Intro: Reservations are provided to classes who have been historically discriminated and deprived as a result of the traditional social structure. Recent SC jusgement on SC/ST reservation is not to allow migrant from other state to eating away the quota meant for the native SCs or STs. Act Article 341 and 342 of the constitution of India define as to who would be SC and ST with respect to any state or UT Article 16 (4), the state may make reservation of appointments or posts in favour of any ‘backward class’ of citizens which, in opinion of the state, is not adequately represented in the public services under the state. issue: 1. the purpose fo SCT/ST atrocities act also got diluted for eg. if a person notified as an sc in one state mocing to other satte where he is not notified as sc then he is vulnerable to act 2. jusgment talk about only economic factro what about others like cultural, social etc. 3.a person is sc /st because he is born in perticular family not bcz he belong to a state 4. We are citizen of a country not of any perticular state, so one should get benefit of reservation through out the country conclusion: Reservation are made as per the population of a perticular stae for sc and st so to some extanct deciosn of supreme court is fair but the migrateory pattern and its influence and its ipact on presential order need to be revisitation. And for that Institutional process is nned of the hour like sc/st commission

What an insightful discussion. The POAA point by Deepak was quite surprising to me. How could such a significant loophole not have been addressed in the judgement? Would love to know more about: 1) any verdict on the definition of SC/ST in Prevention of atrocities act 2) most recent verdict on definition of 'backward' in 15(4), 16(4) and harmonious reading of both these articles vis-a-vis 341 & 342 3) any judgments on the idea of reservation belonging to a community rather than an individual, in which case reservations wouldn't be available to someone from caste 'x' in a non domicile state B even though the caste would be listed as SC/ST in state B. But Fundamental rights are individual, right? So probably this theory doesn't hold much water

What about sc/ st who are joining upsc, other central or state government. I don't think they deserve reservation anymore whether they get migrated or in their state. Time has come to change the rules. What about general category who are struggling to be in the merit list. We have been making race between donkey and horse from decades. If sc/st are joining govt jobs, how they can be called as weaker or underprivileged sect of society. I is so astonishing that since independence there had been no change in it..

SC gave verdict without proper analysis..Before we say india is my country. Now after this decision, people will say "This is my state" "This is my area" dont come here. Not satisfied with supreme court verdict. More analysis should have been given.

Now again few dalits will come out in roads and die in clashes and again this dalit vote using government will use constitutional way to bypass the SC order......I dont understand why SC has become so active about dalit in the last year of modi government. Are they giving modi a chance to improve his dalit virodhi image? I again do t understand ....ki why the demand of reservation have been increasing day by day instead of decreasing ?

It should be according to the ground realities. If the caste doesn't suffer from discrimination in the new state then the 2nd generation shouldn't be given reservation but the 1st generation should be as part of the social justice mandate. Also our reservation system is based on 1931 census should be updated so that only the deserving get the benefits which are so limited in our country.

According to me appointment in government services should be based on the economic conditions of the people. After every exam it should be checked that the candidates appointed under reservation actually deserve the reservation or not according to their economic conditions.If the candidate selected under reservation is well of economically then his/her appointment should be cancelled.

More discussion should be held on it in future....Submit this issue to SC ST comission....

cut off for sc st is 1950,if an sc st communities migrate how will he be able to produce documents proving him Or her of being in. sc st before 1950.Isn't it discriminatory. Supreme court must think about sc st population who have migrated, because they will not get any reservation after this in migrated state. Many have migrated for earning money like sweeper, daily wage earner. If They dont any connection with their native state they will lose their sc st status in native state too. But, if an ias ips migrated from native state he can still get reservation in native state because he has money and he can live in native home too. Supreme court must acknowledges this issue Otherwise only poor sc st communities who have migrated will suffer. Thay wont get any reservation even if they are poor, current ews reservation is also discriminatory, it only consider only upper caste people as ecomomically weaker. since,sc st communities have surname which is of lower caste they wont be able to get even economic weaker section certificate. So, it's really sad for migrated sc st poor communities that they will have to fight in unreseved category, hope suppreme court and all political parties will acknowledges this.

if he/she is an indian they have the right to live any where in indian.. but y not reservation is provided to them.. if they belong to sc/st... what kind of constitution they are making.. some migrated people from one country are becoming prime minister's in other country.. but in india an indian can't get reservation in other state if even he is poor..

