conviction about sins and boast in scriptural standards to defend themselves. The worst part is that they will end up in charge of a church and continue those flawed theological practices. “Many will say to me on that day; Lord did we not prophecy in your name and cast out demons in your name? And I will say get away from me, I never knew you.”
