Something that needs to be added; When registering with The US Library of Congress for copyright, you have a 5 year from creation limit to receive the *extra* protection. That would be that if you were wrongly sued over your song, the person who sued you will have to pay all court fees. This extra was put in place to protect the little guy from the infringer who has lots of money. It doesn't matter who has more money as long as you copyright within 5 years from creation to keep these rights.

Thanks for making this video, I am not the most eloquent with my words when trying to explain to my new band members about copyrights. They look at me like dog who was just showed a card trick. Once I showed them this video they finally got the importance of getting our songs copyrighted.

If you publish a song online the release date is a proof that you are the actual copyright own. In order to have more than one proof you post the song lyrics on other websites to create more dates proof. I think another good way to make a proof for your copyright own. you can either write your song lyrics on a sheet of paper or typing paper is fine then take it to the bank to do notary. Every bank does have a "notary public" a person certified to notarize documents. it's free charge if you have a checking or saving account with their bank. All you need to do is bring your ID (driver license) with any documents that you want to have a notary. The notary person notarizes your document with his/her signature , date and seal and you also have to sign the document as well. The notary is one of the best proof for your copyright.

The rotary is “witnessing” the affixation of your signature (to important documents) -- *the notary is NOT authenticating the validity of the musical copyright creation.* US-based creatives help *PROVE* their copyright creation & copyright ownership claims to a US federal judge by *“timely”* registering their works with the US Copyright Office (either registered as unpublished or registered within five-years of the first-publication date), as that *STATUTORILY* grants them *“prime facie evidence” (presumptive legal proof)* of their copyright creation. Here are the legal citations to review: 17 USC § 410 (Registration of claim and issuance of certificate) & 17 USC 506(e) (False Representation [Criminal Offenses]). If songwriters/musicians register more quickly, either BEFORE the infringement begins OR registered within three-months of first-publication, they can pursue statutory damages (from $750 to $30,000 and up to $150,000 for willful copyright infringement) and attorney fees and legal costs against the infringer (at the court’s discretion). FYI: The US copyright registration system is very much a *“vetting process”* to help authenticate your copyright validity. It’s not necessarily about having a RAW or original music file or unpublished manuscript/song-recording that proves your copyright creation - a US federal judge *MUST* see your ISSUED copyright *“Certificate of Registration.”* Your Certificate will include your “effective date of registration,” the official United States government date stamp! Similarly, mailing a copy of your work back to yourself via a self-addressed-stamp envelope (SASE) has NO legal foundation in US copyright law. Here’s what the US Copyright Office writes, *“The practice of sending a copy of your own work to yourself is sometimes called a ‘poor man’s copyright.’ There is NO [emphasis added] provision in the copyright law regarding any such type of protection, and it is NOT A SUBSTITUTE FOR REGISTRATION [emphasis added].* Source: www.copyright.gov/help/faq/faq-general.html#poorman *Summary: If you’re based in the US, your notarized musical work will NEITHER offer you any presumptive legal proof of your copyright authorship NOR “legal standing” to pursue copyright infringers in federal court.*

Great video, I’ve released four songs after even putting them on KZfaq. I think the question on how to register once music holds up a lot of musicians from sharing their songs with the world. It’s good to know it’s not too late to get them formally registered.
