I wish you were right. But really, the issue with most of these cops is they are just jerks looking for an outlet to be a jerk. They are jerks when they wake up, all day long, and when they go to bed. They probably kick their wives while they sleep. We systematically hire the worst people we can find, to do this job.

Which is a manifestation of the lack of control they *need* vs what they have inside. They are insane... and dumb... and that is a very bad combination when they are treated like gods(the ability to murder you or anyone else at any whim with no recourse is about where it is at, or might as well be).

Yup. Crazy thing is, I have a friend who's a cop rn and has been for a full year. He had to go to a neighboring city because the city we live in did not hire him because he failed his Psyck evaluation...yeah of all things that could have caused him to fail it was that. They deemed him unfit to be an officer But he somehow got in just by going to a city 20 mins away...? Yes my friend and all and he hasn't done anything bad but the fact that you can fail something like that and basically still get in ..?? Weird

The fact that thr officer said that if he didn't see it through to its conclusion that the guy would go to the police department and file a complaint is very telling. The officer is clearly being nothing hut retaliatory and self-serving at that point.

No, it means now he has to follow protocol, because he knew he’d be investigated. He was right. None of it had to happen, but the citizen was more interested in fighting and being disruptive than just agreeing not to drive 40mph in a gas station public parking lot.

Its unclear why the officer thought a complaint would be seen as less valid if the interaction resulted in an arrest. (Also: how likely is someone going to go to the trouble of filing a complaint if there is no arrest? Most would just shrug and go on with their lives.) A lot of "cop logic" going on in this guy's brain.

If you saw the original video, the guy arrested really wasn't disrespectful at all. The officer was an absolute psychopath, and I'm so glad they are considering filing charges against the officer. The officer was even saying on bodycam multiple times that he was concerned the guy was going to make a complaint against him. The officer was the one who escalated the situation, which cannot be seen on this video, and he gaslighted, blaming it on the guy. Then, the officer demanded an apology from the guy as if the guy is his son or some subordinate for several minutes, and since the guy wouldn't apologize, the whole encounter blew out of proportion, and then the officer arrested him--a clear case of retaliation. This officer is insane, and it's all on bodycam. I'm so glad he's off the streets. He's absolutely crazy.

My nephew was a state trooper for over 20 years before he retired. He stated at one Christmas that how much respect you showed him determined if you got a ticket or not. He said that usually young white guys always got a ticket. He also admitted that they had an unofficial quota of tickets to write. The sad thing is that he retired because most of the new troopers coming in are ex-military and they have even less training. Being in the army their way is simple, obey my command or get shot or arrested. He was too afraid that if he continued as a cop that he would be caught in a George Floyd moment or the opposite extreme, Serpico moment. That is what most police have become in the US.

Says a lot that it took this story going viral before the department pretended to do anything at all about this unlawful arrest. I grew up in Texas, and I must say that something is definitely wrong the people hiring law enforcement. No way I would interact with one without my phone recording the entire time. Their egos dictate what happens far more than the actual law.

Had a friend who complained about an officer and was harassed by that officer. He would look for my friends truck and pull him over for no reason. -I think officers make up their own rules!!-We taught our children to trust the police. I’m not so sure anymore!!

Need to end qualified immunity and hold them accountable for actions like this. If the officers were actually held personally liable for rights violations, things would change. IM a private pilot and live next to an airport. One day a plane crashed on departure. I went over and had a look. The millennial Sherriff Deputy came over questioning me on how I heard about this crash and that he could cite me for having a scanner. I asked for his supervisor and he left me alone. Our Govt is completely broken at every level.

This cop should absolutely be fired.. This guy should get a decent settlement for his time and heartache. Criminal charges is a little excessive, because I don't believe anyone should face a harsher punishment just to "send a message" to the rest of society. I saw the whole video, and there was no reason for the cop to act like that. You are allowed to voice your opinion without retaliatory action escalating like this. After he said he wasn’t going to write him a ticket, it should have been over. This is a great example of why people don’t like the cops.

He was arrested (but let go) for contempt of cop. The cop has a huge ego problem and should be fired at once. He's a danger to other cops and to the people that pay him to police them. The cop worries about a complaint if he doesn't arrest him? It goes to show you that they arrest people just to make cover. We need real change and we need it now!

