One thing to remember though is that the landlord may not get nothing from a tenant who may already be struggling financially. This is especially true for those on SSI who may have been struggling to keep up and just couldn't do to lack of money. When you're on SSI, you're judgment proof.

I been staying in these lofts for two years and never had any problems 3:18 we now have new property management and the landlord is saying I’m trusting passing because I’m not in the lease use the police to give me a trust passing ticket is this enough for a small claim and if so any Pointers

If you are not listed as an occupant or tenant on the lease, you do not have a legal right to occupy the property.

Hi every repair is documented via text and has always been delayed. Should I withhold rent for a two separate floodings of sewage that happened a week apart because a plumber never diagnosed the problem rather they blamed us for the utility sink possibly being stopped up

This is really a legal question but one thing we can say is that withholding rent is a process you must be careful with. If you choose to do that, it is best to speak to an attorney for some advice and make sure you set up an escrow account. You must still pay your rent, even if it is not directly to the landlord. Instead, you want to notify the landlord that rent will be withheld due to the lack of repairs and pay into that escrow account until the matter is resolved. Simply withholding rent could cause you additional issues down the road and the landlord can further come after you for nonpayment.

First and foremost, we are sorry to hear of your loss. It's important to gather as much documentation as you can regarding her lease and payments. Typically, the deposit of a deceased individual is handled that same as if the tenant vacated. However, deposit laws can vary by jurisdiction, so it is a good idea to speak with a qualified attorney in your area. If the landlord has no grounds to withhold the deposit, it should be returned to the estate.

@@BayManagementGroup This explanation makes perfect sense. It may be the family still had possession when rent was due, or maybe didn't empty the house, or maybe there was damage/cleaning. It is possible there is no security deposit that should be returned.

As a tenant. Who was renting with no lease. Would I have a chance at attempting to recover a security deposit in court? Or is it pointless?

Nothing is ever completely impossible, but without a lease, a receipt, or something to show where the money went and what it was for - it would certainly be an uphill battle in court.

While there is a lot we don’t know about the situation, a good few steps to take could be the following - • Keep a detailed record of when the gas service was disrupted, any communication with the landlord regarding the issue, and any attempts you've made to rectify the situation. • Reach out to local housing authorities to report the issue. • If the lack of gas poses a health or safety risk, report the issue to relevant authorities such as the local health department or building code enforcement agency. • Try to communicate with your landlord to negotiate a resolution. Explain the hardship the lack of gas has caused and request a rent reduction or other compensation for the inconvenience. • Depending on local laws and regulations, you may have the right to withhold rent until the gas service is restored. • If that doesn’t help, consider consulting with a tenant rights attorney to understand your legal options. Some cases problem can’t be resolved within few days. Replace or repair gas line could take few hours or few months. Some cases you have to apply for permit to replace gas pipe lines. Landlord could give 30 days to move out notice to tenants.

My landlord took most of my increase, because he said his taxes also went up. I may get fair housing involved to investigate to see if his taxes really did go up! I don't know if his tax is really went up or not, all I know is what he said. If push comes to shove, I can always have him audited if absolutely needed.