A little doubt here. If a certain person is an SC/ST in a particular state and migrates to another state where also his or her community is notified as SC/ST, can the person seek reservation in employment in the state to which s/he has migrated? I seem to have missed this point if it mentioned in today's discussion. Can someone clarify?

Goverment was providing quota to sc/st's since independence .to uplift them,and to improve their social and economical conditions.But after the 70 years of independence what is the need of quota to them.Are they not uplifted to other categories level even after the 70 years of independence??????????? Professor has a good view point, indubitably he is a professor. Saideepak is against the verdict at one perceptive and at the same time supporting this at different.So sometimes this become ambiguous and at last he is not ready to take the SC decision as a whole and remember he who bring out a political angle.

This decision is over all not bad, Reservation is not diluted. Locals will love this ideas, every body is local to some area and no forceful resistance can possible. bcoz it is not harming anyone. If somebody migrated to some place then he/she should apply for his/her home state where his/her caste is recognized so no body is denying the rights. The reservation is their in some part of the country where they belongs so hope is not died yet.

since there is no native Schedule tribe is registered in states of punjab & haryana . therefore this decision can also be valid in these states also . (i.e if there is any state where no native ST is registered under contitutn , then ST's from all states will be eligible for edu. & appointment purposes . )

Why are we beating around the bush...?? Reservations in current scenarios are largely demanded for employment opportunities... Create a holistic model of education and create more and more jobs and dismantle this dubious Nexus in this regard... It should be a way forward...

There is urgent need to special status to SCST for their upliftment they don't get enough in last 60 years.

dalits need to have representation in the supreme court. there must an all India level competition exam like upsc for the appointment of judges in SUPREME COURT. KUCH MANUWAADI BAGAD BILLE PURI EK COMMUNITY KA FUTURE DECIDE NAHI KAR SAKTE especially when they are completely unaware of ground level conditions.

How can people generalise the social status of different states to be same.....not only for dalits but there is also chance of getting discriminated for every community ..... historically dalits are not inhabitant in north eastern region....there fore they can't blame the other community of those states for the historical discrimination against them.... bodos, kukis,nagas etc indigenous STs, SCs are privileged for such benefits in that area....

there is not significant % of govt jobs therefore GD has not any importance regarding govt job in respect of reservation . in short judgement is pointing out that any SC/ST member can become socially, economically, politically and educationally stabled in India only because of changing his/her state due to any cause. just a political joke and tragedy for SC/ST.

lol. SC says caste is an localized phenomena. the panelists also agree. Even the British classification of caste was on localized, regional factors. This clearly deflates the narrative pushed by these dalit activists, Political parties and reservation proponents . they claim hindusim or brahminism has oppressed people throughout India as if the religion or upper castes have had some sort of centralized power structure to oppress lower castes throughout india. This logic should be used in dealing with acts such as SC ST atrocities act or reservations in promotions cases further by the court and end this fatlu dalit activism , reservation politics narrative once and for all.

In 70 years time our generations passed but still they don't find anyone socially, economically & financially backward in general casts and similarly no one comes out of poverty as far as sc st are concerned. What about the exams which we had already appeared from other states? Because at the time of filling forms no such sc/st restrictions were made. Will it still be implemented and did aspirants wasted their energy and time just because the SC has given its verdict in the time of declaration of results? .. . . And what about Obc? Why only sc/st? . Modi would be getting less votes this time thats for sure as far i see it.