The Superior Court made it worse years ago when they ruled that officers have no obligation to put themselves In Harm's Way to protect the public. That along with years of qualified immunity allowing murderers and rapists that carry badges, be free to move to the next town over when exposed and resume horribly violating, stealing from, and murdering civilians with impunity (besides.. you know.. having to move to the next town over to continue doing it until you're caught again).

When departments hire a bunch of ex-military who were in Iraq/Afghanistan, they end up with a bunch of people who think everybody they deal with is an enemy combatant. Combine those people with the people who become a cop to fuel their ego and have authority over people, and you get this

Well flip side of the coin is the fact that in many areas that they work everyone has to be seen as a combatant if you have to do your work, but in cases like this it's really excessive. This officer clearly overstepped his mandate. Or it is a lack of training in basic police procedure.

Cop was right. When the citizen said “i know you want voluntary compliance,” that’s a threat to authority and to the public. He screwed up there. Also, private property exclusion doesn’t apply to a public space. Driving 40mph in a large gas station parking lot should be ticketed. And chances are good that Bucees has policies in place to allow authorities on their property to enforce public peace. If this guy owned the parking lot and did not allow it as a public space, then he’d be correct.

The cop even said, he's gotta see this through,because if he doesn't, he's going to go down and file a complaint on him! That's called RETALIATION! - -So, he retaliated because he didn't get the boot licking he thought he deserved. -He arrested him without probable cause, and because he argued with him, which is his 1st amendment right. -He admitted he was following through with the arrest, because if he didn't, the man would likely go right down and file a complaint on him. (Which was likely an attempt to get him to promise not to do that) The department needs to do a better job with their hiring process. If they would REQUIRE a lie detector test and psych exam for every applicant they think they may hire, they could weed out psycho cops, with ego issues, who use their badge to retaliate, not enforce actual law, and who can't admit they were wrong, and just back off, so they escalate until they believe they have an arrestable offense.(those are the worst!) It's much easier NOT TO HIRE someone like this cop, than to FIRE him because of the Unions, who don't care if dangerous psychopaths are patrolling our streets!

The whole stop is on youtube via the officer's bodycam. In no way was the man being disrespectful. He was definitely annoyed about being confronted about a non-issue but the cam clearly shows that what escalated the situation was the man telling the officer he was wrong about a law. He literally could not handle being corrected.

I am pretty certain their Internal Affairs (IA) department invested in only 1 stamp. The green one called "innocent" and couldn't afford to buy the red "guilty" one. Basically they just rubberstamp innocent on all IA probes and say "we found no wrong doing" or "officer acted in accordance with policy and procedure".

They could care less. If found breaking the law, the officer gets a slap on the wrist and taxpayers foot the bill. In no way does it affect the department. However, in state or federal investigations where it's found that wrongdoing runs amok, county sheriff's offices and city police departments have been shut down entirely when the corruption stems from top to bottom. Sadly, in this instance, neighboring departments are tasked to pick up the slack and the affected communities are left with little to no law enforcement or timely emergency response.

@@jeffnelson3791 So do any prospective police recruits. Seasoned officers are walking off of the job simply because it's not worth it to begin with. Without qualified immunity, the legal implications for any new recruit being slapped with a lawsuit the first time out into the public would be staggering. It's bad enough that every sizeable department has to hire police to police its own police. How would getting rid of qualified immunity ultimately affect the police union when a new recruit or any officer's integrity come under fire? Union dues won't be enough to provide them effective legal representation. Yes, police are presumed innocent just like the rest of us. Besides, how do you insure such a force? Will the police start billing people for responding to complaints like an ambulance does to a medical emergency? There's just too many questions and no foreseeable answers in this unlikely scenario.

Hello. Back the Blue type here. Back the Blue doesn't mean standing by corrupt or bad cops... Bad cops are the absolute worst and we need to investigate them and remove them from the force if they are found to not be 100% professional and lawful. It's really not a hard concept. Stand by good cops. Remove/ prosecute bad cops. 99% of cops are amazing patriots who risk their lives for us on a daily basis -- the people they have to deal with are the worst. I can't imagine what they go through... Back the blue.

The good cops suffer for the cops that act like that. Some people are smart mouthed, but that is no reason to detain without probable cause. It's better for them to turn the other cheek, because dealing with the general public you meet all kinds. If a law was broken, that is a different story, but if it is something menial, there is nothing wrong with giving someone a break with a warning. That is a place where a cop can enforce whatever it is, if the person has a bad attitude. Personally, I don't think this guy had a bad attitude at all, it was the other way around. Furthermore, he was out of his jurisdiction being in a parking lot, for a traffic violation, to start with. He could have simply said that he needed to drive more safely in a parking lot, because that is where many accidents happen, and been on his way. You may find that using a carrot instead of a stick works better. We need police protection today even more than the past, let's not screw it up because of cops like that. They may need to emphasize more in training or the police academy on how to do traffic stops more respectfully.

