Cdai & Rondo trial finished before they caught Tay, so when they finally did catch him, it was to late to use him as a witness + the DA already won the case against Cdai & Rondo, so they Extradited Tay from Atlanta to Chicago & locced him up for refusing to testify about the statements he made & documents he signed saying he would testify
