I'd like to understand how they swore under oath that they would go with precedence on Roe v Wade and then went ahead and overturned that case. Shouldn't that also be reviewed? There isn't any way to police yourself when you have no conscience and are corrupt. We need to hold these justices accountable.

They were careful in how they spoke about it. Look, they're lawyers, and as lawyers they know how to carefully phrase their words so as not to get caught in a trap. In fact, none of them came out and said how they would rule on any specific case. What they said was that "Roe v. Wade" was the then-controlling precedent (which it was). None of them promised not to overrule that precedent. Was it deceptive? Absolutely. But legally speaking, it wouldn't count as perjury.

What you suggest is NOT in the Constitution. It takes a constitutional amendment to make any changes to the constitution. And the entire house of representatives would have to Vote on this, it must pass by 2/3 of house votes to pass to an amendment. Or 2/3 of the 50 states must request a new amendment, by a convention of States. Then, the states legislatures would have to ratify the amendment by a 3/4 votes, or 3/4 votes from the convention. You don’t understand government.😊

A principle since Magna Carta (in the British legal tradition, that USA for the most part inherits) is that the law applies to everyone. There are exceptions, for example powers explicitly granted in the constitution and other laws.🍁

An article III judge doesn't have to be a member of the bar, or even a lawyer. Yes, they can be charged with violations of the law and Thomas (in my estimation) is fixing to find out.

Good question. Thomas has accepted bribes for quite some time. Sen. Menendez just got convicted of selling influence, and rightly so. Why is Thomas above the law? His refusal to recuse himself has destroyed any credible claim he has on impartiality. He is a joke and an embarrassment to the court. If his benefactors even come close to having a matter before the court, he should recuse. He has turned up his nose at any suggestion. That is what has to stop!

Averages were dramatically skewed by infant mortality. Yes, life expectancy has improved, but this common bit of trivia is misleading. If you made it into adulthood, you still had a good chance of living to old age. There are numerous good arguments for reform - this isn't one of them.

​@Zetirix You could argue that both amy coney barret and brett Kavanaugh were appointed in incredibly dubious ways and not vetted appropriately for the position. Clarence Thomas is possibly the most corrupt court member that has ever existed and justice Alito has not been recusing himself from cases that he has incredible bias in. The appearance of inappropriate behavior is all that is needed and they have been acting inappropriately and the public can see that. So I count 4 that are more then questionable. It has nothing to do with their views. It has to do with corruption in appointment and in behavior. It is unfortunate that you cannot see that. This is not an us against them issue. This is not Democrat vs. Repulican. This is an issue of the safety of democracy.

Canada has had a mandatory retirement age for justices (75) since 1927. Justices must have 10 years experience as an appellate court judge or as a member of the bar for appeals and are recommended by committee to the Prime Minister who recommends their appointment by the Crown. Removal is very similar to the US impeachment process, except that there is no formal trial in the Senate.

I agree. When the framers wrote that in, appointed justices were already older men who only served maybe a couple of decades if that before they croaked. Things change, times change, and the framers could not have possibly anticipated how much change was to come but they did have enough forethought to make the Constitution amendable which allows us to update it through amendments.

18 years is still far too long, an appointment to the Supreme Court should be the cherry on the top of a long career for judges nearing retirement, 4 years is long enough and will allow for more deserving judges to achieve the goal of becoming a SC Justice. It should also not be a political appointment, they should be chosen by their piers based on merit.

Need A LOT of changes to the US court system, from term limits, to ethics oversight committee, to accountability and consequences, to not being able violate laws and the US Constitution, to expanding it to thirteen members, to not having them appointed by presidents, but through a more democratic measure.

A lifetime appointed Supreme Court is effectively a king made up of 9 justices. Everything in this country is their business if they choose to hear it. 9 people decide the fate of millions. The institution is a monarchy

You're cancelling out the checks in the system - that the Senate approves nominations. That involved all 3 branches into the cycle and provides stability historically. It would turn into a BIGGER mess of favoritism, and that would be an example of autocracy, not representative democracy on this the Constitution is founded... people's vote for their Senators in this case, would be negated and they would have no second say in the balancing.

The Constitutional Amendments you mentioned-one for SCOTUS re term limits with two appointments per presidential term and another amendment re presidential immunity-are magnificent proposals because they will take us much closer to having a more perfect union and, crucial for our democracy, they will be excellent campaign issues for us Dems.

He can totally nominate more justices, there's no set number in the current constitution.. It's the senate confirmation on the expansion and then the justices themselves that would take the time, probably more than there is available right now.

And I don't think biological age proper is actually what a lot of people are concerned about when they say "too old". They are concerned about his not being able to even properly conceive of the challenges facing younger people.

Let the president nominate, the senate confirm and every 2 years the JC justices come up for re-election, same cycle as the house of representatives. If the justice is corrupt (Thomas) or lying about respecting precedent (Cavanaugh and others) we the people could vote them out. The research would be simple. Even Fox viewers disapprove of Thomas.

No, very wrong. As an example, the first chief justice John Jay lived until 83. Thomas Jefferson also lived to 83. These aren't highly unusual ages for the time.

Well. You and I are passengers on this roller-coaster, so try not to despair. Dems in power (Biden, Schiff, Jeffries, ...) are doing what they think is the right thing to do, to avoid Trump getting back in power. Soon (DNC?), they'll get onto the same page. In the meantime, enjoy the outdoors in summer! (I made mulberry jam last week; peaches are on sale by the roadside, and cicadas just started singing yesterday.)

I was infuriated, too - that kind of move is why I didn't vote for Schiff in the primary. He could have expressed himself privately and gotten word to Biden's team that way if he had genuine concerns; instead he's seeking publicity for it, which makes me wonder about him even more.

Article III never says “life tenure.” What it does say is that they’ll hold office during good behaviour, but it does not say anything about how long during good behaviour.

What that means is that barring "bad behavior," which would have to be determined at a Senate impeachment trial, they continue to serve. So it is effectively for life, or until the justice chooses to retire.

When the constitution was written, "for life" meant to a maximum age of life of 60yo. Now "for life" could mean to 100yo.

That's a lie. Don't do that. The first justice lived to 84. The seventh to 87. Of the first 25 justices there was one who died in his 40s. And one who died in his 90s. Four who died in their 50s, and four who died in their 80s. The average age was 68.6. Looking at the first 25, I see terms: 20 years, 15 years, 31, 34, 30, 16, 18, 23, 33, 20, 32, 32, 28.