We call them Tyrant PIGS, not cops. The Tyrant PIGS will violate your civil rights, and possibly murder innocent civilians. These scum bags need to be dealt with all across this nation. There should be a no tolerance policy nationwide, that if you so much as get one civil rights complaint, your career in law enforcement is over end of story. These PIGS get passed on to other depts, when they should never be allowed to police. In Atlanta a cop talked 2 people out of committing suicide in one calendar year and was known for being very community friendly. One would think she won cop of the year but, instead they fired her because she didn't meet the quota for arrests especially juvenile arrests. Goes to show what we are dealing with.

Something like this happened to me in the mid 80s, right after I got out of the military. Cop roughed me up, charged me with resisting arrest. Charges were later dropped. I have never forgotten about that, and have a chip on my shoulder to this day. I taught my son to stay away from cops. They are not your friends.

100%. In the early 80's I was at Cooters, a bar in Houston. I had a bit too much to drink, as sometimes happens to young single men. Instead of handling the incident professionally two bouncers (off duty Houston cops) started roughing me up pretty badly after taking me back into the fenced in empty keg storage area out back. Then two of their on duty cop buddies came to take me to jail. On the way in they were laughing and joking and saying they would file assault charges on ME, for doing nothing to them. And they did. Felony assault charges in TX. That would have been a nightmare. But the judge saw through the charade and let me go. Their buddies on duty were not happy. I would still probably be there if my friend Francine didn't sweet talk the cops into letting me go. I will NEVER EVER believe a cop's testimony unless there is clear video evidence to support it. End qualified immunity and take settlements out of the cops pension fund and a lot of this crap would stop.

What does this have to do with qualified immunity. The key word is 'qualified'. It only protects the actions of public officials who act lawfully and within the scope of their authority. In order to be qualified, a police officers action must be legal and within department policy. This situation does not qualify this officer for immunity, as he clearly violated department policy, and, likely committed a crime.

QI is based on precedent, so unless a public official violated rights in almost the exact way before then it's qualified, but since you can't set precedent in qualified immunity then there's never a first time to actually set a precedent then the only precedent rights violations that would make qualified immunity not be granted are those created before qualified immunity existed. It's a clusterfudge and it needs to be abolished under its current form and codified into law.

Tyre Nichols was beat to death by ALL FIVE officers that stopped him. Think of that. What are the statistical odds of 5 of 5 officers a) being okay with beating a suspect in cuffs b) being the only bad apples in the entire precinct, and c) all being on the same traffic stop? That has to be lottery ticket odds. The reality is the partner is just as bad as the guy arresting. There’s no such thing as a bad apple when all the apples everywhere are rotten.

You can't take them to jail for arguing.. and the threat of arrest over a disagreement is 100% illegal! You need to file a complaint first and serve them with a notice of claim.. the will find no wrongdoing.. they ALWAYS find that they did nothing wrong.. but to threaten someone under color of law, and to KIDNAP them under color of law actually has a penalty up to and including DEATH! Read that law again!!

It is illegal but before video cams everywhere they did it routinely. Now they are starting to feel the heat of public backlash and they seem utterly confused as to why more and more people are starting to hate them.

@@ChronicExcessiveManliness Out of curiosity, isn't qualified immunity in place because of ruling by the U.S. Supreme Court? Wouldn't that mean that ultimately, if someone DID sue the officer directly because of a state law, and won... Wouldn't the officer be able to appeal to the federal court system who would then call that entire law in to question since qualified immunity has already been ruled on? On top of that, if the officer won at the federal level, wouldn't the state have to pay for all the legal fees incurred by the officer since that is literally what the federal ruling says?

Your talking about the guy right. Look, I got stopped and the police officer was righteous thought he had found something wrong. He didn't but we left ok, he left knowing he was wrong but had to show some kind of bravado and I really wasn't interested in proving I was right. Police officers are always on guard. Stupid people like this guy wants to be on guard too and so fight with two pit bulls instead of realizing its not worth it. The guy said on private property and the police officer said no more tickets. It could've ended. The guy wanted to push it,
